HomeMy WebLinkAboutSP-90-0000 - Decision - 0003 Bacon Streetr FINDINGS OF FACT & DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact, application of Atlantic Cellular/Cellular One for conversion of a vacant 7,190 square foot building to cellular telephone sales and service use at 3 Baldwin Avenue. On the 14th of August 1990, the South Burlington Planning Commission approved the above referenced site plan under Section 19.10 of the South Burlington Zoning Regulations based upon the following findings: 1. Atlantic Cellular proposes to renovate the former Regal Optical building on Baldwin Avenue for use as a cellular tele- phone sales and service. The footprint of the building will be changed with the addition of an entrance vestibule. Two (2) new overhead doors will be added at the south end to accommodate vehicle access to the interior for installing car phones. 2. Access/Circulation: Access is via one (1) 20 foot curb cut on Baldwin Avenue to a 20 foot access drive. Circulation will be adequate due to appropriate aisle widths in the parking area. 3. Setbacks/Coverage: The building is currently non -complying along the front, east side and rear setbacks. Since this is an existing condition, no variance is required. The front yard coverage, as proposed is 22% (maximum allowed is 30%). Building coverage is 26% (maximum allowed is 30%). 4. Parking: 14 parking spaces are required and 15 spaces are being provided including 1 handicapped space. Size of parking spaces and width of aisle meets minimum requirements. 5. Traffic: This property is in Zone 4 of the Traffic Overlay District which allows 23 peak hour trip ends. Based on I.T.E. trip rates, the use will generate 11 peak hour trip ends. The property is located within the limits of the Shelburne Road Traffic Impact Policy. 6. Landscaping: The proposed use requires $7,500 in new land- scaping. The landscape plan shows Norway maple, Japanese Lilac and Yew which meets the required value. 7. Sewer: The proposed use is estimated to generate a sewage flow of 105 gpd. DECISION & CONDITIONS The Site Plan application of Atlantic Cellular One for conversion of a vacant 7,190 square foot building to cellular telephone sales and service use as depicted on a plan entitled, "Atlantic Cellular Company, Cellular One, South Burlington, Vermont", prepared by Brad Rabinowitz Architect and dated 6/27/90 is ap- proved with the following stipulations: 1) The applicant shall post a $7,500, 3-year landscaping bond prior to permit. 2) The applicant shall contribute $282 to the Shelburne Road Intersection Improvement fund based on the 11 peak hour trip ends to be generated by this project. 3) A sewer allocation of 105 gpd is granted. The applicant shall pay the $2.50 per gallon fee prior to permit. 4) The plan shall be revised prior to issuance of a building permit to show a manhole or inlet on Baldwin Avenue where the new storm sewer is proposed to connect to the existing storm sewer. This shall be approved by the City Engineer prior to permit. 5) A revised plan showing the new entryway addition shall be submitted to the City Planner prior to obtaining the zoning permit. 6) That exterior lighting be downcast luminaire. 7) That there be no outside storage. 8) A zoning permit shall be obtained within 6 months or this approval is null and void.
