HomeMy WebLinkAboutSP-10-87 - Decision - 0010 Market Street#SP-10-87 CITY OF SOUTH BURLINGTON DEPARTMENT OF PLANNING AND ZONING SOUTH BURLINGTON SCHOOL DISTRICT -10 MARKET STREET SITE PLAN APPLICATION #SP-10-87 FINDINGS OF FACT AND DECISION South Burlington School District, hereinafter referred to as the applicant is seeking approval to amend a previously approved site plan for an educational facility, 10 Market Street. Based on the plans and materials contained in the document file for this application, the Administrative Officer finds, concludes, and decides the following: FINDINGS OF FACT 1. The applicant is seeking approval to amend a previously approved plan to erect a prefabricated gardening shed for storage, 10 Market Street. 2. The owner of record of the subject property is South Burlington School District. 3. The subject property is located in the Central District 1. 4. The application was received on November 23, 2010 5. The plan submitted is entitled, "South Burlington Central School Site Improvements 10 Market Street South Burlington, Vermont 05403," prepared by Civil Engineering Associates, Inc., dated September, 2010. Dimensional Requirements 6. According to Section 8.05 (A)(3) of the Land Development Regulations, the maximum building coverage in this district is 40%. Building coverage will essentially remain unchanged due to the small structure (7x7) on this large parcel and is below the maximum allowable. 7. According to Section 8.04(B) buildings and structures are required to be located within the maximum depth of allowable building envelopes, which shall be (80) feet and, in general, shall be measured from the nearest planned public street right-of-way as shown on the South Burlington official map. The proposed structure is located within this building envelope. Landscaping 8. Pursuant to Section 13.06(B)(7) of the Land Development Regulations, snow storage areas must be shown on the plan. The plan not does indicate the snow storage area. - 1 - #SP-10-87 Accessory Structures Pursuant to Section 3.10 of the Land Development Regulations, the following standards for accessory structures shall be met: 9. Accessory structures, if detached from a principal structure, shall not be placed in the front yard, and they shall not, if placed in the side yard, be located closer to the street than the required front setback of the principal structure. The proposed structure meets this requirement. 10. Accessory structures shall not be located a minimum of five (5) feet from all side and rear lot lines. The proposed structure meets this requirement. 11. The total square footage of all accessory structures shall not exceed fifty percent (50%) of the first or ground floor of the principal structures, with the exception of in -ground pools, tennis courts, and other similar structures at grade level, which shall not be counted towards the maximum square footage of accessory structures. 12. Accessory structures shall not exceed fifteen (15) feet in height. The proposed structure meets this requirement. DECISION Based on the above Findings of Fact, the Administrative Officer herby approves Site Plan Application #SP-10-87 of South Burlington School District, to amend a previously approved plan for an accessory structure, 10 Market Street. 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. This project shall be completed as shown on the plan and shall be on file in the South Burlington Department of Planning and Zoning. 3. The plan shall be revised to show the changes below and shall require approval of the Administrative Officer. Three (3) copies of the approved revised plan shall be submitted to the Administrative Officer prior to permit issuance. a. The site plan shall be revised to label the bike rack and show the snow storage area(s). 4. The applicant shall obtain a zoning permit within six (6) months pursuant to Section 17.04 of the Land Development Regulations or this approval is null and void. 5. The applicant shall obtain a Certificate of Occupancy/Compliance from the Administrative Officer prior to the use of the storage shed. 6. Any change to the site plan shall require approval by the South Burlington Development Review Board or the Administrative Officer.
