HomeMy WebLinkAboutSD-98-0000 - Decision - 0002 0004 Market StreetFINDINGS OF FACT & DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact, application of Century Partners, L.P. to amend an approved planned unit development consisting of 96,800 square feet of general office and shopping center use in four (4) buildings, 100 Dorset Street and 2 Market Street. The amendment consists of minor modifications to the footprint of Building B, lot coverage and landscaping, and the placement of an electrical transformer along the east property line. On the 12`h day of May, 1998, the South Burlington Planning Commission approved the request of Century Partners, L.P. for revised final plat approval under Section 204 of the of the South Burlington Subdivision Regulations based on the following findings: 1. This project consists of amending an approved planned unit development consisting of 96,800 square feet of general office and shopping center use in four (4) buildings. The amendment consists of minor modifications to the footprint of building "B", lot coverage, parking and landscaping. The requested modifications have already been made. This property was last revised on 7/8/97 . 2. This property located at 100 Dorset Street and 2 & 4 Corporate Way (now Market Street) lies within the C1 and CD Districts. It is bounded on the north by a commercial building used for personal service and retail, on the east by the Ramada Inn and undeveloped property, on the south by the Anchorage Motor Inn and Market Street, and on the west by Dorset Street. 3. Transformer: The applicant has placed an electrical transformer within the proposed Mary Street Extension r.o.w. 4. Coverage: CD District: Building coverage is 48.7% (maximum allowed is 90%). Overall coverage is 83.0% (maximum allowed is 90%). 5. Landscaping: The landscaped area along the westerly side of building "B" has been eliminated and replaced with sidewalk. The amount of landscaping installed was reduced from the last approved plan by $3851. The entire redevelopment of this property has a minimum landscaping requirement of $38,980. The approved landscaping had a value of $45,435. The reduction in landscaping by $3851 still provides more than required. 6. Other: The site plan should be revised to depict "as -built" conditions for the area in the vicinity of the new transformer. DECISION & CONDITIONS Based on the above Findings of Fact, the South Burlington Planning Commission approves the final plat application of Century Partners, LP to amend an approved planned unit development consisting of 96,800 square feet of general office and shopping center use in four (4) buildings, 100 Dorset Street and 2 Corporate Way. The amendment consists of minor modifications to the footprint of Building B, lot coverage and landscaping, and the placement of an electrical box along the east property line, as depicted on a two (2) page set of plans , page one (1) entitled, "100 Dorset Street Complex 100 Dorset Street South Burlington ,VT," prepared by Judge Development Corporation, dated 12/8/97, with the following stipulations: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. The plat plan shall be revised to show the changes listed below and shall require approval of the City Planner. Three (3) copies of the approved revised plat plan shall be submitted to the City Planner prior to recording. a) The plat plan be revised to accurately reflect as -built conditions relating to the paved drive located to the east of Building B in the proposed Mary Street Extension r.o.w. 3. The applicant shall be responsible for the cost of moving the transformer located within the proposed Mary Street Extension r.o.w. to a location outside of the proposed Mary Street Extension r.o.w. prior to the construction of this road. The revised location of the transformer shall be approved by the City Planner. 4 The final plat plan shall be recorded in the land records within 90 days or this approval is null and void. The plan shall be signed by the Planning Commission Chair or Clerk prior to recording. !!14 South Burlington Chairman or Clerk Date 2
