HomeMy WebLinkAboutR - 2024-01- Resolution Necessity for Capital Improvement Project 2024-1 RESOLUTION OF NECESSITY FOR CAPITAL IMPROVEMENT PROJECT WHEREAS, at a Meeting of the City Council of the City of South Burlington ("Council") duly warned and held on April 17, 2023, the City's Department of Public Works Director ("Director") and Aldrich & Elliott, the consulting engineer engaged by the City of South Burlington ("City") to assist with the design and implementation of the project, recommended there was need to install, erect and integrate into the City's potable water supply system a new Two Million One Hundred Thousand gallon water storage tank sited adjacent to the City's existing water tank on land west of Dorset Street to assure sufficient future water service to the water customers of the City's water system and to improve system water pressure; and WHEREAS this capital project is estimated to cost Five Million Seven Hundred Fifty Thousand and 00/100 Dollars ($5,750,000.00); and WHEREAS the Director and Aldrich & Elliott explained that the tank as designed has a capacity of 2.1 million gallons which is expected to meet estimated customer demand for water into the foreseeable future and address system pressure issues; and NOW THEREFORE BE IT RESOLVED that the Council finds that the public interest and necessity demand that the City design, engineer, plan for, install and erect a 2.1-million-gallon water tank adjacent to the City's existing water tank on land west of Dorset Street to assure sufficient future water service to the water customers of the City's water system and to improve system water pressure ("Project") at an aggregate estimated cost of Five Million Seven Hundred Fifty Thousand and 00/100 Dollars ($5,750,000.00); and BE IT FURTHER RESOLVED that the costs of the Project after the application of available state and federal construction grants-in-aid, appropriations, reserves, and other funds (including ARPA funds) available to the City, if any, are too great to be paid out of the ordinary annual income and revenue of the City; and BE IT FURTHER RESOLVED that a proposal for undertaking the Project and to issue general obligation bonds or notes of the City in an aggregate principal amount not to exceed Five Million Seven Hundred Fifty Thousand and 00/100 Dollars ($5,750,000) to pay for the Project and related costs of issuance and expenses should be submitted to the legal voters of the City at the annual City Meeting to be duly warned and held on March 5, 2024; and BE IT FURTHER RESOLVED that a public information meeting will be held to discuss the Project and the issuance of bonds on Monday, March 4, 2024, commencing at six-thirty o'clock (6:30) in the afternoon (p.m.) to be held in-person 1 at the City Offices and also electronically on the Zoom platform, the specific details and dial-in numbers for the Zoom element will be as specified in the Warning for the Meeting and the warning for the public information meeting; and BE IT FURTHER RESOLVED that all acts relating to the proposition of incurring bonded indebtedness and the issuance of general obligation bonds or notes of the City for the purpose of financing the Project be in accordance with the provisions of Chapters 53 and 120 of Title 24 of the Vermont Statutes Annotated; and BE IT FURTHER RESOLVED that the attached form of the Warning and form of Ballot are specifically adopted for use in connection with consideration of the above-stated proposition of making public improvements and incurring bonded indebtedness therefor.
