Findings of Fact. Conclusion of Law & Order
This matter came before the South Burlington Zoning Board of Adjustment on November 24,
1997 by the application of Yoram Somets and Todd & dawn Lawliss, the appellants for a
conditional use approval to operate a day care center in conjunction with a general office use
located at 3 Baldwin Avenue. The Board of Adjustment finds as follows:
1) That the property in question is zoned Commercial I District.
2) That the property is occupied with a 7965 square foot structure.
3) The existing use is general office use.
4) The proposed use is a day care center for a maximum of thirty nine (39) children.
5) The proposed day care center will occupy approximately 2640 square feet with a play lot of
1200 square feet installed within the front yard.
6) The building has been inspected by State Agencies for compliance with minimum requirements
for day care use.
7) Average daily traffic activity is 39 vte's on Baldwin Avenue.
8) The day care use is projecting an increase of 14 peak hour trip ends.
9) Hours of operation is 7:00 A.M. to 5:30 P.M.. Morning preschool 10 children and afternoon
29 children.
10) Zoning Board of Adjustment stipulated that a eight foot wood fence be installed along the
easterly property line.
11) Sewer and water is available and does not create any adverse impacts (additional 200 gpd is
requested).

3 Baldwin Avenue is GRANTED
