South Burlington, Vermont 05403 Re: Day Care Dear Mrs. LaBelle: ZONING ADMINISTRATOR 658-7958 The City Attorney is of the opinion that Section 4409 - 24 V.S.A. allows for six children on premise at any one time. Having six full time and six part time children would not qualify as a single-family residential use, and would therefore be prohibited. Your operation is classified as a conditional use which requires approval by the Zoning Board of Adjustment. Enclosed please find an application along with the review criteria for a conditional use. The Board meets on the second and fourth Mondays monthly and the application must be filed 20 days prior to a hearing date. The City requests that ,you resolve this matter as soon as possible. I believe I have a right not to be sub- jected to the type of disturbances such a venture as a daycare center would present. Furthermore, I believe that having a daycare center next to my house would decrease the value of my property should I decide to sell it. I hope that the best interests of those neighbors most likely to be effected by the LaBelle's venture will be given strong consi- deration before any grant is given to the LaBelles for creation of a Day Care Center. Because of a heavy schedule, I am writing this letter rather than appearing at the meeting. However, I do hope this letter will still be viewed as a voice in strong opposition to the LaBelle's appeal.
