HomeMy WebLinkAboutSD-00-66 - Decision - 0002 0004 Market Street#SD-00-66 FINDINGS OF FACT AND DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact, final plat application #SD-00-66 of Barnes and Noble Bookstore/DWM, Inc. to amend a planned unit development consisting of 96,800 square feet of general office and shopping center use in four (4) buildings. The amendment consists of adding an enclosed dumpster storage area on the east side of the building at 102 Dorset Street. On the 2nd of January, 2001, the South Burlington Development Review Board approved the final plat application of Barnes and Noble Bookstore/DWM, Inc. under Section 204 of the South Burlington Subdivision Regulations based on the following findings: 1. This project consists of amending a planned unit development consisting of 96,800 square feet of general office and shopping center use in four (4) buildings. The amendment consists of adding an enclosed dumpster storage area on the east side of the building at 1.02 Dorset Street. 2. The owner of record is Barnes & Noble. 3. This property is located at 102 &100 Dorset Street and 2 & 4 Market Street and lies within the C1 and CD1 Districts. It is bounded on the north by a commercial building used for personal service and retail, on the east by a hotel and undeveloped property, on the south by a hotel and Market Street, and on the west by Dorset Street. 4. Access/Circulation: No changes. 5. Parking: No changes. 6. Dumpster: The applicant proposed adding a screened dumpster area adjacent to the existing dumpster area. The proposed screening will be a six (6) foot high stockade fence. DECISION AND CONDITIONS Based on the above Findings of Fact, the South Burlington Development Review Board approves final plat application #SD-00-66 of Barnes and Noble Bookstore/DWM, Inc. to amend a planned unit development consisting of 96,800 square feet of general office and shopping center use in four (4) buildings. The amendment consists of adding an enclosed dumpster storage area on the east side of the building at 102 Dorset Street, as depicted on a plan, entitled "100 Dorset Street Complex 100 Dorset Street South Burlington, VT," prepared by Dorland, dated 12/8/97, with a stamped received date of 12/07/00, with the following stipulations: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. The applicant shall obtain. a zoning permit within six (6) months pursuant to Section 27.302 of the zoning regulations or this approval is null and void. 3. The applicant shall obtain a Certificate of Occupancy/Compliance from the Administrative Officer prior to use of the enclosure. 4. The final plat plan (sheet 1) shall be recorded in the South Burlington land records within 90 days or this approval is null and void.
