Marcel C: Chaffee/Hayes DEVET OPMENT REVIEW BOARD 19 PA Gi 3 A resident noted that the first stretch of parking just off Arbor Rd. is always used, and she didn't see how more cars could be accommodated from the new building. There is also a cement divider in the road, so the people on the other side can't cross over. A resident said that when she bought her unit she was given a sketch that showed only one building in the center space. She now realizes that sketch was useless. She was concerned with building spacing t6'r tire coverage and noted that the buildings are not sprinklered. There is also no place to put snow, and now there will be even less. She also :toted there is no water control behind the first 2 buildings and there has been floce ing. Another resident said they had also been told that the center area would be green space. Mr. Jaeger said the spacing will be similar to the other buildings, but building # 18 will be a little closer to building #19. A resident -noted that the way buildings are angled, you are looking into someone's bedroom or bathroom. Another resident asked when the roads will be paved. He noted that you now have to go over curb -like bumps, and one resident had his car damaged and needed expensive repairs. Mr. Jaeger said Mr. Milot would know the answer to that. He said that typically developers lei a road sit for a year to set before paving. He felt that after the heavy work is done, a top course could be put on, possibly in late October. Ms. Quimby moved to approve Preliminary Plat application #SD-01-24 and Final Plat application #SD-01-25 of !, -u Burlington Realty Company subject to the stipulations in the draft motion of 19 June 2001 amended to include a stipulation for an additional 3 parking spaces to4be provided by the developer. Public Hearing: Application #CU-01-17 of Mark Chaffee and Lori Hayes seeking approval under Section 26.05, Conditional Uses, and Section 3.506 of the South Burlington Zoning Regulations. Request is for permission to relocate existing stairs to the east and replace the existing stairs with riprap, 3 Lyons Ave: Mr. Beaudin, representing the applicants, said the existing stone steps were in bad repair and the applicants had thought to replace them. They then found a problem with the riprap next dcor and realized that even if the steps were replaced in that location there would still be a problem. They decided to abandon those steps, riprap the area, and add new wooden steps in the opening where there used to be steps at one time. Mr. Desarno said if they bring in any more cars, the would be taken down in back. He added that you won't know this is a car facility from the .ont. This condition of the 1988 approval will still be applicable. No additional traffic will be produced as the applicant is proposing to reduce the number of lots. Landscaping; A landscaping schedule noting the number, variety, and size of proposed street trees should be submitted with the preliminary plat application. The preliminary plat should be stamped by a licensed surveyor and note base flood elevations. g) CHAFFEE & HAYES — HEIGHT INCREASE FOR SINGLE FAMILY HOME UNDER SECTION 3.506 - CONDITIONAL USE APPLICATION, 3 LYONS AVENUE The applicants are seeking conditional use approval from Section 26.05, Conditional Uses, and approval from Section 3.506 of the South Burlington Zoning Regulations to increase the allowable height of a single family dwelling from 25 feet to 27 feet, 3 Lyons Avenue. The Development Review Board previously approved this dwelling at the October 17, 2000 meeting (minutes enclosed). This property is located within the Conservation and Open Space District. It is bounded on the north by Red Rocks Park, on the west by Lake Champlain, on the south by a single- family residence, and on the east by a single-family residence. Criteria 3.506 (expansion or reconstruction of pre-existine structures): a) The structure to be expanded or reconstructed was in existence on April 24, 2000. b) The expanded or reconstructed structure does not extend any closer to the high water elevation than the existing structure. The proposed height increase will not affect the structure's relation to the high water mark. c) The total building footprint area of the expanded or reconstructed structure shall not be more than fifty (50) percent larger than the footprint of the structure lawfully existing on April 24, 2000. For the purposes of this regulation, reconstruction may include razing the existing structure and constructing a new structure in accordance with the provisions of this section. The approved square footage of the dwelling will not be affected by this height increase. e) Existing trees and ground cover shall be preserved, maintained, and supplemented by selective cutting, transplanting and addition of new trees, shrubs and ground cover in order to enhance the aesthetic integrity of the lake shore, provide a visual buffer from the lake and an absorption area for erosion prevention. The proposed height increase will not affect the approved landscaping. DEVELOPMENT REVIEW BOARD MEMO FERRUARY 6, 2001 MEETING Conditional Use Criteria: The proposed use complies with the stated purpose of the Conservation and Open Space District to encourage "maintain and improve the quality of natural resources". The proposed use will not adversely affect: a) the capacity of existing or planned community facilities. No affect expected. b) the character of the area affected. The proposed single-family house will be a two story, three bay, side -gabled house with roof dormers. The basement level will allow for a walkout to the lake front portion of the property. The house will utilize the shingle style. The roof and facades of the house will employ natural cedar shingles with a bare minimum of painted trim. The massing and materials proposed will blend the building with existing residences and the natural characteristics of the site. c) traffic on roads or highways in the vicinity. The proposed use is not expected to impact traffic. d) bylaws in effect. The proposal is in conformance with the zoning regulations. In addition, the proposed building is in conformance with the adjacent Queen City Park District. The proposed house will exceed the 25 foot height limit of the Queen City Park District by two feet. The applicant has submitted a report addressing the criteria of Section 11.402 of the Zoning Regulations that allow for heights of up to 35 feet in the Queen City Park District if the increase will not adversely affect views, access to sunlight, or parking (see enclosed). The applicant has also submitted letters from adjacent property owners (see enclosed). Staff has no problem with the height increase. No rooftop antennas, satellite dishes, or other rooftop devices are proposed. The proposed building meets the front and side yard setbacks of the Queen City Park District. The proposed rear yard setback of six (6) feet does not meet Queen City Park District rear yard setback of 10 feet. The proposed building will not be any closer to the rear yard property line than the existing building. e) utilization of renewable energy resources. The proposed use will not adversely affect: a) the capacity of existing or planned community facilities. No affect expected. b) the character of the area affected. The proposed single-family house will utilize the topography of the site and will sit approximately two (2) feet below the existing foundation of the existing structure. It will be a two story, three bay, side -gabled house with roof dormers. The basement level will allow for a walkout to the lake front portion of the property. The house will utilize the shingle style. The roof and facades of the house will employ natural cedar shingles with a bare minimum of painted trim. The proposed building will bear the same relationship to the high water elevation as the existing building. Lake elevation 102.00 is approximately 2 feet south of the base of the existing seawall. This seawall is constructed with native stone masonry and is in good condition and will remain. 2) The applicant should submit a landscape plan noting the landscaping to be retained and the proposed landscaping. The landscaping should provide a visual buffer from the lake and an absorption area for erosion control. The current landscaping consist of a large (12") oak tree new the westerly lot line. The balance is grass. There is little if any sign of erosion currently. We propose to retain the 12"" oak tree. We, propose to rcinove the raised flagstone patio (30.5' x 16.0', 488 sf) and replace it with a smaller on grade patio ( 12.0' radius. 226 sf). This will increase the current absorption area which is Wass. I have met with Bruce Hoar, Public Works Director today at this site to consider removal of some existing pavement and provide grass/Wound cover to further increase the absorption area. For -visual mitigation we propose a dense row of junipers now the top of the sea wall to retain a lawn area for the children. Richard Cassidy has agreed for the retnoval of deck partially on this property and provide in this area mitigating vegetation. We propose a hedge along on this property line that will not interfere with the current views of the Cassidy (east) W McCann (north) properties.
