DESCRIPTION: This is a draft discharge permit proposed for issuance to the City of South Burlington for
the discharge of stormwater runoff from a a stormwater offset project, the so-called
"Mayfair Park Stormwater Collection System" located on Mayfair Street in South
Burlington, Vermont to the Potash Brook watershed. The means of storm water offset
includes new perforated pipe, catch basins, and installation of Contech® Engineered
Solutions swirl concentrator or equal system as approved by the Secretary.
TENTATIVE DETERMINATIONS
Tentative determinations regarding effluent limitations and other conditions to be imposed on the pending
Vermont permit have been made by the State of Vermont Agency of Natural Resources (VANR). The
limitations imposed will assure that the Vermont Water Quality Standards and applicable provisions of the
Federal Clean Water Act, PL 92-500, as amended, will be met.

FURTHER INFORMATION
The complete application, proposed permit, and other information are on file and may be
inspected at the VANR, Montpelier office. Copies, obtained by calling (802) 828-1535, will be
made at a cost based upon the current Secretary of State Official Fee Schedule for Copying
Public Records from 8:00 a.m. to 4:00 p.m., Monday through Friday.
PUBLIC COMMENTS/PUBLIC INFORMATIONAL MEETINGS
Written public comments on the proposed permit are invited and must be received on or before
the close of business day (7:45 am - 4:30 pm) August 26, 2014, by the Agency of Natural
Resources, Department of Environmental Conservation, Watershed Management Division,
Stormwater Management Program, Main Building, Second Floor, One National Life Drive,
Montpelier, Vermont 05620-3522 or send via email to
anr.wsmdstormwatercommentskstate.vt.us. If sending by mail, the permit number should
appear next to the VANR address on the envelope and on the first page of any submitted
comments. If sending by e-mail, the permit number should appear on the subject line. All
comments received by the above date will be considered in formulation of the final
determinations.
During the notice period, any person may submit a written request to this office for a public
hearing to consider the proposed permit. The request must state the interest of the party filing
such request and the reasons why a hearing is warranted. A hearing will be held if there is a
significant public interest (including the filing of requests or petitions for such hearing) in
holding such a hearing.
RIGHTS TO APPEAL TO ENVIRONMENTAL COURT
At the conclusion of the public notice period and after consideration of additional information
received during the public notice period, the VANR will make a final determination to issue or to
deny the permit. Pursuant to 10 V.S.A. Chapter 220, any appeal of this decision must be filed
with the clerk of the Environmental Court within 30 days of the date of the decision. The
appellant must attach to the Notice of Appeal the entry fee of $250.00, payable to the state of
Vermont. The Notice of Appeal must specify the parties taking the appeal and the statutory
provision under which each party claims party status; must designate the act or decision appealed
from; must name the Environmental Court; and must be signed by the appellant or their attorney.
In addition, the appeal must give the address or location and description of the property, project
or facility with which the appeal is concerned and the name of the applicant or any permit
involved in the appeal. The appellant must also serve a copy of the Notice of Appeal in
accordance with Rule 5(b)(4)(B) of the Vermont Rules for Environmental Court Proceedings.

GENERAL NOTES:
1. THESE GENERAL NOTES SHALL APPLY TO ALL DRAWINGS IN THIS CONTRACT AND TO THE
WORK THEY CONVEY.
2. LOCATION OF EXISTING STRUCTURES, PIPING AND OTHER ITEMS AS SHOWN ON THESE
DRAWINGS HAVE BEEN TAKEN FROM AS -BUILT RECORD DRAWINGS OBTAINED FROM THE
CITY OF SOUTH BURLINGTON. LOCATION OF THESE ITEMS SHALL BE CONSIDERED
APPROXIMATE AND THE CONTRACTOR SHALL DIG TEST PITS AS REWIRED TO VERIFY
LOCATIONS. THERE MAY BE OTHER BELOW GRADE STRUCTURES NOT SHOWN WHICH WALL
REWIRE DEMOLITION AND/OR RELOCATING IN ORDER TO COMPLETE THE WORK OF THIS
CONTRACT. THEREFORE. THE CONTRACTOR SHALL VERIFY THE LOCATIONS, ELEVATIONS,
AND DIMENSIONS OF ALL EXISTING UTILITIES. STRUCTURES. AND OTHER FEATURES
AFFECTING THE WORK PRIOR TO CONSTRUCTION. THIS SHALL BE DONE AT NO
ADDITIONAL COST TO THE CONTRACT.
3. ANY DISCREPANCIES BETWEEN THESE DRAWINGS AND EXISTING CONDITIONS SHALL BE
BROUGHT TO THE ATTENTION OF THE ENGINEER BEFORE PROCEEDING WITH THE WORK.
4. ALL PIPE LENGTHS SHOWN ON THE DRAWINGS ARE MEASURED FROM MANHOLE
CENTERLINE TO MANHOLE CENTERLINE. INVERTS ON DRAWINGS WILL GOVERN.
5. PROPERTY LINE INFORMATION WAS TAKEN FROM THE CITY OF SOUTH BURUNGTON
ASSESSOR'S MAPS AND IS APPROXIMATE ONLY.
6. CONTRACTOR SHALL RELOCATE ALL EXISTING STRUCTURES PIPING, AND OTHER ITEMS
NECESSARY FOR THE CONSTRUCTION OF THE PROJECT AS SHOWN ON THE CONTRACT
DRAWINGS.
7. THE CONTRACTOR SHALL BE RESPONSIBLE FOR MAKING ALL ARRANGEMENTS FOR
ANCHORING SUPPORTING AND/CR RELOCATING AND PROTECTING ALL UTILITIES DURING
CONSTRUCTION. ALL COSTS SHALL BE INCLUDED IN THE UNIT PRICES BID. IN THE CASE
OF DAMAGE, THE CONTRACTOR SHALL BE RESPONSIBLE FOR THE COST OF ALL REPAIRS.
B. THE CONTRACTOR IS RESPONSIBLE FOR MAINTAINING PROPER AND ADEQUATE TRENCH
SHORING AND BRACING AT ALL TIMES IN ACCORDANCE 'NTH RECOMMENDED/REWIRED
SAFETY STANDARDS AND REGULATIONS.
9. ALL EXCAVATIONS SHALL BE SECURED TO PROTECT THE GENERAL PUBLIC BY THE
CONTRACTOR DAILY.
10. THE CONTRACTOR SHALL FURNISH ALL PROTECTIVE AND/CR WARNING DEVICES AS
REWIRED TO CONTROL AND PROTECT THE PUBLIC IN ALL WORK AREAS. THE
CONTRACTOR SHALL MAINTAIN EMERGENCY ACCESS TO ALL AREAS AFFECTED BY HIS
WORK AT ALL TIMES. THE CONTRACTOR IS RESPONSIBLE FOR NOTIFYING FIRE AND
POLICE DISPATCHERS DAILY WHEN STREET ACCESS IS RESTRICTED OR TRAFFIC IS BEING
DETOURED. DETOURS REQUIRE APPROVAL BY THE ENGINEER AND OWNER.
11. THE CONTRACTOR SHALL REMOVE AND DISPOSE OF ALL DEMOLISHED AND WASTE
BUILDING MATERIAL. CONCRETE, MASONRY, TREES, SHRUBS, DEBRIS AND OTHER
MATERIALS NECESSARY FOR THE SATISFACTORY COMPLETION OF THE CONTRACT WORK
AND AS REWIRED BY THE OWNER. CONSTRUCTION DEBRIS SHALL BE DISPOSED OF N
STRICT ACCORDANCE WITH ALL LOCAL, STATE, AND FEDERAL LAWS.
12. ALL FENCES, RETAINING WALLS, BUSHES SHRUBS, ETC. THAT ARE DAMAGED OR CANNOT
BE SALVAGED FOR REUSE SHALL BE REPLACED BY THE CONTRACTOR AT NO ADDITIONAL
COST TO THE OWNER.
13. ALL DRAINAGE OUTLETS FROM THE CONSTRUCTION SITE AND ACTIVITIES, INCLUDING
STORM DRAINS, CATCH BASINS, RUNOFF ETC.. SHALL HAVE SILT BAGS, SET FENCE, HAY
BALES, AND OTHER EROSION CONTROL DEVICES INSTALLED AS REWIRED PRIOR TO
CONSTRUCTION.
14. THE CONTRACTOR SHALL BE RESPONSIBLE FOR OBTAINING ALL NECESSARY PERMITS AND
COORDINATING INSPECTIONS AS REQUIRED.
15. ALL WORK SHALL CONFORM TO ALL FEDERAL, STATE, AND LOCAL CODES, REGULATIONS
AND STANDARDS, THE MORE STRINGENT SHALL APPLY.
16. THESE DOCUMENTS 00 NOT INCLUDE THE NECESSARY COMPONENTS FOR CONSTRUCTION
SAFETY. CARE OF ADJACENT PROPERTIES DURING CONSTRUCTION AND COMPLIANCE WITH
STATE AND FEDERAL REGULATIONS REGARDING SITE SAFETY SHALL SOLELY BE THE
CONTRACTORS RESPONSBEITY.
17. ALL AREAS DISTURBED BY THE CONTRACTOR DETERMINED NOT TO BE WITHIN THE LIMITS
OF THE PROJECT, OR DETERMINED TO BE EXCESSIVE DISTURBANCE OF THE AREA FOR
THE PROPOSED WORK SHALL BE RESTORED AT NO ADDITIONAL COST TO THE OWNER.
18. ALL DISTURBED AREAS SHALL BE RESTORED AS REWIRED BY THE ENGINEER/OWNER
AND THE VERMONT STORMWATER MANAGEMENT MANUAL, VERMONT AGENCY OF NATURAL
RESOURCES, LATEST EDITION.
19. ALL DRAINAGE OUTLETS SHALL BE LOCATED AND APPROPRIATE EROSION PREVENTION
AND SEDIMENT CONTROL MEASURES INSTALLED AS REWIRED PRIOR TO CONSTRUCTION.
ALL DEWATERING OPERATIONS SHALL CONFORM TO ALL APPROPRIATE AGENCY
REGULATIONS. CONTRACTOR SHALL BE RESPONSIBLE FOR ALL REWIRED DISCHARGE
SAMPLING AND TESTING AND SHALL BE INCIDENTAL TO THE DEWATERING OPERATIONS
20. ALL MATERIALS AND CONSTRUCTION SHALL CONFORM TO THE STATE OF VERMONT
