Mr. Bresee asked that the Mall cover the walkway from the parking garage to Sears as it
got very slippery and icy.
9. Application #CU-05-02 of Community Lutheran Church seeking conditional
use approval under Section 14.10 Conditional Use Review, of the South
Burlington Land Development Regulations. Request is for permission to
construct a 1112 sq. ft. addition to a place of worship, 1560 Williston Road
and
10. Site Plan Application #SP-05-05 of Community Lutheran Church to amend a
previously approved plan for a 8593 sq. ft. place of worship. The
amendment consists of constructing a 1112 sq. ft. addition for place of
worship use, 1560 Williston Road:
Mr. Belair noted there are landscape waivers being requested which staff does not favor.
They feel the lot is large enough to find space for landscaping. In addition, the plan does
not show the required number of parking spaces. 9 more are needed for this addition.
This would still put them below the required minimum.
Mr. Lamoureaux agreed to stripe off 9 more parking spaces. He also noted there will be
no removal of existing trees for the new construction.
Mr. Dinklage suggested plantings around the addition. Mr. Lamoureaux said thee could
be some low foundation plantings. He added they want to develop a peace garden over
the years and could include some of that in this budget, about $2000. Mr. Boucher noted
this still leaves them with a $6000 waiver.
The approval motion was amended to eliminate Stipulation #3a and a stipulation granting
a $6,000 landscaping credit.
Mr. Boucher moved to approve Application #CU-05-02 and Site plan Application $SP-
05-05 of Community Lutheran Church subject to the stipulations in the draft motion as
amended above. Ms Quimby seconded. Motion passed unanimously.
11. Application #CU-05-03 of Start to Finish Construction seeking conditional
use approval under Section 14.10, Conditional Use Review, of the South
Burlington Land Development Regulations. Request is for permission to
allow a 12'x14' addition to a single family dwelling to encroach five feet into
the required front yard setback, 63 Meadow Road:
Mr. Ploof showed the location. Mr. Belair said staff had no issues.
Mr. Boucher moved to approve Application #CU-05-03 of Start to Finish Construction
subject to the stipulations in the draft motion. Ms. Quimby seconded. Motion passed
unanimously.

Project Description
Start to Finish Construction, Inc., hereafter referred to as the applicant, is seeking conditional
use approval under Section 14.10, Conditional Use Review, of the South Burlington Land
Development Regulations. The request is for permission to allow a 12' x 14' addition to a single
family dwelling to encroach five (5) feet into the required front yard setback, 63 Meadow Road.
CONDITIONAL USE CRITERIA
Section 14.10(E) of the South Burlington Land Development Regulations establishes the following
review standards for all conditional use applications:
The proposed use, in its location and operation, shall be consistent with the planned
character of the area as defined by the City of South Burlington Comprehensive Plan.
Staff feels the proposed addition is in -line with the planned character of the area.
The proposed use shall conform to the stated purpose of the district in which the
proposed use is to be located.
Staff does not feel the proposed addition conflicts with the stated purpose of the R4 Zoning
District.
The DRB must find that the proposed uses will not adversely affect the following:
(a) The capacity of existing or planned municipal or educational facilities.
Educational facilities will not be affected by the proposed addition.
(b) The essential character of the neighborhood or district in which the property is
located, nor ability to develop adjacent property for appropriate uses.
The proposed additional will not adversely affect the character of the neighborhood or the ability
to develop adjacent properties.
(c) Traffic on roads and highways in the vicinity.
The proposed addition will not have any significant impacts on traffic in the vicinity.
(d) Bylaws in effect.
The proposed addition is in keeping with bylaws and regulations in effect.
(e) Utilization of renewable energy resources.
The proposed addition will not affect renewable energy resources.
(t) General public health and welfare.
The proposed addition will not have an adverse affect on general public health and welfare.
Section 3.06 (J) of the South Burlington Land Development Regulations establishes the following
review standards for the proposed project:
The DRB must find that the proposed encroachment will not adversely affect the
following:
(a) Views of adjoining or nearby property owners.

RECOMMENDATION

o Survey data (distance and acreage).
o Contours (existing and finished).
o Proposed landscaping schedule (number, variety, and size) as required in Section 13.06(G) of the
Land Development Regulations.
o Location of streets, abutting properties, fire hydrants, existing buildings, existing landscaping.
o Existing and proposed curb cuts, pavement, walkways.
o Zoning boundaries.
o Number and location of parking spaces (as required under Section 13.01(b) of the Land
Development Regulations).

I talked with Dick and Sharon Holcomb at 63 Meadow Rd. I have no objections to their request
for their addition. I understand that they need a waiver since the front of their house is a tad too
close to the center of the road.
