Our intention is to bring the level of the ground surface in this area up to approximately the 309 foot contour line and blend it into the surrounding terrain. Once the fill is complete the area would be seeded, and mulched as necessary to prevent erosion. We estimate that it will take approximately 4,500 cubic yards of earth material to fill this area. Any material used in this area will be clean earthen materials capable of supporting the weight of future buildings. No debris or stumps will be used. The area of fill has been identified on maps as "Wetland Area B", so I feel it is important to let you know that the State of Vermont does not consider this a protected wetland, unlike the other Corporate Circle area wetlands. We will take the required measures to meet Vermont Water Quality Standards, including compliance with all conditions which were generated specifically for this fill activity by the Vermont Wetlands Office. Also, since this area is not included in any of the catagories listed at 3.101 through 3.106, Article III (Conservation and Open Space District) does not apply. I /yam 4z / I �l PLANNING COMMISSION Y-9RCH 21, 1978 The South Burlington Planning Commission held a meeting on Tuesday, march 21, 1978 at 7:30 pm in the Conference Room, City Hall, 1175 Williston Road Members Present William `vessel, Chairman; Sidney Poger, Kirk Woolery, David ?iorency, James Ewing Members Absen Ernest Levesque, George 111ona Others Presen Stephen Page, Planner; Bob Irish, Scott Tower, Xargaret and Henry Farmer, Allen D. Webster, Harvey Butterfield, Williard.Nalchajian, David Webster, Lydia Lowell, Ray and Emery Victory, Peter Trono, R.C. Roessler, R. M. Doherty, Bill Schuele Minutes of March 9 and 14, 1978 Mr. Ewing moved to approve the minutes of Yarch 9 and March 14, 1978. The motion was seconded by Mr. Poger and passed unanimously. Rezoning request for R1 to R4 for property in Bartlett's Bay, Yessrs. Roessler and Trono ?;r. Wessel explained the Commission's procedure on a zoning request. Mr. Page submitted a letter from Mr. Roessler on the subject (see attached copy). Mr. Roessler stated his reasons for requesting the zone change, which are reflected in the letter. Mr. Wessel asked what the density of zoning was along lake and Mr. Page said that he thought there were about 4 residences per acre, although he would have to double check that. Air. Butterfield said he was president of the South Burlington Lakeshore Association and he presented the Commission with a petition signed by 42 property owners requesting thatthis request be denied. The existing housing there is on parcels less than one acre of land,lf'he said, but they have been there for a long time, even before South Burlington was zoned. He felt the land was not suitable for high density development and he asked the Commission not to perpetuate mistakes of the past. He also pointed out that while Mr. Roessler said that he would put 8 dwellings on almost 5 acres of land, if the zone was changed, he would be within his rights to put up 4 dwellings per acre. He also said that he felt a zone change would alter the character of the area and contribute to traffic problecs. Mr. Webster spoke against the proposal and suggested that what was needed was a variance rather than a zone change. Mr. Henry Far,er stated that he opposed the change. The Commission was unanimously oppcsed to rezoning the area. Xr. Woolery moved that the Planning Commission deny the rezoning request for the property in Bartlett's Bay of Yessrs. Roessler and Trono for a change from PiPUD to R4. The motion was seconded by 1•'r. Morency and passed unanimously. Discussion of concept of Cfficial r.ap *'r. King was not present, so the Commission discussed this item. Nor. 0 PLANNING C014MISSION MARCH 21, 1978 Page showed the Commission what he had been doing on the map. He said the basic purpose was to assure that land was reserved for future city needs, such as parks, road widening, and easements. Some stipulations of approval are clearly good to put on an official map and others may not be made part of the map, but should be catalogued so that the city is aware of them. He said there would be a small scale map which would show location and give a brief description of what was reserved, and then there would be larger scale maps which would show all the details. If the•.city had an official map, he felt, it would make planning easier for both the city and the developer. Mr. Wessel asked how long it would take to finish the project without additional help and 14s. Page replied that this would be a good project for a student to do. The Commission discussed how to divide the project and unanimously agreed to map things the Commission had acquired as stipulations first. Mr. Woolery moved that the Planning Commission authorize Planner Ste hen Pa e to proceed with the Official South Burlington City "ap in two stapes: 1 to catalogue and draft on a ma those conditions and stipulations that have already been agreed upon and 2 to draft and put on a map projected future city services. Further that be be authorized to hire someone to assist him in this task, total cost to be decided. The motion was seconded by Mr. Ewing and passed unanimously. Mr. Ewing felt ,fir. Page should discuss the matter with the Council. Mr. Page reminded the Commission of the upcoming meeting with a traffic consultant. Discussion of development concepts for South Burlington Realty (f Ramada property. Air. Joseph King er Mr. King said this was an informal session to get things moving and he showed the Commission where the land was. Part is zoned BR and part R4 and they would like some consideration of changing the R4 to BR. The land would be developed in three phases and he said that they would like the new roads in the parcel not to be similar to Kennedy Drive. They want cars in there but not roaring through. They are thinking of some recreation (tennis courts, skating, etc.) some business shops and perhaps some residences. Messrs. Poger and Ewing said that the Williston Road Task Force report had felt this road should be similar to Kennedy Drive and should serve to get traffic off Williston Road. Mir. page was not sure this property owner could or should be required tad solve the city's problem with Williston Road. ;fir. Poger felt the Commission would need help from a traffic expert on this area. Mr. Y.ing said they had thought about putting in a rotary but Air. Poger did not like that idea. Nr. Yorency said the Commission had to be very careful about what went into the area and the planning that would have to be done. N.r. King said he expected to complete the project in 5 years or so. Mr. Wessel said they would need more traffic information and su€gested that perhaps the city and developer together might want to fund such a study. The Commission was not receptive to the idea of changing the R4 zone to BR. :fir. Ewing wondered if the city and developer might share the ccst of the road.. Mr. King said that the type of road it would be and whether the zone would be changed were critical factors. Mr. Foger warned him that the sewer problem might hold up some of his plans. Review of Regional Plan Mr. Wessel said this item should be eliminated since Mr. Page had not had time to work on it and the Commission did not have time either. The r 3. PLANNING COMMISSION LARCH 21, 1978 Regional Planning Commission had asked for a review of the Regional Plan see attached copy) and Mr. Morency did not think that they had been given enough time to review it. He suggested that the Commission talk to Hugh Yarvin, South Burlington's representative to the regional board and that they ask. -for an extension. Mir. Morency moved that the Planning Commission request that Steve Page send a letter to the Regional Planning Commission to request an extension for our comments on the Regional Plan, -YE ARE NOT THE LAST GENERATION, for a period of approximately 4 months and we further request that South Burlington's representative to the Regional Planning Commission meet in the near future with the Planning Commission to discuss the Regional Plan. The motion was seconded by Xr. Foger and passed unanimously. Discussion of workload for Planning Commission and Planner Mr. Wessel said that when the Commission asked for more help, it got more money and advice to become more efficient. 'r. Page said that he had some thoughts on the issue. One was that he has receptive to the idea of setting office hours during which he would talk to developers. He had not decided on the morning or afternoon but said he would like to ease into it. The.Commission agreed to that. He also said that the Commission did not have a consistent format for reviewing projects nor do they have consistent review of all applicable criteria. He suggested that the Commission try to adopt a standard format for conducting meetings and added that he would like to be more consistent with a criteria review. A third suggestion was that since the city was so burdened with applications, perhaps the staff should take care of the details and the Commission only deal with the important issues. '1r. Page also said that he would like to take a more agressive stance in memos and meetingx Mr. Morency felt this was a good idea and said that if Mr. Page felt a project was bad, he should say so and he would be backed up. Kr. Page also wanted to just highlight the criteria for subdivision, not burden the Commission with insignificant or conforming issues. Mr. Morency said he was not in favor of meeting twice a week to review applications. He said that if Mr. Page made sure applications were complete and the Commission streamlined its procedures and they still had a backlog of applications, they should stop reviewing when time ran out. Mfr. Woolery felt the Commission should have special meetings to discuss policy and resolve it. Mr. Morency felt hard meeting nightg had to be much more formal than they are now. Mr. Poger suggested funneling all questions through the Chairman and he said he felt it was not a good use of time to have people come in and talk for 10 minutes one week, 20 the next, etc. He felt that was inefficient and wasteful of time. Mr. Ewing suggested picking the issues that the Commission knew would take the most time and discuss' -those first. Air. Woolery said perhaps the Commission should only schedule two projects.;er night and finish those in two meetings each. Mr. Yorency agreed the Commission had to be more realistic about how much it could handle in one night. Mr. Poger said that on the issue of Mr. Page submitting an approval motion at the beginning of a hearing he felt it might mot be good since often the Commission raises issues during discussion that might not have been thought of before. On the attached map I have indicated both the areas which have received fill recently, and the total area of fill for which permission is sought. Fill area "A" has received approximately 1,600 cubic yards of fill, over an area averaging 55 feet by 130 feet at an average depth of approximately 6 feet. Permission is sought to extend the fill area, as indicated on the plan, to,a total area of approximately 25,000 square feet at an average depth of 10 feet. The total fill under this plan would be 9,300 cubic yards. We propose to use Area "A" as a temporary fill area, only as long as there is no permanent development in the immediate vicinity, for the storage of clean earth materials which are to be used for jobs in the vicinity of Corporate Circle. A review of our records shows that you have not been issued such a permit. Let me briefly explain Corps jurisdiction. A Corps of Engineers permit is required under Section 404 of the Clean Water Act (33 U.S.C. 1344) for those activities involving the discharge of dredged or fill material in all waters of the United States, including not only navigable waters of the United States, but also inland rivers, lakes, streams, and wetlands. Our jurisdiction under the Clean Water Act extends landward to the ordinary high water mark or the landward limits of any wetlands. The term "discharge" in this context may include the redepositing of wetlands soils such as occurs during mechanized landclearing activities, including grubbing, grading, and excavation. The term "wetlands", used above, is defined by Federal regulation to mean "...those areas that are inundated or saturated by surface or groundwater at a frequency and duration sufficient to support, and that under normal circumstances do support, a prevalence of vegetation typically adapted for life in saturated soil conditions..." (33 C.F.R. Part 328.3 (b), as published in the November 13, 1986 Federal Register). Wetlands generally include swamps, marshes, bogs, and similar areas. 2 The term "fill material", used above, is defined by Federal regulation to mean "...any material used for the primary purpose of replacing an aquatic area with dry land or of changing the bottom elevation of a waterbody. The term does not include any pollutant discharged into the water primarily to dispose of waste...11 (33 C.F.R. Part 323.2 (b), as published in the November 13, 1986 Federal Register). When we discover unauthorized work, we investigate the severity of the violation, whether it was intentional, and whether any immediate action is necessary to protect important resources. Based on this investigation, we decide whether to order initial corrective measures, institute legal action, or accept an after -the -fact application. In this situation we believe that initial corrective measures are appropriate in order to control erosion and to prevent further degradation of the wetlands adjacent to the channelization site. As mentioned previously, we believe that the rechannelization of the stream and placement of the excavated material will result in a change in the hydrologic regime of the adjacent wetlands. In addition, fill has also been placed in wetlands to the northeast of the channelized site which may cause sedimentation in the adjacent wetland. In view of the above and in accordance with Title 33 Code of Federal Regulations, Part 326.3(d) as published in the November 13, 1986 Federal Register, you are hereby directed to undertake the following initial corrective measures: a. In order to prevent the excavated channel from draining the surrounding wetlands, restore the excavated channel to its pre -construction condition. Prior to commencing the corrective measures, a pre -construction meeting shall be held on -site with key construction personnel and representatives of the Corps and the Vermont DEC. This work should be accomplished as soon as the area is dry enough for equipment to work, but no later than September 15, 1992. Should the area be too wet for equipment to work on bare ground, mats should be utilized to facilitate access to the area. b. In order to prevent runoff from the area to the northeast of the rechannelization from causing additional sedimentation in the emergent wetland, a row of haybales should be staked at the base of the fill slope and the slope seeded and mulched. This area should be monitored until vegetation is established. 3 Please notify Marty Abair of the Corps' Vermont Project Office before you commence work so that the required pre - construction meeting can be arranged. A Corps representative may arrange to be on -site while the work is being performed to ensure that the above conditions are met. In order to fully resolve the violation, you will have to either restore the channel and remove all fill placed within our jurisdiction, thereby restoring the wetland to pre -construction conditions, or apply for and receive after -the -fact authorization to retain the unauthorized work as well as any other proposed work. I must stress, however, that waterways and wetlands are vital areas that constitute productive and valuable public resources, the unnecessary alteration or destruction of which is to be discouraged. Therefore, Federal regulations state that filling of these resources shall not be permitted unless the applicant clearly demonstrates the following a. that the activity associated with the fill must have direct access or proximity to or be located in the water resources in order to fulfill its basic purpose, and that other site or construction alternatives are not practicable; or b. if the activity associated with the fill does not have to have direct access to the water resources, you must provide information on the need to place fill in the waterway and/or wetlands and the feasibility of alternative sites or methods to accomplish the objective of the project. In addition to a and b above, the possibilities for mitigation of any unavoidable damages to the resources must be discussed. If mitigation is possible, it should be included as part of the application (enclosed, see 40 C.F.R. Sections 230.10(a)(1), (2) and (3) of the December 24, 1980 Federal Register). You must submit information that thoroughly and clearly documents the need for the fill, alternatives, and mitigation possibilities. Without this information, we could not issue a permit to retain the unauthorized work. Additionally, a permit cannot be issued until you receive Water Quality Certification from the Vermont Department of Environmental Conservation. Failure to respond within 15 days of receipt of this letter may result in the initiation of legal action. There are compelling arguments for both the human and natural environments and in American history, when the two forces collide, it has usually been the natural environment which has suffered. We have the technology and the inclination to adequately plan our future on the scale South Burlington wants to. We view this situation as an opportunity to show -case the best parts of planning the built environment around relatively intact natural habitats. That said, it is easy to write and more difficult to accomplish something. We hope to bring a number of dissimilar - groups together to achieve a consensus for protecting the wetlands of South Burlington while building a downtown which present and future residents of the City can be proud of. Ultimately, we hope to bring both public and private interests together to jointly:propose the permitting and design of a comprehensive City Center Plan. Description of the General Vicinit The entire parcel owned by South Burlington Realty consists of about 39.5 acres located to the east of Dorset Street, west of Hinesburg Road, south;of Williston Road and north of Iby Street. (see locus map, Figure 2). The parcel has vehicular access via Corporate Way which connects Hinesburg Road and Dorset Street. There is a 65 foot Right -of -Way to Hidas Road (White Street F Ext.). Potential ROW's exist on Mary Street (50') and via Lake Buick to Dorset Street (50'). This area was farmed for decades through (approximately) the 1950's. At some point in the later portion of that time a race track was constructed on the western side of the parcel. Ecologically, the area is vegetated by small pole -sized transitional hardwoods which colonized the area after abandonment. The area receives urban runoff from various off -site residential, educational (grammar school) and commercial properties. Most or all of these impervious surfaced developments were designed/built without benefit of detention ponds. Parts of the site were wet to begin with and, of course, more water has been artificially added to the site from the lack of detention. Nonetheless, this has served to expand and in some regards enhance the wetland. The main east -west drainage was channelized at various times in its historical past. Though this served to help dry the area out for agricultural purposes, it has filled in and had become densely vegetated with alders and other shrubs/forbes. The area NATURAL RESOURCE CONSULTING SERVICES Mr. Randy Munson Page 3 J was quite flat and since the outlet across Lake Buick land was culverted, the invert could not be lowered and the area held water. Part of the property was permitted to have a dug drainage across it in a 1981 Act 250 proceeding. The permit was reauthorized periodically and the ditch was excavated variously from 1980 to 1990. The Act 250 permit required SBR to channelize an existing drainageway and move another one. Implicit in that, the ability (dated by today's standards) to fill the old drainageway. Last winter, 1992, the ditch was re -freshened and extended 400 feet beyond the authorized length of ditch. Adjacent to the SBR parcel to the south and west is a parcel Purchased -by the City of South Burlington in 1989 with Land and Water Conservation funds (USDI) for the purpose of outdoor recreation. This parcel is largely upland and is raw un- developed land at -this point. The land is vegetated by a combination of transitional and northern hardwoods, white pine and eastern hemlock. The area is fairly thick and confined by development to itsiimmediate south and west. Description of Impacted Area The wetland at "City Center" is a degraded, small wetland associated with a small perennial stream running from the junction of Routes 16 and 2 to Dorset Street. Most of the wetland vegetation can be classified as shrub -scrub, with small areas of open water and emergent vegetation. The drainage basin that generates water flow through the wetland is about 225 acres in size. This watershed is entirely urbanized and receives discharge from culverts northeast of the wetland. An office memorandum from Robert F. Shattuck, Hydraulics Engineer for the State of Vermont Agency of Transportation addresses increased rates of runoff from proposed reconstruction of Dorset Street, an area to the west of the SBR site. In effect he states that for a ten year storm event the runoff resulting after construction "... will not increase measurably." He cautioned however, that any development to the east of Dorset Street should consider detention of any storm flow until the University ?call and Dorset Street storm flows have receded. This allows the effect of any storm event to be minimized. The watershed for the SBR site is about 50 acres less than Dorset Street and has the ability to handle any increase in out flow on -site. The wetland receives much anthropogenic pollution from runoff. A road, Corporate Way, was built between 1982 and 1985, bisecting the wetland. This new construction has impacted a relatively small portion of the wetland. Additionally, the wetland and its NATURAI. RESOURCE CONSULTING SERVICES Mr. Randy Munson Page 4 surrounding upland contains much waste from squatters and others Passing through the area. As described above the impacted drainage way had been previously ditched for agricultural and race track drainage. The ; material was side cast into a scrub shrub (alder, willow, red maple) wetland and levelled during the winter. No other fill appeared to have been brought in nor did any appear to have been removed off -site. The area of unauthorized excavation/borrow placement was about 400 feet by an average of 52 feet wide (n = 9) or 0.48 acre. Some common_ plants species and their wetland status are given in Table 1. We delineated the area of impact approximately to U.S. Army Corps Of Engineers (COE) and Vermont standards as defined in the Corns of Engineers Wetlands Delineation Manual (Environmental Laboratory, 1987),and the Federal Manual for I-2 entifying and Delineating Jurisdictional Wetlands (Federal Interagency Committee for Wetland Delineation, 1989), respectively. Section 404 of the Clean Water Act defines wetlands as "Those areas that are inundated or saturated by surface or groundwater at a frequency and duration sufficient to support, and that under normal circumstances does support, a prevalence of vegetation typically adapted for life in saturated soil conditions. Three parameters are diagnostic for wetlands: the presence of hydric (wetland) soils, a preponderance of hydrophytic vegetation (plants adapted for growth in saturated conditions), and wetland hydrology. To be considered a wetland all three criteria must be met on undisturbed sites. The standard reference for determination of whether or not a plant species is a wetland species or not is: Reed, Porter B., Jr. 1988. In 1991 NRCS performed_a Functional Analysis of selected wetlands throughout Chittenden County for the Chittenden County Regional Planning Commission. .This subject wetland was included in the NATURAL RESOURCE CONSULTING SERVICES Mr. Randy Munson Page 6 qualitative study based on the New Hampshire Method (Ammann, A.P., and A. Lindley Stone, 1991. Method for the Comparative Evaluation of Nontidal Wetlands in New Hampshire. NHDES-WRD-1991- 3) and an aerial survey of the wetland. This study was commissioned independently of and over a year in advance of the present research, so these conclusions were reached independently of any knowledge of the present owner or intended activities. The following is an excerpt from our report "Wetland Survey of Essex, Hinesburg, Shelburne, South Burlington and Williston, VT". NRCS, October 1991. "The City Center wetland, because of its extremely degraded condition, scores very poorly on almost all Functional Values derived from the CCRPC study. It was found however, to have a high potential to control flood waters. The importance of this Functional Value is increased by its position in the urban watershed, with the accelerated runoff rates that accompany large areas of impermeable surfaces. Ironically, the recent construction in the area may also augment this potential. The culvert that channels the stream under the new road serves as a restrictive features, which would serve to desynchronize storm flow and subsequent flood potential." SOILS DESCRIPTION: According to the USDA Soil Conservation Service Soil Survey for Chittenden County, five soil types or associations can be found on the City Center site. The topography consists of small depressions, gentle slopes (0 to 5 percent) and level terraces. Scarboro Loan (Sd) can be found in the depressions and along the edges of drainage channels. This soil type is characterized by deep and poorly drained loam to fine sandy loam textured soil. The water table can be found at or near the surface for most of the year. This soil is very permeable and is subject to becoming droughty if over drained. The watertable can be effectively controlled as long as enough elevation change is available for Positive drainage flow from the site. The water table is the most restrictive factor for development in this soil. Au Gres (Au) fine sandy loam occupies level to gently sloping grades (0 to 5 percent). The soil consist of deep, loose, fine to gravely sand. It is somewhat poorly to poorly drained with a high seasonal water table at or near the surface during the wet season and down to a depth of 3 feet or more during the droughty Part of the year. The soil is rapidly permeable and has a low NATURAL RESOURCE CONSULTING SERVICES _0 Mr. Randy Munson Page 7 water holding capacity. With a proper drainage system installed the water table can be successfully controlled. Without a drainage system, the water table would be a limiting factor to development outside of agricultural use on this soil. Duane and,Deerfield (DdA) soils occupy irregularly shaped depressions generally just upslope of the Au Gres soil type. The soil texture is fine sandy loam to gravelly loamy sand deeper in the soil profile. Like other soils found in this area the Duane and Deerfield association is highly permeable and exhibits low water holding capacity. The water table can be found at two feet below the surfaces but fluctuates seasonally. The depth to the water table can be restrictive to development if not controlled through drainage system. Adams and VIndsor (AdA) loamy sands occupy irregularly shaped terraces. The soil is sandy to a depth of four feet and generally is underlain by stratified sand, gravel, sandy loam, till of bedrock. These soils are highly permeable and exhibit low water holding capacity and may be moderately well to excessively well drained. The suitability for development is high with little reptriction. Some of the depressi-ons may contain muck and peat (Hp). The Soil Survey map shows a very small area (200 sq. ft.) within the eastern boundary of the property. This soil type exhibits high organic content with a water table existing at or near the - surface for the entire year. Whether this soil type actually exists here within the property is questionable due to the level of accuracy of the Soil Survey maps. An on -site wetland delineation should be performed using accepted standards to determine its existence. To generalize, the soils are well suited for manipulation and respond accordingly ifcdrained or inundated. They are the best candidates for wetland mitigation and, when drained, for development. PROPOSED DEVELOPMENT/MITIGATION: The proposal will bring about four city blocks with mixed residential, commercial and municipal uses to the immediate area of the impacted wetland and possibly other noncontiguous but nearby wetlands. The city planning office through its consultant has identified this specific area (independently of,this process) as the focal point for South Burlington's "Downtown". Lacking a cohesive "Downtown" by virtue of its strip type development and tract housing, they believe the greater good is served by concentrating growth in --the existing urbanized zone. Figure 2 is NATURAL RESOURCE CONSULTING SERVICES Mr. Randy Munson Page 8 ,+ a schematic of this plan as presented by Dr. Michael Munson, Planning Consultant to South Burlington in July of 1992. Details of where all jurisdictional wetlands are on the site and the building/utility infrastructure needs to be developed. We believe there could be linkage between the adjacent city owned parcel and the SBR land to do a creative wetland mitigation solution to the entire problem. Fact: The drainage ways which would be affected were man modified for, generations. Solution: Replace the open drainage ditch onto city owned land with a varied habitat in -kind wetland approximately twice as large as the original one which (1) handles detention from this and off -site developments, (2) replaces all wetland functions of the list wetlands and (3) provides dow intensive interpretive nature trail access by the,;,wetland for educational and recreational Pursuits. Be-4ng situated so close to both the Central elementary school and the South Burlington High School. There would be.excellent opportunities to study wetlands, perhaps even to monitor the long term habitat response of this mitigation area. The possibilities are myriad. PROPOSED SCHEDULE OF EVERTS: The following is a proposed schedule of events that should occur for the orderly prosecution of the goals outlined earlier. Chronology may change somewhat without serious consequences. Critical path decision points and inflexible events are noted in the text. Task 1. Field delineate all on -site wetland including the City - owned parcel. Assume 1987 and 1989 COE manuals to yield same wetland dimensions (requires COE and State of VT concurrence). Task 2. Survey the above wetlands via rod and transit. Task 3. Investigate all affected wetland functions/values. Task 4. Prepare topographic map of entire parcel including City -owned land. Contour interval to be one foot. Task 6. Prepare detailed soils map of entire parcel including City -owned land. Task 7. Schedule and hold monthly progress meetings with COE, State of Vermont, City and Act 250 personnel. Project Coordination in general. Task 8. Seek approval of USDI Land and Water Conservation personnel,to allow for the development of wetland mitigation and recreation facilities on City land partiallyefunded by private sources. Task 9. Prepare a detailed Wetland ?litigation Plan for the entire parcel (this would include after -the -fact fill applications to both the COE (9a) and State of Vermont (9b) allo%�ing the presently effected wetland to be mitigated.,:.snd to be comprehensive for other required modifications throughout the parcel and for the mitigation -area partially on City land. Task 10. Do preliminary architectural engineering details for entire parcel. Task 11. Seek other required Local and State approvals including Act 250 Amendment, Permit, City zoning approvals, etc. Task 12. Construct Wetland Mitigation Area and associated recreational facility. Task 13. Monitor Wetland functions in concert with SBHS/UVM/MRCS on a long tekm basis. It is our assumption that Tasks 1-6 could be accomplished within a 4-6 week period. Task number 7 is ongoing and would occur at 4-6 week intervals as determined by the participants. Task number 8 is assumed to take six months (which means that on the ground mitigation work, Which is contingent upon USDI approval, must Wait until 1993). Alternatively we could backcast the original spoil back into the channel and allow it to vegetate, then re -dredge it in the future pending approval of the entire plan. Task 9 will take about one month to accomplish. Task 10 (engineering), though not our field, will probably require several months. Task,12 will require about 2-4 weeks though a re -vegetation plan may extend this (spring plantings are, in our experience, far superior to summer or fall plantings).
