5 Austin Road
Findings of Fact, Conclusions of Law & Order
This matter came before the South Burlington Zoning Board of Adjustment on April 12, 1999 by
application of John Stephens, representing this application was Thomas Kolrner, Architect, for a
variance according to plans submitted. The Board of Adjustment finds as follows:
1) The area in question is zoned R-1 District and Conservation - Open Space. The required
setback from Lake Champlain (elevation 102.5 feet) is one hundred and fifty (150) feet
horizontal distance.
2) The setbacks within R-1 District are minimum 50 feet front yard and 25 feet side yards.
3) Civil Engineering Associates submitted evidence (letter dated March 16, 1999 on file) that no
permits from State of Vermont are required and that no permits are required from the U.S.
Army Corps of Engineers.
4) A concrete sea-wall located at ground elevation 95.5 feet is proposed and designed by Civil
Engineering Associates.
5) The existing house, garage and deck has a total lot coverage of 2773 square feet. The proposed
structure has a coverage of 2740 square feet.
6) The proposed first floor elevation of the new dwelling is 107 feet which is two feet higher than
existing camp.
7) The new dwelling location increases the setback seven (7) feet from the lake.
8) Camp constructed in 1920's predating zoning.
9) Foundation damage caused by July, 1998 flood is beyond repair.
10) New location of structure as proposed improves setbacks and removes non -complying
structure.

The variance to construct a 35' x 48' (footprint) two story residential unit at 5 Austin Road is hereby
GRANTED
