FINDINGS OF FACT & DECISION

Re: Findings of Fact, application of David Grippin to amend Site Plan Permit #SP-99-63 for
a 7,965 SF general office building, issued November 2, 1999, to change the layout of
parking areas, relocate a dumpster and relocate landscaping elements, at 3 Baldwin Avenue,
South Burlington, VT 05403. The Owner of Record of this property is 3 Baldwin Avenue
LLC.
On the 25th day of June, 2001, the Director of Planning and Zoning approved the request of
David Grippin for site plan review under Section 26.10 of the South Burlington Zoning
Regulations based on the following findings:
1. This amendment consists of minor changes to the approved site plan to relocate
landscape elements, relocate a dumpster, and make minor changes to the approved parking
areas.
2. The record owner of the property is 3 Baldwin Avenue, LLC. The property lies
within the C1 district. It is bounded on the east by single family residences, on the north by
Baldwin Avenue, on the west by a restaurant, and on the south by an auto service station.
3. Access/circulation: Access to the property is provided by a 20-foot curb cut onto
Baldwin Avenue. This will remain the same. This amendment will make minor changes to
the layout of parking areas on the property, none of which will adversely affect circulation.
4. Coverage/setbacks: This amendment will have no impact on existing building
coverage (26.3%). The amendment will increase total site coverage from 30.1% to 35.4%.
Front yard coverage will increase from 23.6% to 29.7%. These coverages are within the
limits for the C1 district.
5. Pam: The proposed amendment would reduce the total number of spaces from
30 to 29 spaces. Under the Zoning Regulations 32 spaces are required for the building. On
August 17, 1999, the Development Review Board approved a two -space waiver. The
reduction from 30 to 29 spaces is proposed to improve the walkway along the side of the
building. The revised parking layout for 29 spaces includes two handicapped spaces. A
bike rack is proposed to be installed. As the proposed reconfiguration will increase the area
of the pedestrian walkway, and no additional VTEs are projected, the reduction in total
parking by one space is recommended.
6. Sewer: No changes to the approved wastewater allocation of 1,000 gallons per day
are proposed.
7. Lighting: No changes to the approved lighting fixtures are proposed.
8. Building height: No changes to building roofline or height are proposed.
9. Traffic: No changes that would result in any additional trip ends or other traffic
impacts are proposed.
10. Landscaping: The landscaping changes proposed will relocate two Norway Maples
and one Japanese Lilac, and remove one Norway Maple. An area along the southwest side
of the building will be restored to turf. The site is well landscaped and no additional
landscaping to replace the Norway Maple to be removed is recommended.
11. Dumnster: The existing dumpster is proposed to be relocated to the southwest
corner of the property.
DECISION AND CONDITIONS
Based on the above Findings of Fact, the South Burlington Director of Planning and Zoning
approves the site plan application of David Grippin to amend Site Plan Permit #SP-99-63
for 3 Baldwin Avenue, LLC, dated November 2, 1999, to change the layout of parking
areas, relocate a dumpster and relocate landscaping elements, at 3 Baldwin Avenue, South
Burlington, as depicted on a plan entitled "3 Baldwin Avenue, LLC Site Plan," prepared by
Champlain Consulting Engineers and dated 8/16/99, with the following stipulations:
1) All previous approvals and stipulations, which are not superseded by this approval, shall
remain in effect.
2) A reduction in the required parking from 30 spaces to 29 spaces is approved.
3) The relocated dumpster must be screened from view from public streets.
4) Any change to the site plan shall require approval by the South Burlington Development
Review Board.
5) Any new exterior lighting shall consist of downcasting shielded fixtures so as not to cast
light beyond the property line. Any change in exterior lighting shall require approval of
the Director of Planning & Zoning prior to installation.
6) No changes to parking, landscaping or access and circulation other than those approved
in this permit shall be allowed without prior approval.
7) A zoning permit shall be obtained within six (6) months or this approval pursuant to
Section 27.302 of the Zoning Regulations, or this approval shall be null and void.
8) A Certificate of Occupancy/Compliance shall be obtained from the Administrative
Officer prior to occupancy of the proposed structure.
