SITE PLAN APPLICATION #SP-16-45
FINDINGS OF FACT AND DECISION
Century Partners, LP, hereinafter referred to as "applicant", is seeking to amend a previously
approved plan for a two (2) level parking deck. The amendment consists of removing the upper
level resulting in a surface parking area, 2 Market Street.
Based on the plans and documents contained in the document file for this application, the
Administrative Officer finds, concludes, and decides the following:
FINDINGS OF FACT & CONCLUSIONS
1. The applicant is seeking to amend a previously approved plan for a two (2) level parking
deck. The amendment consists of removing the upper level resulting in a surface
parking area, 2 Market Street.
2. The owner of record is Century Partners, LP.
3. The subject property is located within the City Center Form Based Code District (FBC),
Transect 5
4. The application was received July 11, 2016.
The submitted plan consists of a seven (7) page set of plans, page two (2) is titled
"Parking Deck Removal Existing Conditions Site Plan", prepared by Donald L. Hamlin
Consulting Engineers, Inc. and dated 06/30/16.
Zoning and Dimensional Requirements
6. There are no dimensional changes as the project consists of removal of a parking deck.
Form Based Code Requirements
7. The removal of the parking deck will result in a surface parking area which does not
meet the surface parking requirements. This is a pre-existing situation which will not be
made worse with this application.
SITE PLAN REVIEW STANDARDS
Only the standards below are affected by this application. All other standards will continue to be
met.

Parking
8. The removal of the parking deck will result in the reduction of the number of parking
spaces to 323 spaces. The minimum parking requirement for the property is 194 spaces,
based on 96,700 sq. ft. of GFA at 2 spaces/1000 sq. ft., so the minimum parking
requirement will continue to be met.
Landscaping, Screening, and Open Space
9. The applicant will be adding $8,000 of new landscaping along Market Street to enhance
the appearance of the remaining surface parking. The City Arborist has commented to
staff in an email dated 7/22/16 that the applicant may want to make some changes to
species or locations of the new plantings. In an email from the applicant on 7/29/16, the
applicant indicted that they wanted to proceed with the plan as submitted without
making any changes.
10. The Administrative Officer concludes that since the City Arborist's comments were only
recommendations, that the application can be approved as submitted with the
understanding that pursuant to Section 13.06 (I) of the LDRs, "all plantings shown on
the site plan shall be maintained by the property owner in a vigorous growing
condition...".
DECISION
Based on the above Findings of Fact, the Administrative Officer hereby approves site plan
application #SP-16-45 of Century Partners, LP, subject to the following conditions:
1. All previous approvals and stipulations not superseded by this approval will remain in
effect.
2. This project must be completed as shown on the plan and on file in the South Burlington
Department of Planning and Zoning.
3. Prior to permit issuance, the applicant must post an $8000 landscaping bond. This bond
will remain in full effect for three (3) years to assure that the landscaping has taken root
and has a good chance of survival.
4. The applicant must obtain a zoning permit within six (6) months pursuant to Section
17.04 of the Land Development Regulations or this approval is null and void.
5. The applicant must obtain a Certificate of Occupancy from the Administrative Officer
upon removal of the parking deck.
6. Any change to the site plan will require approval by the South Burlington Development
Review Board or the Administrative Officer.
