It has been brought to my attention that the house you have under construction at 5 Austin
Drive is larger than the house you are permitted to construct under the zoning permit issued
on 2/8/00 (see enclosed). This permit authorized the construction of a 2140 square foot house
and the City Assessor estimates your house to be approximately 5676 square feet. It also
appears that the garage and decks are larger than that requested on the permit.
If you have constructed more building than permitted, you will have to obtain a permit for the
increased size. Let me remind you that the variance granted on 4/26/99 for this dwelling
limited the footprint to 35' x 48'. �(eLt'

We would like to request a six month extension to obtain a permit to build at 5 Austin
Road in South Burlington. The variance allowed us presently to obtain a building permit
by October 26t' At this time, we are currently trying to replace the old decayed wooden
seawall with rip -rap and at the same time drawing up house plans with Tom Koerner of
Shelburne We also would like to sell our house in Williston before taking on the extra
expenses of building .It would be appreciated if you would allow us to take an additional
six months to put together all the loose ends and obtain the permit in April of 2000.

Dear Dr. & Mrs. Stephens:
This letter is written at the request of your Architect, Tom Koerner, and it addresses the permitting
requirements for the shoreline stabilization plan we developed for your property on Austin Road last
year. You will recall that you wished to replace the existing failed timber and rock rip -rap walls with
a new reinforced concrete wall in approximately the same location.
Since all of the concrete wall will be constructed landward of ground elevation 95.5' MSL (Mean Sea
Level) no permit is required from the State of Vermont. Furthermore since all of the wall will be
constructed landward of elevation 98.0' MSL no U.S. Army Corps of Engineers permit is required.
I understand you are in the process of applying for permits from the City of South Burlington and that
questions were raised relative to these permitting requirements. If you should require further
information please let me know.

property from erosion .Presently, we have rip -rap that is supporting the northern 100 feet
of shoreline, but need to extend the wall to resolve the additional 100 feet left
unprotected. According to our contractor, we will need a additional 100 cu.yds or less to
properly finish the entire wall. Since all the properties to the north of us have rip -rap
walls, we feel this is in conformity with theirs and seems to be the best choice for
strength and longevity.
We would greatly appreciate your allowing the use of the additional cubic yardage above
the 20 cu. yds. permitted.

1) OTHER BUSINESS
John and Marlene Stephens are requesting a six (6) month extension (see enclosed) to the
variance granted them by the Zoning Board of Adjustment on 4/12/99 (effective 4/26/99).
The variance granted was to demolish an existing residential dwelling and detached
garage, and replace with a 35' x 48' two story dwelling unit located within nineteen (19)
feet of elevation 102.5 feet of Lake Champlain and a detached 24' x 30' two story garage
with guest quarters (living room, bedroom and bath) to within four (4) feet of the front
yard and one (1) foot of the northerly side yard, located at 5 Austin Road (see enclosed
decision).
This variance was needed because the property is located within the C.O. District along the
lake.
2) CONSENT AGENDA
a) OVERNITE TRANSPORTATION COMPANY - FUEL TANK - SITE PLAN
This project consists of the installation of a 3,000 gallon above ground diesel tank and
pump on a property developed with an 8400 square foot truck terminal.
This property located at 2 Holmes Road lies within the C2 District. It is bounded on the
north by Holmes Road, on the east by commercial buildings, on the south by an auto
dealership, and on the west by the railroad r.o.w.
Access/circulation: Access is provided by a 44 foot curb cut on Holmes Road. This property
also has a r.o.w. which connects the dealership property to the south with Holmes Road.
No changes proposed.
Circulation on the site is adequate.

3. Any change to the final plat plans shall require approval of the South
Burlington Development Review Board.
4. Due to the fact that the final plat plans will not change from the last set of
plat plans, recording of additional plat plans is not required.
Ms. Quimby seconded. Motion passed unanimously.
11. Public Hearing: Application of John & Marlene Stephens seeking approval
from Section 25.117(a) of the South Burlington Zoning Regulations. The request is
for permission to place fill along the lake shore to construct a seawall of
approximately 80 ft. in length:
Mr. Stephens said they want to extend the wall they already have. They are trying to
prevent the wall from washing away. They have repaired the dock. Mr. Stephens
showed pictures of the area.
Mr. Belair said staff has no issues with this.
Mr. O'Rourke moved the Development Review Board approve the application of
John & Marlene Stephens seeking approval from Section 25.117(a) of the South
Burlington Zoning Regulations. The request is for permission to place fill along the
Lake shore to construct a seawall of approximately 80 feet in length, as depicted on
a plan entitled "Dr. and Mrs. John Stephens Shoreline Stabilization Topography
Plan South Burlington Vermont," prepared by Civil Engineering Associates, Inc,
dated August 1998, with the following stipulations:
1. All previous approvals and stipulations, which are not superseded by this
approval, shall remain in effect.
2. The applicant shall obtain a zoning permit within six months pursuant to
Section 27.302 of the zoning regulations or this approval is null and void.
3. The applicant shall obtain a Certificate of Occupancy/Compliance from the

I move the South Burlington Development Review Board approve the application of John
& Marlene Stephens seeking approval from Section 25.117(a) of the South Burlington
Zoning Regulations. The request is for permission to place fill along the lake shore to
construct a seawall of approximately 80 feet in length, as depicted on a plan entitled, "Dr.
and Mrs. John Stephens Shoreline Stabilization Topography Plan South Burlington
Vermont" prepared by Civil Engineering Associates, Inc., dated August 1998, with the
following stipulations:

11) JOHN & MARLENE STEPHENS - FILLING
This project consists of the placement of more than 20 cubic yards of fill along the lakeshore
to construct a seawall of approximately 80 feet in length.
Section 25.177 of the zoning regulations allows the Board to impose any conditions it deems
necessary, including but not limited to the following:
(i) Duration of phasing of the permit for any length of time.
(ii) Submission of an acceptable plan for the rehabilitation of the site at the
conclusion of the operations, including grading, seeding and planting, fencing,
drainage, and other appropriate measures.
(iii) Provision of a suitable bond or other security adequate to assure compliance
wit the provisions of this Section.
(iv) Determination of what shall constitute preconstruction grade under Section
25.1130) above.
Staff does not see a need to attach any of these conditions.
12) ALLEN & NANCY MARTIN - ADDITION TO AUTO SERVICE - SITE PLAN
This project consists of amending a previously approved plan for two existing buildings
consisting of: 1) a 3580 square feet building for tire sales and storage use, and 2) a 3750
square feet service building with three existing service bays. The amendment consists of
a 2000 square foot. addition to the existing service building consisting of three additional
service bays resulting in a 5750 square feet service building. The total area of the two
buildings after the addition will be 9330 square feet.

PUBLIC HEARING
SOUTH BURLINGTON DEVELOPMENT REVIEW BOARD
The South Burlington Development Review Board will hold a public hearing at the South
Burlington City Hall, Conference Room, 575 Dorset Street, South Burlington, Vermont on
Tuesday, November 2, 1999, at 7:30 P.M. to consider the following:
1) Preliminary plat application of John Larkin to subdivide a 28.21 acre parcel into two (2)
parcels of 4.45 acres and 23.76 acres and to further develop the 23.76 acre parcel as a
planned residential development of 35 lots resulting in: 1) 32 single family lots, 2) a 12 unit
multi -family development consisting of six (6) duplexes, 3) a 2.48 acre open space lot, and
4) a 2.72 acre proposed city park, 200 Allen Road.
2) Final plat application of University Mall Realty Trust to amend an approval consisting of the
following: 1) construct a 983 space parking structure, 2) construct a 111,504 square foot GLA
addition to the main building, and 3) construct a 15,510 square foot automotive center. The
amendment consists of minor site modifications to the parking layout and green space areas,
155 Dorset Street.
3) Final plat application of Bananas University Realty Corporation to amend a planned unit
development consisting of 210 residential units, a 61 room hotel, a 20,000 square foot movie
theater (1000 seats), a 22,500 square foot restaurant/retail/indoor recreation/day care

through service. The amendment consists of converting 2594 square feet of retail space to:

The South Burlington Development Review Board held a regular meeting on Tuesday, 21
September 1999, at 7:30 p.m., in the Conference Room, City Hall, 575 Dorset Street.

1. Other Business:
Mr. Belair advised that John & Marlene Stephens are requesting a six-month extension
on a variance granted by the Zoning Board on 12 April 1999 and effective 26 April. Mr.
Stephens said they have been waiting for a developer to finish some property work, and
their house plans are not completely done yet so they won't be ready to build by April.
Mr. O'Rourke noted it would be hard to get a variance at this time, but it has been the
policy to grant a 6-month extension for an existing approval.
Mr. Farley moved to grant a 6-month extension to the variance issued by the Zoning
Board to John and Marlene Stephens on 12 April 1999. Ms. Quimby seconded.
Motion passed unanimously.
2. Consent Agenda:
a). Site plan application of Overnite Transportation Company to install a 3,000
gallon above ground diesel tank and pump on a property developed with an 8,400

b). Site plan application of Jill B. Jones to amend a previously approved plan for a
