This permit authorized the construction of a 2140 square foot house and the City Assessor estimates your house to be approximately 5676 square feet. It also appears that the garage and decks are larger than that requested on the permit. If you have constructed more building than permitted, you will have to obtain a permit for the increased size. You will recall that you wished to replace the existing failed timber and rock rip -rap walls with a new reinforced concrete wall in approximately the same location. Since all of the concrete wall will be constructed landward of ground elevation 95.5' MSL (Mean Sea Level) no permit is required from the State of Vermont. Furthermore since all of the wall will be constructed landward of elevation 98.0' MSL no U.S. Army Corps of Engineers permit is required. I understand you are in the process of applying for permits from the City of South Burlington and that questions were raised relative to these permitting requirements. Belai , ministrative Officer Re: September 21, 1999 agenda items Date: September 17, 1999 1) OTHER BUSINESS John and Marlene Stephens are requesting a six (6) month extension (see enclosed) to the variance granted them by the Zoning Board of Adjustment on 4/12/99 (effective 4/26/99). The variance granted was to demolish an existing residential dwelling and detached garage, and replace with a 35' x 48' two story dwelling unit located within nineteen (19) feet of elevation 102.5 feet of Lake Champlain and a detached 24' x 30' two story garage with guest quarters (living room, bedroom and bath) to within four (4) feet of the front yard and one (1) foot of the northerly side yard, located at 5 Austin Road (see enclosed decision). This variance was needed because the property is located within the C.O. District along the lake. 2) CONSENT AGENDA a) OVERNITE TRANSPORTATION COMPANY - FUEL TANK - SITE PLAN This project consists of the installation of a 3,000 gallon above ground diesel tank and pump on a property developed with an 8400 square foot truck terminal. This property located at 2 Holmes Road lies within the C2 District. It is bounded on the north by Holmes Road, on the east by commercial buildings, on the south by an auto dealership, and on the west by the railroad r.o.w. Access/circulation: Access is provided by a 44 foot curb cut on Holmes Road. This property also has a r.o.w. which connects the dealership property to the south with Holmes Road. No changes proposed. Circulation on the site is adequate. DEVELOPMENT REVIEW BOARD NOVEMBER 2, 1999 3. Any change to the final plat plans shall require approval of the South Burlington Development Review Board. 4. Due to the fact that the final plat plans will not change from the last set of plat plans, recording of additional plat plans is not required. Ms. Quimby seconded. Motion passed unanimously. 11. Public Hearing: Application of John & Marlene Stephens seeking approval from Section 25.117(a) of the South Burlington Zoning Regulations. The request is for permission to place fill along the lake shore to construct a seawall of approximately 80 ft. in length: Mr. Stephens said they want to extend the wall they already have. They are trying to prevent the wall from washing away. They have repaired the dock. Mr. Stephens showed pictures of the area. Mr. Belair said staff has no issues with this. Mr. O'Rourke moved the Development Review Board approve the application of John & Marlene Stephens seeking approval from Section 25.117(a) of the South Burlington Zoning Regulations. The request is for permission to place fill along the Lake shore to construct a seawall of approximately 80 feet in length, as depicted on a plan entitled "Dr. and Mrs. John Stephens Shoreline Stabilization Topography Plan South Burlington Vermont," prepared by Civil Engineering Associates, Inc, dated August 1998, with the following stipulations: 1. All previous approvals and stipulations, which are not superseded by this approval, shall remain in effect. 2. The applicant shall obtain a zoning permit within six months pursuant to Section 27.302 of the zoning regulations or this approval is null and void. 3. The applicant shall obtain a Certificate of Occupancy/Compliance from the Administrative Officer prior to use of the seawall. 4. Memorandum - Development Review Board November 2, 1999 October 29, 1999 11) JOHN & MARLENE STEPHENS - FILLING This project consists of the placement of more than 20 cubic yards of fill along the lakeshore to construct a seawall of approximately 80 feet in length. Section 25.177 of the zoning regulations allows the Board to impose any conditions it deems necessary, including but not limited to the following: (i) Duration of phasing of the permit for any length of time. (ii) Submission of an acceptable plan for the rehabilitation of the site at the conclusion of the operations, including grading, seeding and planting, fencing, drainage, and other appropriate measures. (iii) Provision of a suitable bond or other security adequate to assure compliance wit the provisions of this Section. (iv) Determination of what shall constitute preconstruction grade under Section 25.1130) above. Staff does not see a need to attach any of these conditions. 12) ALLEN & NANCY MARTIN - ADDITION TO AUTO SERVICE - SITE PLAN This project consists of amending a previously approved plan for two existing buildings consisting of: 1) a 3580 square feet building for tire sales and storage use, and 2) a 3750 square feet service building with three existing service bays. The amendment consists of a 2000 square foot. addition to the existing service building consisting of three additional service bays resulting in a 5750 square feet service building. Mr. Stephens said they have been waiting for a developer to finish some property work, and their house plans are not completely done yet so they won't be ready to build by April. Mr. O'Rourke noted it would be hard to get a variance at this time, but it has been the policy to grant a 6-month extension for an existing approval. Mr. Farley moved to grant a 6-month extension to the variance issued by the Zoning Board to John and Marlene Stephens on 12 April 1999. Ms. Quimby seconded. Motion passed unanimously. 2.
