DECISION AND FINDING OF FACT
On the 25th day of July, 1994, the South Burlington Zoning
Board of Adjustment heard evidence regarding the appeal of
Judge Development Corporation, 2 Corporate Way, based on the
following facts and findings:
1) The unique physical circumstances of the lot are that it
is a transitional lot with the front side on City Center
and the back side not, and that the lot is narrow and
shallow on the easterly side because of the pedestrian
right-of-way.
2) The Central Business District parking requirements and
the size of the lot limit what is a permitted and
reasonable use of the property.
3) The hardship is the 80-foot building envelope and the
possibility of a pedestrian walkway, not created by the
appellant.
4) The building is in keeping with the character of the
neighborhood and will match the City Center side.
5) The variance is minimal; appellant is doing 98% of what
is asked regarding zero setback, use, parking, design,
etc.
Based upon the above facts and findings the appellant's
request for a variance is hereby granted.
