The certification is required whether the building is owned or leased. For the purpose of this certification, the local zoning administrator or, in the absence thereof, the Town Clerk must indicate that the business is in compliance with all local zoning requirements, Inspection Station Requirement: As a reference for the zoning administrator, the following information is provided: The Official State Inspection Manual states that to become and remain a licensed inspection station, the building approved for inspection must, at a minimum, have space for the inspection and repair of the vehicle types to be inspected. The minimum floor space (all with a concrete or black -top floor surface) acceptable for garages to inspect: Pleasure Cars & Trucks = 25 feet of adequate floor space Motorcycles & Motor Driven Cycles = 12 feet of adequate floor space School Buses = 40 feet of adequate floor space In every event (except trailers) the building must be of sufficient size to allow the vehicles to be inspected inside the building. Dealer Requirement: A. Building Requirements: 1. The building shall be at least 1,200 square feet in size. Measurement of the building shall be around the exterior of the building if single level. A multi -level or multi -use building shall be measured on the inside perimeter of all space to be used by the dealership. 2. The space occupied by a dealer within a building shall be used primarily for the dealer business. 3. The building shall contain a heated dealer office area, which shall be separate from any unrelated business quarters and must contain reasonable accommodations to conduct business with the public. Dealer records must be housed and maintained in the dealer office area. The Commissioner may grant written approval for records to be housed and maintained in a building other than the dealer's office if located on the dealer's premises. The dealer license certificate must be displayed in the office area and be visible to the public. 4. If the building is multilevel or multiuse, the dealership must hayp,an entrance that.is easily recognized by the public. B. Outside Display Area Requirements The outside display area must be located in the immediate proximity of the approved building and maintained for display purposes. Dealers owning property on both sides of a public highway located opposite the approved building may use the property for display purposes. C. Signage The station shall prominently display an exterior sign with the words, Official Vermont Inspection Station" on it. The letters must be at least four inches (4") high. D. Hours of Operations Requirements Each station shall be open at least five (5) days a week for a total of at least thirty-five (35) hours per week, holiday and emergencies excepted. For the calculation of these hours, the period between 9:00 PM and 6:00 AM of any day shall not be counted. The hours of operation shall be posted in a conspicuous manner. Title 23 V.S.A. § 4 (8)(v) which is part of the definition of dealers states that the applicant shall be a person who: Owns real estate (as defined in Section 132 of Title 1) at his or her place of business or has a lease with an expiration date not earlier than the last day of the registration year for which registration is sought under the provisions of Subchapter 4 of Chapter 7 of this Title, which includes a building of at least 1,200 square feet in size used primarily for the business of the dealership. The building shall have adequate facilities for the maintenance of the records required by law to be kept including, but not limited to, those required by Section 466 of this Title and for the transfer of motor vehicles. Belair Administrative Officer THIS AGREEMENT, executed in triplicate by and between hereinafter referred to as Developer", the CITY OF SOUTH BURLINGTON, hereinafter referred to as "Municipality", and the hereinafter referred to as "Bank". WITNESSETH: WHEREAS, Developer has received site plan approval from the MUNICIPALITY'S Planning Commis on for the development of property located at as depicted on a site plan entitled dated and prepared by 1,A,_,s WHEREAS, Developer is required by said approval, at its own expense, to complete certain improvements; and WHEREAS, the parties to this Agreement wish to establish an escrow account to secure the obligations of the Developer as set forth in the City approval; and WHEREAS, the Bank executes this Agreement solely in the. capacity of escrow agent. NOW THEREFORE, the parties hereby covenant and agree as follows: 1. DEVELOPER will, at its own expense, complete the following construction as depicted and in accordance with the specifications set forth in said site plan and related documents: 2. The consent of the developer to such payment by the Bank to the Municipality shall not be required. The Bank shall incur no liability to the Developer on account of making such payment to the Municipality, nor shall the Bank be required to inquire into the propriety of any claim by the Municipality of default on the part of the Developer or into the use of such funds by the Municipality in completing such improvements. 7. The Municipality shall not file with the Bank a statement of default until thirty (30) days after notice has been sent by it to the Developer by certified mail, return receipt requested, setting forth its intention to do so. 8. All monies released by the Bank to the Municipality pursuant to paragraph five (5) shall be used by the Municipality solely for the purpose of performing obligations imposed upon the Developer by that portion of this Agreement upon which the Developer is then in default. Any work to be performed by the Municipality pursuant hereto shall be let on a contractual basis, or on a time and material basis or shall be performed by the Municipality with its own work force and equipment or shall be accomplished in such manner as in the judgement of the Municipality shall accomplish the work most expeditiously and economically. 9. If monies are released by the Bank to the Municipality pursuant to paragraph five (5) and it shall later develop that a portion of the released monies are surplus to the Municipality's needs, any such surplus shall be refunded by the Municipality to the Bank to be held and distributed by the Bank pursuant to the terms of this Agreement. 10. The Bank will not refuse or delay to make such payments to the Municipality when requested by the Municipality by the appropriate statement, and Developer will not interfere with or hinder such payments by the Bank to the Municipality. Said statement shall contain a certificate of compliance with the notice requirements of paragraph seven (7) of this Agreement. 11. This Agreement shall terminate and shall be of no force or effect upon performance of all requirements contemplated hereby, and the completion of the warranty period set forth in paragraph three (3) . 12. For the guarantee of DEVELOPER's performance of all requirements hereunder set forth, DEVELOPER has caused the BANK to issue its Irrevocable Letter of Credit in favor of the MUNICIPALITY, the original of which is attached to the MUNICIPALITY's copy of this Agreement, and a copy of which is attached to the DEVELOPER's copy of this Agreement. During the term of this Agreement, DEVELOPER shall cause the attached Letter of Credit to be renewed at least thirty (30) days before the maturity date thereof. Failure of DEVELOPER to deliver evidence of such renewal to MUNICIPALITY thirty (30) days prior to the date of expiration of said Letter of Credit shall constitute a default of the terms of this Agreement. 5. Said Irrevocable Letter of Credit provides that the drafts drawn under said credit, must be accompanied by a written statement signed by a duly authorized agent of the MUNICIPALITY, that in the judgement of the MUNICIPALITY, the DEVELOPER is in default under the terms of this Agreement, and that the funds to be drawn by the draft are in payment for, or in anticipation of payment for materials, labor and services required for completion of the improvements identified in Paragraph 1. Payment of each draft will be made at sight when presented to the BANK by the MUNICIPALIT;, the payment limited only by the aggregate amounts presented in relationship to the maximum amount of the Letter of Credit. If DEVELOPER shall be in default of the Agreement for seven (7) days because of its failure to provide evidence of renewal of the Letter of Credit, required in paragraph 4 above, the MUNICIPALITY shall notify DEVELOPER by certified mail of said default. DEVELOPER shall then within three (3) business days provide MUNICIPALITY with evidence of said renewal of Letter of Credit or MUNICIPALITY may notify BANK of such default and request payment under said Letter of Credit. 6. The DEVELOPER and MUNICIPALITY hereby agree that the sum of ($ 3,4c' - cc3L� ) shall be sufficient to secure DEVELOPER's obligations' under this Agreement but shall not relieve DEVELOPER from the obligation to pay any additional costs, if actual casts exceed the above -stated cost. 7. The MUNICIPALITY will promptly submit to the DEVELOPER a copy of any draft it submits to the BANK. The consent of the DEVELOPER to payment of said draft by BANK to the MUNICIPALITY under said Letter of Credit shall not be required. 2- S. The MUNICIPALITY shall not file with the BANK a Statement of Default until ten (10) days after notice has been sent to the DEVELOPER, by certified mail, setting forth its intention to do so. 9. All funds drawn on the BANK by the MUNICIPALITY pursuant to the Letter of Credit shall be used solely by the MUNICIPALITY for the purpose of completing construction of the improvements identified in Paragraph 1. Any work contracted for by the MUNICIPALITY pursuant hereto shall be let on a contractual basis, or on a time and material basis, or shall be performed by the MUNICIPALITY's own work force and equipment, or shall be accomplished in such other manner as in the judgement of the MUNICIPALITY shall accomplish the work more expeditiously and economically. 10. If payments are drawn on the BANK by the MUNICIPALITY pursuant to said Letter of Credit, and it shall later develop that a portion of the monies drawn are in excess of the MUNICIPALITY'S needs, any such excess amount shall be refunded by the MUNICIPALITY to the BANK, to be credited by said BANK to the DEVELOPER. 11. This Agreement and said Letter of Credit shall terminate and shall be of no force and effect upon completion of the one year warranty period as described in the above Paragraph 3. If the MUNICIPALITY has not delivered any written notice to the DEVELOPER of any defective or improper work or materials in the construction of the improvements within the twelve (12) month period, or if notice has been given and the defective work or materials have been corrected by the DEVELOPER, the MUNICIPALITY shall forthwith notify the BANK in writing that the Letter of Credit may be canceled, and shall return the original Letter of Credit to the BANK, and both the DEVELOPER and the BANK shall be released from all obligations hereunder and under said Letter of Credit. 12. The BANK may not modify the Letter of Credit without first receiving written consent of the MUNICIPALITY. 13. A 2500 square foot warehouse was approved on this lot on 12/13/94 (see enclosed) which was never built. This property located at 15 Lime Rock Road lies within the IC District. It is bounded on the north by undeveloped property (floodplain), on the west by a warehouse/office building, and on the south by an office and a mixed industrial building. Access/circulation: Access will be via a 20 foot curb cut on Lime Rock Road. Circulation on the site is adequate. Coverage/setbacks: Building coverage is 6.2 % (maximum allowed is 30%). Overall coverage is 42.5% (maximum allowed is 70%). Front yard coverage is 26.9% (maximum allowed is 30%). Setback requirements are met. Parking: A total of twenty one (2 1 ) spaces are required and twenty one (21) spaces including one (1) handicapped space are being provided. The plan should be revised to provide a bike rack as required under Section 26.253(b) of the zoning regulations. Landscaping_ The minimum landscaping requirement, based on building costs, is $3600 which is being met. Proposed landscaping includes White Pine and Crabapple. Sewer: No sewer allocation needed. On -site septic system is proposed. Traffic: ITE estimates the proposed warehouse to generate 1.85 vehicle trip ends during the P.M. peak hour. The applicant should be aware that the road impact fee is approximately $350. Dumpsters: The dumpsters used by the business will be stored inside the building. Outside storm A portion of the business involves the storage of empty dumpsters. The City Council has scheduled a public hearing for 1 /4/99 to consider the proposed amendments. a) Proposed Zone Change - 700 Airport Parkway As part of the proposed amendment to change the zoning of 700 Airport Parkway (Budget Rent -a - Car), the Council has proposed to change the zoning of five nearby residential lots from I-C District to Residential 4 District (see enclosed). Such a change would bring these single family residential homes into conformance with zoning and also create a zoning district that is consistent with the zoning directly across the street. Staff supports the change. Staff will contact the property owners prior to Tuesday's meeting. b) Design Review Ordinance - Change of Use The Council accepted the Commission's recommendation to still require applications involving a "change of use" to obtain design plan approval, however, under a more limited design review process. The Planning Commission proposed language that would allow the Commission to require design improvement to the exterior of a building, provided the cost of the improvements do "not exceed $7,000, or 25% of the improvement cost needed to accommodate the new use (e.g., interior and exterior fit -up costs), whichever is greater". The Council has proposed to revise the language slightly (see enclosed) as follows: "not exceed $7,000, or 10% of the assessed value of the building, whichever is greater". Staff supports the revised language because the result will be about the same and it is much easier to calculate and administer. Lot l.is by itself at the inter- section of Shamrock Road and Ethan Allen Drive. Additional topographic work has been done. The limits of the 100 year flood plain have been extended. The fence line has been shown. Lot 1 has been narrowed a bit to put 20 feet between the flood plain limit and the back of the lot. Mr. Spitz noted that although buildings cannot be on the flood plain, they can use the area back to the existing fence for parking, etc. Mr. Page noted that they would prefer to have access to -Lots 2 and o directly from Ethan Allen Drive. Regarding a right of way, Mr. Spitz noted that although 60 feet would be required for a public street, that is not the case here, and 40 feet would be sufficient with 20 feet in the lot and 20 feet in the flood plain. Mr. Mona expressed concern fdrz a clear designation of the right of way involved. Mr. Belter said it was his thought that if the road ever needed to be built someday there was no reason 20, 30 or 50 feet of it couldn't be out in the flood plain. Mr. Mona said they didn't want to put the road out there; rather add 10 feet either side of the already designated 20 feet. Mr. Page agreed to add a 10 foot right of way for future development on the easterly line of lot 1 to serve the rear land. Regarding entrances to the lots, Mr. Spits suggested two options. If there is concern with those entrances there would have to be a stipulation that entrances come only into the main road, in which case 2 lots would have to be dropped off. If there is not concern, no stipulation is needed. Mr. Poger said there is still concern with Ethan Allen Drive coming into the already dangerous intersection. Mr. Page said that in his last conversation with Mr. Szymanski, Mr. Szymanski indicated that the City plans to install a flashing caution signal at the intersection.. Mr. Mona asked whether anyone has estim- ated what the cost would be to improve the intersection. Mr. Spitz replied that for this scale of development, the cost would be too great. Mr. Mona then asked whether the Commission has any money to spend on its own survey of what can be done and how much it would cost. Mr. Spitz said it should be done but he is willing to let it go by on this development. Mr. Poger said it would be wise to look at the ideal layout for the property in the new budget year. Mr. Jacob suggested it could be part of the plan of the next developer. Mr. Jacob seconded the motion with unanimous approval. Several residents of Shamrock Road expressed their concern about the added traffic at an already dangerous intersection. Mrs. Bruner asked whether there would be any access to Shamrock Road and Mr. Poger said there would not.
