CITY OF SOUTH BURLINGTON
On the 27th day of October, 1997, the South Burlington Zoning Board of
Adjustment heard testimony regarding a variance application of Raymond and
June LeClair, 56 Maryland Street, this meeting was also attended by James
LeClair.
Based upon the testimony provided at the above mentioned public hearing and the
documents submitted to the Zoning Board of Adjustment which are contained
within the "document file" for this application, the Zoning Board finds,
concludes, and decides as follows:
FINDINGS OF FACT
1) The property is zoned R4 District.
2) Section 25.00 Dimensional requirements of the zoning by-laws
requires a minimum side yard of ten (10) feet.
3) The existing structure is a 26'x 46' raised ranch. The
proposed addition is 22'x 29' two story addition for a
family room in the lower level and a dining area on the main
floor level.
4) The lot is irregular with 75 feet of frontage and an average
depth of 177 feet.
5) The appellant is requesting a four (4) feet side yard
encroachment into the setback area.
Conclusion
1) The house is not square to the street. The front of the
house has a southerly side yard of fourteen feet to the
front and the back of the house has a six feet side yard.
2) An existing 14'x 15' living area and 12'x 14' deck was
removed due to damage by carpenter ants. The proposed
addition will replace the living area which was removed.
3) Existing infrastructure necessitates locating the addition
in the proposed location.
4) The proposed expansion essentially replaces that which was
existing.

5) The addition will improve the character of the neighborhood
and has the support of adjoining neighbors.
Based upon the findings and conclusion setforth above, the Zoning
Board of Adjustment hereby grants the applicant's request to
construct a 221x 29' rear add' ion to within six (6) feet of the
southerly side yard located t Mar land treet.
