DECISION AND FINDING OF FACT
On the 14th October, 1996 the South Burlington Zoning Board of Adjustment heard
testimony regarding a conditional use application of Gayl Marinello, 16 Maryland
Street.
Based upon the testimony provided at the above mentioned public hearing and the
documents submitted to the Zoning Board of Adjustment which are contained within
the "document file" for this application, the Zoning Board finds, concludes, and
decides as follows:
Findings of Fact
1) The area in question is zoned R-4 District.
2) Accessory apartment are conditional uses under Section 26.75 of the zoning
by-laws.
3) The existing dwelling is a 261x 45' raised ranch occupied by the applicant.
4) The lot contains approximately 15,000 square feet.
5) Section 26.75 requires that the occupancy of the accessory apartments be
related, handicapped or over the age of 55 years.

1) Applicant will convert lower level of ranch into accessory apartment.
2) Presently a couple units of similar design are located within the neighborhood.
3) Past 8 years property has been a rental unit with a maximum of five adults now
reduced to not more than three adults.
4) Property is now owner occupied.
5) Improvements to the property should enhance the neighborhood.
Based upon the findings aqd conclusion set -forth above, the Zoning Board of
Adjustment hereby gra s e applicants request to convert approximately 430
square feet of the low lev 1 into an accessory apartment located at 16 Maryland
Street. A
