HomeMy WebLinkAboutVR-94-0000 - Supplemental - 0012 Maplewood DriveAl"N f No Text October 24,1994 Request for Variance to Non -Complying Setback Regulation This appeal is being made to the South Burlington Zoning Board in an effort to get the necessary variance to make modifications to the house located at 12 Maplewood Drive, So. Burlington, VT. It is our understanding that because the house sits 40' back from the center of Maplewood Drive and the proposed cost of the modifications is more than 35% of its fair market value we must follow this process. 1. The house has a pre-existing condition whereby it sits only 40 ft from the road center of Maplewood Drive. My planned addition is to the rear portion of the house and will not negatively impact this pre-existing condition. 2. Due to the distance the house is located from the road center, It is considered a non -complying structure. Even though property is not in strict conformity with zoning regulations, it has been in reasonable use and should continue to be so. 3. House was built on this spot in about 1944. We purchased the property in 1983. The house was considered non -complying for the same reason then as it is now. 4. Property will be maintained as a single family dwelling. Addition will be to the rear portion of the building - not to extend the present width of the house. Also, we believe that the modifications proposed will result in only minimal changes to outside appearance and will not negatively impact the character of the neighborhood or adjacent properties. 5. The proposed addition will not infringe upon the current non -complying setback and therefore represents the minimum variance that affords relief with the least modification possible of the zoning regulations and of the plan.
