DESIGN REVIEW #DR-04-03
FINDINGS OF FACT & DECISION
Judge Development Corporation, hereafter referred to as the applicant, is requesting
approval to replace an existing Master Signage Permit with a new Master Signage Permit, so
that future tenants are able to receive sign permits. Specifically, the applicant is seeking
approval for the following colors: off-white; green; blue; peach; and medium browns. The
South Burlington Design Review Committee (DRC) reviewed the proposal on January 26,
2004. The South Burlington Development Review Board (DRB) reviewed the proposal on
February 3, 2004.
Based on testimony given at the above mentioned meetings and on the plans and
supporting materials contained in the document file for this application, the Development
Review Board finds and decides as follows:
FINDINGS OF FACT
1. The applicant is requesting approval to replace an existing Master Signage Permit with a
new Master Signage Permit, so that future tenants are able to receive sign permits.
Specifically, the applicant is seeking approval for the following colors: off-white; green; blue;
peach; and medium browns.
2. Judge Development Corporation is the record owner of the property.
3. The Master Signage Permit application was reviewed under Section 6 Section 8 of the
South Burlington Sign Ordinance.
The subject property is located at 100 Dorset Street in the Dorset Street/City Center Sign
District (DS/CC Sign District). Pursuant to Section 6 of the City of South Burlington Sign
Ordinance, the erection, alteration, or relocation of any sign within this district shall require
design review by the South Burlington Design Review Committee (DRC) and Development
Review Board (DRB). Section 8 of the Sign Ordinance requires all property owners within the
DS/CC Sign District to obtain a Master Signage Permit prior to the issuance of any individual
sign permits for the subject property. Section 8(e)(1) requires that the property owner of
record be the primary permitee of a Master Signage Permit. The record owner of the property
is the Judge Development Corporation.
Pursuant to Section 8 of the Sign Ordinance, a Master Signage Permit shall establish
consistent design parameters for the property to ensure that all signage is in accordance with
goals of the DS/CC Sign District. The Master Signage Permit shall specify size ranges and
the graphic elements to be used to relate multiple signs to one another.
DESIGN REVIEW CRITERIA
In reviewing an application for signage, the DRC and DRB shall consider the following:
(a) Consistent Design
The design of a sign must be compatible and harmonious with the design of buildings on the
subject property and nearby.
The proposed master signage permit will allow for signs that are compatible with the existing
building and the surrounding buildings. They will be constructed of extruded -aluminum sign
cabinets with lexan face material decorated fronts and rears and vinyl graphics.
(b) Promotion of City Center Goals
Signs within the DS/CC Sign District should be of high aesthetic quality and pedestrian
oriented.
The proposed signage is in compliance with this requirement
(c) Color & Texture
The applicant has proposed using the following colors: off-white; green; blue; peach; and
medium browns. The proposed color scheme does not strictly comply with the standard in
Section 6(b)(3) of the Sign Ordinance that states, "The use of a maximum of three (3)
predominant colors is encouraged to provide consistent foreground, text, and background
color schemes." Therefore, peach is not approved in the subject master signage permit.
(d) Materials Used
The proposed signs will be constructed of extruded -aluminum sign cabinets with lexan face
material decorated fronts and rears and vinyl graphics. The proposed materials of the
proposed signs are of high -quality and are complimentary to the buildings.
(e) Wall Mounted Signs
Section 10 of the Sign Ordinance governs the size and location of wall -mounted signs.
Pursuant to Table 10-1 of the Sign Ordinance, a wall -mounted sign for a multi -tenant
building or a multi -building lot with a master signage permit in any district and no
freestanding or landscape sign shall not exceed 15% of the area of the facade to which
it is attached or 100 sq. ft., whichever is smaller.
Signs on this property shall not exceed 15% of the area of the faqade to which it is attached
or 100 sq. ft., whichever is smaller.
Pursuant to Table 10-1 of the Sign Ordinance, all wall -mounted signs on the subject
property shall not exceed 15% of the area of principal public facade of each building.
The total public facade of the subject building is 2,742 square feet (182.8' x 15'). Therefore
all wall -mounted sings on the subject property may have a total area of 411 square feet.

Section 10(c) states that a wall -mounted sign shall not project above the roof or
parapet of the building nor below the top of any first floor doorway unless permitted
through the design review approval process.
The proposed sign locations will not project above the roof or parapet of the subject building.
In addition, the proposed sign locations will not extend below the top of any first floor
doorways. Thus, the proposed signage is in compliance with this requirement.
Pursuant to Section 10(d), a wall -mounted sign shall not cover any opening or project
beyond the top or end of any wall to which it is attached.
The proposed signage is in compliance with this requirement
Section 10(g) stipulates that a wall -mounted sign shall not project from the wall in
excess of 9".
There is nothing included in the subject application to suggest compliance or noncompliance
with this requirement. Compliance with this requirement is a condition of approval for this
Master Signage Permit.
(0 Freestanding Signs
Section 9(h) states that free-standing signs along Dorset Street are to be located in a
sign corridor that begins adjacent to the road Right -of -Way and runs sixteen (16) feet
from the edge of the Right of Way toward the building face. In those instances where
dimensions do not provide for a two (2) foot setback from the Right -of -Way before a
sign support post can be located, it is permitted to erect a centered single pole
mounted sign of which the road side edge of the sign is directly outside the R.O.W.
line.
The subject property does not currently have a freestanding sign, and no freestanding sign
is included in this master signage permit.
Section 9(h) states that free-standing signs in the Dorset Street/City Center District
may not exceed thirty-two (32) square feet in overall dimensions and may be no
higher than twelve (12) feet, measured from the average finished grade at the base of
the sign to the highest point of any part of the sign structure.
The subject property does not currently have a freestanding sign, and no freestanding sign
is included in this master signage permit.
DECISION
Motion by Mark Boucher, seconded by Gayle Quimby, to approve design review application
#DR-04-03, conditional upon the following conditions:
1. A Master Signage Permit shall be issued to the Judge Development Corporation by the
DRB, prior to the issuance of any individual sign permit for the property.
2. Box signs shall be 3' in height and letters shall be centered in the sign boxes.
3. Box signs shall be internally illuminated and utilize an opaque background.
4. Channel lettering signs shall be internally illuminated.
5. Signs shall be centered from top to bottom in the sign band.
6. The colors of the signs under this master signage permit shall include an off-white
background with green, blue, and/or medium brown lettering.
7. All signs under this master signage permit shall be constructed of extruded -aluminum sign
cabinets with lexan face material decorated fronts and rears and vinyl graphics.
8. Pursuant to Section 20 of the Sign Ordinance, all signs shall be of substantial and sturdy
construction, kept in good repair, and painted or cleaned as necessary to maintain a clean,
safe, and orderly appearance.
9. Signs on this property shall not exceed 15% of the area of the facade to which it is
attached or 100 sq. ft., whichever is smaller.
10. All wall -mounted signs on the subject property shall not exceed 411.3 square feet in total
area.
11. Signs of the subject property shall not project from the wall in excess of 9".
12. The subject master signage permit applies only to the building on the southeasterly
portion of the property (currently known as the Healthy Living building).
