HomeMy WebLinkAboutZB-96-0000 - Decision - 0007 Austin RoadSTATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON DECISION AND FINDING OF FACT On the 24th day of June, 1996 the South Burlington Zoning Board of Adjustment heard testimony regarding a variance application of Willard and Lynne Nalchajian, 7 Austin Road, this meeting was also attended by Chuck Dunham of Civil Engineering Associates. Findings of Fact Based upon the testimony provided at the above mentioned public hearing and the documents submitted to the Zoning Board of Adjustment which are contained within the "document file" for this application, the Zoning Board finds, concludes, and decides as follows: 1) The area in question is zoned R-1 District. 2) Section 25.00 Area, density and dimensional requirements requires a minimum lot of one (1) acre with 120 feet frontage. 3) Lot #5 (Webster parcel) contains .50 acre with 87 feet frontage and lot #6 (Nalchajian parcel) contains .26 acre with 75 feet frontage. 4) Both lots and the existing structures are non -conforming. Structures located within Cons ervation-Open Space District set -back requirements. 5) Applicant is proposing a property line adjustment which increases his lot size by approximately 2700 square feet. 6) No land development is under consideration at this time. Conclusion Lot 5 (Webster parcel) will be transferred from the applicants control. 2) Seawall constructed on lot #5 which protects the property and controls drainage to lot #6. 3) The boundary line adjustment as proposed is necessary to permit the owners of lot #6 to maintain and/or replace the seawall. 1 4) Lots were set-off in early 1930's as camp sites and later converted to year round dwellings. 5) The essential character of the neighborhood will not be materially changed, nor will there be any detriment to adjacent properties. 6) Adjoining property owners support this variance.
