PLANNING COMMISSION .NNE 26, 1979 Mr, Ewing felt the developer had given 40' of buffer and should not be required to give more. Mr. Poger agreed, saying the Commission should not re - engineer the building. The motion failed with Messrs. Poger, Woolery and Ewing voting no and Messrs. Mona and Draper voting yes. Mr. Ewing then moved to amend stipulation #2 to read that "Building #2 shall be located at least 40' west of the property line, the way it is shown in red on the plan of record." Mr. Mona seconded the motion and it passed with Mr. Draper voting no. It should be noted that this amendment only applies to the first part of the stipulation and that the second part is left as printed above. The motion passed unanimously. Ice Cream's Mr. Richard Maher represented Friendly and said that they proposed to purchase the lot at 21 McIntosh Avenue and extend their parking lot. The lot is now zoned commercial. He .said they had talked to Mr. Bolduc, the adjoining owner, and he did not object. There will be a 15' buffer between the two properties and a 6' fence. A row of white pines will be planted and the present curb cut for the McIntosh property will be closed. Lighting will be cut-off lighting. Mr. Woolery moved that the South Burlington Planning Commission approve the site plan proposal of Friendly's Ice Cream Corporation, to expand its present parking lot as de icted on a plan entitled "Preliminary Plot Plan..." drawn by T.B.B.. dated 5 22 79, subject to the following stipulations: 1. The 2 lighting fixtures to be relocated to the east property line shall be screened so that the adjoining residential yard is not illuminated. 2. The curb cut on the LaJeunesse lot shall be closed. 3. An adequate bond shall be posted to insure the fence extension, new plantings, and closing of the curb cut shown on the plan. 4. The parking lot shall be restriped as shown on the plan. Mr. Draper seconded the motion and all were in favor. Site plan review for expansion of Reilly Tire parking lot Mr. Page said the representative had left, but he showed the Commission the plan. He said there had been a communication problem here and that the work had already been done, because Reilly Tire said they had been told to go ahead and do it. The city has no written confirmation of this, but Reilly feels they did the work in good faith. Mr. Page said that eventually the building would be extended but there are no plans for that now and it will just be used for storage of cars. Mr. Page said that one of the banks should be stabilized. Mr. Woolery moved that the South Burlington Planning Commission approve the parking lot expansion for Reilly Tire, as depicted on the of record, subject to the following stipulations: 1. Modification of the existing fill slopes and swale along the Church driveway shall be performed to the satisfaction of the City Engineer and transmitted to the Planning Commission in writing. Memorandum 6/22/79 Page 2 #4 Reilly Tire Parking Lot Expansion As you know, this is a t accompli. Although�initially inquire( about the permits necessary for expansion of its parking lot, some confusion dice nsue about the extent of the filling involved. Reilly proceeded to fill in the belief that no permits or approvals were necessary. Since we (at City Hall) have no record of having approved or denied such a request, I suggest the review focus on: 1) limits to future filling, 2) erosion control (esp. bank stabilization), and 3) storm drainage (since the enlarged parking area will eventually be paved. #5 Friendl 's Parki� Lot Expansion Friendly's plans toLcquire an adjoining house and lot to permit the expansion of its parking area. The required buffer zone, which consists of a stockade fence and white pine plantings, is being extended northward. Since two of the existing overhead liahtkoing fixtures are being moved closer to the residential district, I suggest screens be attached to prevent light from spilling over onto the adjoining residential back yard. Parking and circulation remain excellent under the revised plan. Dolduc M E M O R A N D U M To: South Burlington City Council From: Richard Ward, Zoning Administrative Officer Re: Lajeunesse, 21 McIntosh Avenue Date: May 4, 1979 Attached is a letter from Mr. Lajeunesse discribing his proposed use. Under the 1974 zoning regulations the lot in question is located within the Business Retail District, a restaurant operation is a conditional use and catering operation is a permitted use. Mr. Lajeunesse presently operates his insulation business from this location. He informs me that he has warehousing located in Burlington. BURLINGTON We, the undersigned, are opposed to the proposal by Mr. Lajeunesse to establish a mobile catering unit at 21 McIntosh Ave., ana to use the garage as a food preparation area. We are opposed to it for the following reasons: 1. It would create additional air -pollution. 2. It would Present an additional fire hazard to neighboring properties. 3. Disposal of food refuse would present sanitation and health problems, and perhaps attract vermin. 4. aegardless of how slight, there would be an increase of traffic flow, including delivery trucks, in this perpetual bottle -neck into the neighborhood. 5. Since 21 HICIntosh is the first --and most visible --home to visitors as they enter the "Orchards", it plays an especially important symbolic role in defining the quality of the neighborhood. Compared to the attractiveness of the adjacent prope.^ties of 23 McIntosh and Friendly Ice Cream, 21 McIntosh would require substantial re -landscaping if it were to meet these aesthetic standards..Three trucks, a bus, several cars, and more blacktop would have the opposite effect. Nor would this be compatible with residential use. 6. Allowing this continuing deterioration :from a home with residential character to a fast-food business would have a negative impact upon the re -sale values of all our homes. 7. Finally, we join the ranks of those thoughtful citizens who are deeply concerned with the continuing loss of attractive South Burlington property to strip development and fast-food chains. We have been severely criticized for this by citizens of our neighboring towns, officials of State government, and visitors to our Vermont countryside. This noble unit will serve principly baked chicken, but also will serve hamburgs, hotdons, 7rinders f.f. soda etc. everything will be put together in the bus except the baked chicken which I plan to bake in my garage and transfer to the bus. I elan to pipe my exhaust fan into the attic of ny house to muffle the noise, as it is very close to residential property. I also plan on not having raw produce delivered to this address, but intend to pick it up myself, again to cut down on large truck noise, and congestion of traffic to Fhe area. Ward and Members of the City Council: Thank you for notifying me of the proposed changes of the LaJeunesse property. Due to a prior commitment, I cannot attend the zoning meeting on the 16th, and wish to have the following read (or distributed) to all present members of the Council. Mr. LaJeunesse has been a good neighbor over the past two years, and I hope that this publicly stated opinion will not jeopardize our good relationship. I have only a few concerns regarding the proposed business changes, the first of which is parking space for his service vehicles and/or employee vehicles. Recalling that the existing house lot is not quite 100, by 1001, and that there is only a one car driveway, how many trucks c2n be parked reasonably on the lawn of this small ranch house without altering the present residential quality? I believe that setting limits on such vehicles would be well-advised. Over the past several months, Mr. LaJeunesse has had one car, three trucks and a bus parked on his front and back lawns. If the proposed change entails commercial cooking on the premises, I have two additional concerns. One is the increased fire hazard, and the other is the unavoidable air -pollution caused from the commercial preparation of foods. I thank you in advance for considering my concerns.
