Specifically, you have initiated the following activities on the above -described property: Converted a vacant lot to warehousing, storage and distribution use without a zoning permit. You have seven (7) days from the date of this letter to discontinue this violation and take appropriate remedial action. Specifically, you must accomplish the following: Remove all items being stored on the property and seed all disturbed areas. Box 9370 South Burlington, Vermont 05407-9370 Re: Notice of Violation - Section 25.117 Alteration of Existing Grade and Section 26.55 Outside Storage of the Zoning By - Laws Dear Mr. Riggs: This letter will confirm our conversation regarding the filling of your lot located at 18 Lime Rock Road. Section 25.117 requires that filling with earth products which exceeds twenty (20) cubic yards shall require approval by the Zoning Board of Adjustment after a public hearing. It is my understanding that Alan Pidgeon d.b.a. Engineers Construction has hauled fill in excess of five hundred (500) cubic yards. Without permits this is a direct violation of the South Burlington Zoning By -Laws. Upon inspection of your property, I observed four (4) trailers being used for storage along with outside storage of piping and other consruction equipment. Section 26.55 requires approval by the Zoning Board of Adjustment and approval of a revised site plan by the Planning Commission, Without approval, this is also considered a direct violation. Pursuant to 24 V.S.A. Section 4444, you have seven (7) days in which to cure these violations. In order to cure these violations you must submit an application to the Zoning Board of Adjustment seeking approval to fill your property. You must Mr. Terry Riggs Notice of Violation September 10, 1997 remove the trailers and construction equipment or apply to the Zoning Board of Adjustment for a conditional use permit along with Planning Commission approval for a change to the original site plan approval. He is concerned with noise and views. He does not want a fence in- stalled along his property line because he does not want to feel "closed in" and lose his views of Williston Road. I suggested a screen of pines instead, but he does not want that because of potential loss of views of Williston Road. He also requested that the west and north sides of the dock be enclosed to shield the noise. 6) ADDITION. LOT 6, ETHAN ALLEN INDUSTRIAL PARK Terry Riggs and John McKeown propose to construct a 4,000 square foot, one-story addition to the existing Commercial Piping build- ing, 18 Lime Rock Road. The current building is also single - story and 4,875 square feet. The lot is 1.32 acres and is in the Industrial Commercial zone. Initial construction on this 'site was approved on 9/17/85. The property is bounded on the east by a vacant industrial lot, on the north and west by open land, and on the south by a vacant industrial lot which is owned by the applicant. Access & Circulation: Access will continue from the 21 foot wide curb cut which is at the northern end of the cul de sac. Circu- lation is limited to the eastern and northern (rear) sides of the building. Circulation is adequate. Setbacks: All setbacks are within guidelines. Parking: The use requires 12 parking spaces. Fourteen parking spaces are proposed. Landscaping: $3,000 in new landscaping is required. No new landscaping is proposed. The original plan showed 30 - 35 hem- locks or cedars to be planted along the west and south property lines to screen the building. It appears these were never plant- ed. These should be planted along the west property line. Coverage: Permitted overall coverage is 70% and building cover- age, 30%. Proposed respective coverages are 26% and 1S%. Other: A 30 foot wide gravel area should be provided along the north side of the addition for its entire length in order to provide adequate access for proper fire protection. This trailer should be removed or shown on the plan. Also, there are 2 trailers located on the western portion of the property at the bottom of the hill. They appear to be abandoned and should be removed. 7) GARY RIGGS, LOT 18 ETHAN ALLEN DRIVE Gary Riggs proposes to construct an 11,250 square foot single - story building for storage/distribution uses. Five 2,250 square foot units are planned. The "Zoning Board approved Mr. Riggs' request for multiple use on 7/26/89. In September of 1988, a similar 5 unit building (built in 2 phases) for the same use was approved for the adjacent (lot. #17). Flo+ The lot is in the Industrial/Commercial Zone and 4__ a marrow (120' wide) and long parcel just over the minimum lot size. The property is bounded on the west by Mr. Riggs' storage/distribu- tion facility, on the north by Ethan Allen Drive, and on the east and south by Commerce Avenue. Access: Access is shown from both Ethan Allen Drive on the north and Commerce Avenue on the south. Circulation: Circulation is shown along the length of the east- ern side of the building. A 24 foot aisle width is proposed between the parking spaces and loading zones for the building. No circulation is available along the back of the building due to the narrowness of the lot. Parking: The use requires 20 parking spaces assuming 10% office space, 3 non -office employees per unit, and 1 company vehicle per unit. The plan shows 21 spaces. Landscaping: The proposed building requires $6960 worth of land- scaping. The landscaping plan shows Norway Maple, Cap Yew, Barberry, Dwarf Juniper and nursery White Cedar, similar to that proposed for lot #17. Planned landscaping and installatlori is valued at. $5623. It should be noted that the trailers on site are the result of our completion of several large projects. To show our good intent, we have also set a deadline to clear the lot of any debris, machinery, and piping that may be in violation. Box 9370 South Burlington, Vermont 05407-9370 Re: Notice of Violation - Section 25.117 Alteration of Existing Grade and Section 26.55 Outside Storage of the Zoning By - Laws Dear Mr. Riggs: This letter will confirm our conversation regarding the filling of your lot located at 18 Lime Rock Road. Section 25.117 requires that filling with earth products which exceeds twenty (20) cubic yards shall require approval by the Zoning Board of Adjustment after a public hearing. It is my understanding that Alan Pidgeon d.b.a. Engineers Construction has hauled fill in excess of five hundred (500) cubic yards. Without permits this is a direct violation of the South Burlington Zoning By -Laws. Upon inspection of your property, I observed four (4) trailers being used for storage along with outside storage of piping and other consruction equipment. Section 26.55 requires approval by the Zoning Board of Adjustment and approval of a revised site plan by the Planning Commission, Without approval, this is also considered a direct violation. Pursuant to 24 V.S.A. Section 4444, you have seven (7) days in which to cure these violations. In order to cure these violations you must submit an application to the Zoning Board of Adjustment seeking approval to fill your property. You must Mr. Terry Riggs Notice of Violation September 10, 1997 remove the trailers and construction equipment or apply to the Zoning Board of Adjustment for a conditional use permit along with Planning Commission approval for a change to the original site plan approval. If you fail to secure these approvals, you will be subject to legal action and fines of up to fifty ($50.00) dollars per day for each day the violation continues. If you do not agree with this Notice of Violation, you may appeal it to the Zoning Board of Adjustment in writing within fifteen (15) days of this date.
