HomeMy WebLinkAboutSD-07-47 - Decision - 0002 0004 Market Street#SD-07-47 CITY OF SOUTH BURLINGTON DEPARTMENT OF PLANNING AND ZONING CENTURY PARTNERS — 4 MARKET STREET FINAL PLAT APPLICATION #SD-07-47 FINDINGS OF FACT AND DECISION Century Partners, hereafter referred to as the applicant, is seeking final plat approval to amend a previously approved planned unit development consisting of 96,197 sq. ft, of general office and shopping center use in four (4) buildings. The amendment consists of showing a 24 foot ingress and egress easement across 4 Market Street in favor of the property at 1117 Williston Road. The Development Review Board held a public hearing on Tuesday, September 4, 2007. Mark Sperry, Esq., represented the applicant. Based on testimony provided at the above mentioned public hearing and the plans and supporting materials contained in the document file for this application, the Development Review Board finds, concludes, and decides the following: FINDINGS OF FACT 1. The applicant is seeking final plat approval to amend a previously approved planned unit development consisting of 96,197 sq. ft. of general office and shopping center use in four (4) buildings. The amendment consists of showing a 24 foot ingress and egress easement across 4 Market Street in favor of the property at 1117 Williston Road. 2. The owner of record of the subject property is Century Partners. 3. The subject property is located in the Central District 1 Zoning District. 4. The plan submitted is entitled, "Shopping Center/General Office Space PUD", prepared by Donald L. Hamlin Consulting Engineers, Inc., dated 11/09/05, last revised on 6/18/07. Access Easements The application submitted by the applicant is to amend the previously approved plan to specifically show a 24 foot ingress and egress easement in favor of Lodging North, owner of the hotel located at 1117 Williston Road and adjacent to the subject lot at 4 Market Street. A plan which relocated the access drives between the properties was previously approved by the Development Review Board on August 24, 2006 and revised on December 15, 2006. However, the access easement was never adequately labeled on the plans. This application accomplishes this. All previous approvals and stipulations shall remain in full effect, except as amended herein. 2. This project shall be completed as shown on the plat submitted by the applicant and on file in the South Burlington Department of Planning and Zoning. 3. Any change to the final plat plan shall require approval of the South Burlington Development Review Board. 4. The final plat plan (sheet S-1) shall be recorded in the land records within 180 days or this approval is null and void. The plan shall be signed by the Board Chair or Clerk prior to recording.
