Re: Findings of Fact, application of Charlotte Demag for construction of a 2,500
square foot warehouse, 15 Lime Rock Road.
On the 13th of December, 1994, the South Burlington Planning Commission approved
the request of Charlotte Demag for site plan review under Section 26.10 of the South
Burlington Zoning Regulations based on the following findings:
1. This project consists of the construction of a 2,500 square foot warehouse
building on a 44,287 square foot lot.
2. This property located at 15 Lime Rock Road lies within the IC District. It is
bounded on the north by undeveloped property (floodplain) , on the west by a
warehouse/office building, and on the south by an office and a mixed industrial
building.
3. Access/circulation: Access will be via a 24 foot curb cut on Lime Rock Road.
Circulation is adequate.
4. Coverage/setbacks: Building coverage is 5.6% (maximum allowed is 30%) .
Overall coverage is 54.2 0 (maximum allowed is 70 0) . Front yard coverage is 30 0
(maximum allowed is 30 0) .
Setback requirements are met.
5. Parking: This project requires one (1) parking space and one (1) handicapped
space is being provided.
6. Lighting: Exterior lighting will consist of one (1) building mounted mini -flood
150 watt high pressure sodium lamp. This light does not meet the zoning regulations
for a downcasting shielded fixture. This light should be replaced with a
downcasting shielded fixture acceptable to the City Planner which does not cast light
beyond the property line. Also proposed are three (3) building mounted 28 watt
downcasting and shielded compact fluorescent lights.
7. Landscaping: The minimum landscaping requirement based on building costs,
is $1500 which is being met. Plantings will include White Pine and Norway Maple.
8. Sewer: The sewer allocation needed for this project is 30 gpd. The applicant will
be required to pay the per gallon fee prior to issuance of a zoning permit.
9. Flood plain: The zoning map shows this entire parcel being within the flood
plain. The subdivision plat which includes this lot indicates the field verified
location of the flood plain. This plat indicates that no portion of the lot is within the
flood plain.
DECISION & CONDITIONS
Based on the above Findings of Fact, the South Burlington Planning Commission
approves the site plan application of Charlotte Demag for construction of a 2,500
square foot warehouse, 15 Lime Rock Road as depicted on a plan entitled "Demag
Riggers" prepared by Jeff Sikora, dated October 28, 1994, and revised November
30, 1994, with the following stipulations:
1. All previous approvals and stipulations affecting this property which are not
superseded by this approval shall remain in effect.
2. The applicant shall post a $1500 landscape bond prior to issuance of a zoning
permit. The bond shall remain in effect for three (3) years to assure that the
landscaping takes root and has a good chance of surviving.
3. Any new exterior lighting shall consist of downcasting shielded fixtures so as not
to cast light beyond the property line. Any change in lighting shall be approved by
the City Planner prior to installation.
The proposed mini -flood light shall be replaced with a downcasting shielded fixture.
The details of this fixture shall be approved by the City Planner prior to permit
issuance.
4. A sewer allocation of 30 gpd is approved. The applicant shall pay the per gallon
fee prior to issuance of a zoning permit for the warehouse.
5. The applicant shall obtain a zoning permit for the warehouse within six (6)
months or this approval is null and void.
6. The applicant shall obtain a Certificate of Occupancy/Compliance from the
Administrative Officer prior to use of the warehouse.
7. Any change to the site plan shall require approval by the South Burlington
Planning Commission.
8. The plan shall be revised prior to issuance of a zoning permit to show cedars
instead of White Pine. The number and height of cedars to be planted shall be
approved by the City Planner.
