HomeMy WebLinkAboutSP-13-30 - Decision - 0002 Baldwin Avenue#SP-13-30 CITY OF SOUTH BURLINGTON DEPARTMENT OF PLANNING AND ZONING SOUTH BURLINGTON SCHOOL DISTRICT — 2 BALDWIN AVENUE SITE PLAN APPLICATION #SP-13-30 FINDINGS OF FACT AND DECISION South Burlington School District, hereinafter referred to as the applicant, is seeking approval to amend a previously approved plan for an educational facility. The amendment consists of installing a 15'x20' concrete slab and constructing a 6' high, 4- sided enclosure with a screened gate and relocating existing trash and recycling receptacles, 2 Baldwin Avenue. Based on the plans and materials contained in the document file for this application, the Administrative Officer finds, concludes, and decides the following: FINDINGS OF FACT 1. The Applicant is seeking site plan approval to amend a previously approved plan for an elementary school. The amendment consists of installing a 15'x20' concrete slab and constructing a 6' high, 4-sided enclosure with a screened gate and relocating existing trash and recycling receptacles, 2 Baldwin Avenue. 2. The application was received on May 31, 2013. 3. The owner of record of the subject property is South Burlington School District. 4. The subject property is located in the Municipal Zoning District. 5. The plan submitted consists of one (1) page and is entitled "Orchard School Playground Improvements" prepared by Civil Engineering Associates, Inc., dated May 2011, last revised on 7/23/12. In addition to the above _general review standards, site plan applications shall meet the following specific standards set forth in Section 14.07 of the Land Development Regulations: (c) All dumpsters and other facilities to handle solid waste, including compliance with any recycling or other requirements, shall be accessible, secure, and properly screened with opaque fencing to ensure that trash and debris do not escape the enclosure(s). 6. The proposed plan relocates two existing dumpsters to a new concrete pad with the dumpsters to be enclosed by a 6 ft. high stockade fence and screen link fence gate. The criterion will be met. Pursuant to Section 13.06(B), snow storage areas must be specified and located in an area that will minimize the potential for run-off. 7. The plans depict adequate snow storage areas. DECISION Based on the above Findings of Fact, the Administrative Officer hereby approves site plan application #SP-13-30 of South Burlington School District subject to the following conditions: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. This project shall be completed as shown on the plan and shall be on file in the South Burlington Department of Planning and Zoning. 3. The applicant shall obtain a zoning permit within six (6) months pursuant to Section 17.04 of the Land Development Regulations or this approval is null and void. 4. The applicant shall obtain a Certificate of Occupancy from the Administrative Officer prior to use of the new concrete pad and enclosure. 5.
