Dear Mr. Riggs:
Please be advised that based on information available to the City, you have commenced
land development on your property at the above address without obtaining a permit from
the City as required by Section 27.10 of its Zoning Bylaws and 24 VSA 4443(a)(1).
Specifically, you have initiated the following activities on the above -described property:
Converted a vacant lot to warehousing, storage and distribution use without a zoning
permit.
You have seven (7) days from the date of this letter to discontinue this violation and take
appropriate remedial action. Specifically, you must accomplish the following:
Remove all items being stored on the property and seed all disturbed areas.
If you do not accomplish the actions directed in this letter within seven (7) days of the date
of this letter, the City may pursue this matter in court. In such court proceeding, the City
will be entitled to seek appropriate injunctive relief and fines of up to one hundred
($100.00) dollars per day for each day your violation continues beyond the seven (7) day
period provided in this letter.

If the violation described in this letter occurs again within twelve (12) months of the date
of this letter, you will not be entitled to receive a further Notice of Violation from the City
before the City pursues further enforcement proceedings.

written notice of appeal (see enclosed) and eighty five ($85) dollars within fifteen (15) days
of the date of this letter with the Clerk of the Development Review Board at the following
address: 575 Dorset Street, South Burlington, Vermont 05403.

Dear Mr. Riggs:
This letter will confirm our conversation regarding the filling
of your lot located at 18 Lime Rock Road. Section 25.117
requires that filling with earth products which exceeds twenty
(20) cubic yards shall require approval by the Zoning Board of
Adjustment after a public hearing.
It is my understanding that Alan Pidgeon d.b.a. Engineers
Construction has hauled fill in excess of five hundred (500)
cubic yards. Without permits this is a direct violation of the
South Burlington Zoning By -Laws.
Upon inspection of your property, I observed four (4) trailers
being used for storage along with outside storage of piping and
other consruction equipment. Section 26.55 requires approval by
the Zoning Board of Adjustment and approval of a revised site
plan by the Planning Commission, Without approval, this is also
considered a direct violation.
Pursuant to 24 V.S.A. Section 4444, you have seven (7) days in
which to cure these violations. In order to cure these
violations you must submit an application to the Zoning Board of
Adjustment seeking approval to fill your property. You must

remove the trailers and construction equipment or apply to the
Zoning Board of Adjustment for a conditional use permit along
with Planning Commission approval for a change to the original
site plan approval.
If you fail to secure these approvals, you will be subject to
legal action and fines of up to fifty ($50.00) dollars per day
for each day the violation continues. If you do not agree with
this Notice of Violation, you may appeal it to the Zoning Board
of Adjustment in writing within fifteen (15) days of this date.

6. Site plan application of Terry Riggs and John McKeown for
construction of a 4,000 sq. ft. addition for storage purposes
to the existing Commercial Piping Building, 18 Lime Rock Rd.
Mr. Belter stepped down as an adjacent property owner.
Mr. Riggs said the addition would be 40'x1001. They now have
a storage problem and want to get things that have been
stored outside into a covered area. The company is a mech-
anical contractor. Ms. Peacock brought up the question of
landscaping required of the previous owner that has not been
done. Mr. Riggs said he would put in landscaping and would
discuss it with the City Planner. Mr. Weith questioned some
trailers on the lot. Mr. Riggs said these are to be moved to
a job site next week.
Ms. Peacock moved the Planning Commission approve the Site
Plan application of Terry Riggs and John McKeown for con-
struction of a 4,000 sq. ft. addition for storage purpose's as
depicted on a plan entitled "J.T_ Venture._ C_P_T_ fitnrarn-

I met with Mr. Racine, the property owner to the north. He is
concerned with noise and views. He does not want a fence in-
stalled along his property line because he does not want to feel
"closed in" and lose his views of Williston Road. I suggested a
screen of pines instead, but he does not want that because of
potential loss of views of Williston Road.
He also requested that the west and north sides of the dock be
enclosed to shield the noise.
6) ADDITION. LOT 6, ETHAN ALLEN INDUSTRIAL PARK
Terry Riggs and John McKeown propose to construct a 4,000 square
foot, one-story addition to the existing Commercial Piping build-
ing, 18 Lime Rock Road. The current building is also single -
story and 4,875 square feet. The lot is 1.32 acres and is in the
Industrial Commercial zone. Initial construction on this 'site
was approved on 9/17/85.
The property is bounded on the east by a vacant industrial lot,
on the north and west by open land, and on the south by a vacant
industrial lot which is owned by the applicant.
Access & Circulation: Access will continue from the 21 foot wide
curb cut which is at the northern end of the cul de sac. Circu-
lation is limited to the eastern and northern (rear) sides of the
building. Circulation is adequate.
Setbacks: All setbacks are within guidelines.
Parking: The use requires 12 parking spaces. Fourteen parking
spaces are proposed.
Landscaping: $3,000 in new landscaping is required. No new
landscaping is proposed. The original plan showed 30 - 35 hem-
locks or cedars to be planted along the west and south property
lines to screen the building. It appears these were never plant-
ed. These should be planted along the west property line.
Coverage: Permitted overall coverage is 70% and building cover-
age, 30%. Proposed respective coverages are 26% and 1S%.
Other: A 30 foot wide gravel area should be provided along the
north side of the addition for its entire length in order to
provide adequate access for proper fire protection. This gravel
strip should remain unobstructed at all times.

There is a trailer used for storage just behind the building.
This trailer should be removed or shown on the plan. Also, there
are 2 trailers located on the western portion of the property at
the bottom of the hill. They appear to be abandoned and should
be removed.
7) GARY RIGGS, LOT 18 ETHAN ALLEN DRIVE
Gary Riggs proposes to construct an 11,250 square foot single -
story building for storage/distribution uses. Five 2,250 square
foot units are planned. The "Zoning Board approved Mr. Riggs'
request for multiple use on 7/26/89. In September of 1988, a
similar 5 unit building (built in 2 phases) for the same use was
approved for the adjacent (lot. #17).
Flo+
The lot is in the Industrial/Commercial Zone and 4__ a marrow
(120' wide) and long parcel just over the minimum lot size. The
property is bounded on the west by Mr. Riggs' storage/distribu-
tion facility, on the north by Ethan Allen Drive, and on the
east and south by Commerce Avenue.
Access: Access is shown from both Ethan Allen Drive on the north
and Commerce Avenue on the south.
Circulation: Circulation is shown along the length of the east-
ern side of the building. A 24 foot aisle width is proposed
between the parking spaces and loading zones for the building.
No circulation is available along the back of the building due to
the narrowness of the lot.
Parking: The use requires 20 parking spaces assuming 10% office
space, 3 non -office employees per unit, and 1 company vehicle per
unit. The plan shows 21 spaces.
Landscaping: The proposed building requires $6960 worth of land-
scaping. The landscaping plan shows Norway Maple, Cap Yew,
Barberry, Dwarf Juniper and nursery White Cedar, similar to that
proposed for lot #17. Planned landscaping and installatlori is
valued at. $5623. A revised landscaping plan addressing the $1337
shortfall should be submitted.
Setbacks/Coverage: All setback requirements are met. Front yard
coverage requirements are met. Building coverage is 28% (maximum
30% allowed). Total lot coverage will be provided at the meeting
(maximum permitted is 70%).

Consider site plan application of E. Ross for conversion of a

Dorset Street.
Mr. Jacob stepped down during this discussion due to a
conflict of interest.
Mrs. Lafleur explained this is an existing single family
house, 864 sq. ft. Three parking spaces would be required;
the applicant is proposing 5. Mrs. Lafleur recommended
removing the angled parking place.
Mr. Ross said he didn't want people parking in the street.
There is a garage in the rear. Members felt parking would be
better in the rear with a buffer to neighboring backyards.
Mrs. Maher suggested Mr. Ross get a professional to design
a parking plan.
Mrs. Hurd moved that the discussion be continued until the
first meeting in October. Mr. McClary seconded, and the
motion passed unanimously.
Mr. Jacob resumed his seat; however, Mr. Belter stepped down
during the following discussion due to a conflict of
interest.
Consider site plan of, Ray Cooley for construction of a,, 4875 '
sq. ft. office/warehouse on lot #6, Eithan Allen Farm Indus-
trial Park.
Mr. Kuhn advised there are 8 parking spaces to the right with
the office center to the southeast and repair facilities to
the rear. Vehicles will be parked in the rear. The office
will operate year round; the vehicle repair will be in the
winter. Most vehicles will be stored inside. There will be
4 office employees and 4 maintenance -repair people. Mr.
Dooley suggested marking the parking area in the rear.
Mr. Dooley moved that the South Burlington Planning
Commission approve the site plan application of R!�,y Cooley,
James Lamphere, agent, for the construction of a 4875 sq.

Mr. Ready noted that this property is next to the Thompsons.
He said he will remove the existing drive and put one in
directly opposite the one across the road. The building will
be fully sprinklered. There will be no parking in front.
The roadway around the building will be 18 ft. There is
sufficient parking sapce. Mrs. Lafleur noted that Mr.
Szymanski had suggested better landscaping as a buffer
between the residential use next door. Mr. Ready said he can
provide a 4 ft. buffer and still have 18 ft. for the drive.
Mr. Dooley moved that the South Burlington Planning
Commission approve the site plan application of Donald J.
Ready for Creative Design Cabinet Shop for construction of a
5720 sq. ft. building for industrial/office use at 3073
Williston Rd. as depicted on a plan entitled "Creative
Design Cabinet Shop", dated 7/30/85 with the following
stipulations:
1. A landscaping plan of $3000 is required. A $1600
landscaping bond shall be posted prior to permit and $1400 is
granted for existing landscaping.
2. A sewer allocation of 225 gpd is granted.
3. The property shall be graded to prevent draining toward
the eastern property.

Parking: 45 spaces are proposed as required.
Landscaping and Screening: The project requires $6000 in land-
scaping. The applicant proposes $3000 in new landscaping and
requests credit for $3000 of existing. The existing land-
scaping consists of yews, 3 spruce, a cedar hedge, 2 willows
and 3 pines which is sufficient. The applicant will be
placing additional landscaping to buffer the Cadey property.
5) ROSS, 329 DORSET STREET
The applicant proposes to convert a single-family dwelling to
an insurance office. This is the first application under the
new Transitional District. It was approved by the Zoning
Board of Adjustment on September 9, 1985.
Parking and Circulation: Five parking spaces are proposed,
3 are required for this 864 square foot office. The parking
is located in the front yard and along the northern end of
the building off of Brookwood. Four -spaces may be adequate
and the angled space eliminated if the applicant agrees.
This would be more aesthetically attractive.
Access: Access will be from Brookwood Drive as it is presently.
Landscaping and Screening: A large pine will be removed from
the Brookwood corner to accommodate parking. The backyard will
not be used for parking and has several large trees.
Other: The property is in Traffic Overlay Zone 5; nine trips
per peak hour are permitted. According to the ITE data, in-
surance offices with 3 employees produce 1.5 trips during the
peak hour.
6) COOLEY,,%LOT #6, ETHAN ALLEN FARM INDUSTRIAL PARK
V
The applicant proposes to construct a one-story office/warehouse
building on lot #6 of the Belter subdivision. The lot is 1.32
acres and is zoned Industrial -Commercial.
Access and Circulation: The 30 foot wide curb cut is at the
northern end of the cul de sac. Circulation is adequate.

Parking: The new building requires fourteen spaces, sixteen
are provided. The house will be served by two garage spaces.
Access and Circulation: The curb cut to the house will be closed
and the two uses will share a 36 foot wide driveway. Circulation
is provided around the building. (See Goddette's memo)
Landscaping: $3000 in landscaping is required. The plan shows
existing landscaping ($1400) and a new planting plan of flowers
and evergreens. A $1600 bond will be required for the new land-
scaping.
Other: A sewer allocation of 225 gpd will be required. The
traffic overlay zone (5) permits 40 trips per peak hour for
this lot. The applicant projects 4 cars per hour.

This project consisting of granting a 25 foot easement on Lot #5
to allow the relocation of the sewage disposal system on lot #6,
each lot now owned by Ray Cooley located off Ethan Allen Drive in
the City of South Burlington, Vermont is hereby approved under
the requirements of the regulations named above, subject to the
following conditions:
GENERAL
(1) The subdivision must be completed as shown on the plans
Project 8537-A, prepared by Dwight M. Baker, PE for Wiemann-
Lamphere, Architects and which have been stamped APPROVED by
the Division of Protection. No changes shall be made to the
approved plan without prior written approval from the Agency
of Environmental Conservation.
(2) Each prospective purchaser of any lot of the subdivision

conveyance.

WATER SUPPLY

SEWAGE DISPOSAL
(4) The installation of the sewage disposal system shall be
inspected by a professional engineer registered in the State
of Vermont who shall report in writing prior to use, that
the work has been done in accordance with the approved plans
and the permit.
(5) The sewage disposal system shall be constructed as shown
on the APPROVED plan and shall be operated at all times in a
manner that will not permit discharge of effluent onto the
surface of the ground or into the waters of the State. No
construction (buildings, roads, water lines, etc.) that
might interfere with the installation or operation of the
sewage disposal field or its replacement area is permitted.
All isolation distances as set forth in Enviromental
Protection Rules, Chapter 8, Section 8-08, and Chapter 7,
Appendix 7-D, shall be adhered to.
PLUMBING
(6) The Division of Protection is to be notified prior to the
closing or covering of any waste plumbing so that we may
inspect the workmanship.

(7) The Master Plumber responsible for the interior plumbing
shall provide the owner of the project a written certifica-
tion stating that the work has been done in accordance with
the approved plans and the Environmental Protection Rules,
Effective September 10, 1982.

workmanship must meet the standards of the Environmental
Protection Rules, Chapter 9, Plumbing; the National Plumbing
Code; and the requirements of the Vermont Fire Prevention

Dear Dick:
This letter is to clarify the amount and depth of fill on Lot 95 and Lot #6 on Lime Rock Road.
All fill material will be placed outside of the flood boundary (elevation 218). All disturbed areas
will be topsoded, seeded and mulched.
As defined on the site sketch, three areas will be filled. Area A will be defined as the area
adjacent to Lot 04, Area B will be defined as the area between Lot 45 and 6, and Area C will be
defined as the area on the northerly portion of Lot 46.
The starting elevation of all the fill areas will be at or above 218.0. The upper plateau elevation of
Lot #5 and Lot 46 is approximately 224. Therefore, the maximum depth of fill wi,11 be
approximately 6 feet.
Very rough calculations indicate the amount of fill in each area are as follows:
Area A = 150 cy
Area B = 150 cy
Area C = 100 cy

Dear Mr. Ward:
In response to your letter dated 9/10/97, we would like to address your
concerns regarding the above referenced violations:

* Enclosed please find our "Application to Board of Adjustments" to
request approval to fill more than 20 yards outside flood boundary.

* We have enclosed a "Site Plan Application" for temporary storage
of trailers as required. It should be noted that the trailers on
site are the result of our completion of several large projects.
As new work is awarded, each of these trailers will be relocated
to a c�c�i f i n-i�S�r+ c � a Al -^ ,. —,—men —s! _..ade rr• —i the
"permanent" visual effect of the stairs located in front of each
trailer. Due to the fact that access is required to each of these
trailers by CPI employees, we are required by OSHA to provide a
certain standard of stairs or we will be in violation of OSHA
safety standards. Each trailer is transferred to the job site
with a set of stairs.
* We have one trailer (brown trailer) that warehouses low usage
material. We are requested permanent storage status for this
unit.

In conclusion, it has never been our intent to knowingly violate any of
the city zoning ordinances. To show our good intent, we have also set
a deadline to clear the lot of any debris, machinery, and piping that
may be in violation. During the week of 9/22/97, we will install a
temporary silt screen on the property to conceal any offenses until
they are resolved to the city's satisfaction.
I appreciate the chance to resolve these violations before any fines
are levied. Please let me know if further documentation is required.

Dear Mr. Riggs:
This letter will confirm our conversation regarding the filling
of your lot located at 18 Lime Rock Road. Section 25.117
requires that filling with earth products which exceeds twenty
(20) cubic yards shall require approval by the Zoning Board of
Adjustment after a public hearing.
It is my understanding that Alan Pidgeon d.b.a. Engineers
Construction has hauled fill in excess of five hundred (500)
cubic yards. Without permits this is a direct violation of the
South Burlington Zoning By -Laws.
Upon inspection of your property, I observed four (4) trailers
being used for storage along with outside storage of piping and
other consruction equipment. Section 26.55 requires approval by
the Zoning Board of Adjustment and approval of a revised site
plan by the Planning Commission, Without approval, this is also
considered a direct violation.
Pursuant to 24 V.S.A. Section 4444, you have seven (7) days in
which to cure these violations. In order to cure these
violations you must submit an application to the Zoning Board of
Adjustment seeking approval to fill your property. You must

remove the trailers and construction equipment or apply to the
Zoning Board of Adjustment for a conditional use permit along
with Planning Commission approval for a change to the original
site plan approval.
If you fail to secure these approvals, you will be subject to
legal action and fines of up to fifty ($50.00) dollars per day
for each day the violation continues. If you do not agree with
this Notice of Violation, you may appeal it to the Zoning Board
of Adjustment in writing within fifteen (15) days of this date.
