HomeMy WebLinkAboutSP-03-13 - Decision - 0015 Lime Rock Road#SP-03-13 FINDINGS OF FACT Er DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact, site plan application #SP-03-13 of Michael and Cynthia Tetrault to amend a previously approved plan for a 2756 sq. ft. warehouse building. The amendment consists of constructing a 2100 sq. ft. accessory building, 15 Lime Rock Road. On the 17t" day of June, 2003, the South Burlington Development Review Board approved the request of Michael and Cynthia Tetrault for site plan approval under Section 14.05 (F) (1) of the South Burlington Land Development Regulations based on the following findings: 1. This project consists of amending a previously approved plan for a 2756 sq. ft. warehouse building. The amendment consists of constructing a 2100 sq. ft. accessory building. 2. This property located at 15 Lime Rock Road lies within the I-C District and Flood Plain Overlay District. 3. The owners of record of this property are Normand 4 Laurie Frennette. 4. Access/Circulation: Access is provided by a 20-foot wide curb cut on Lime Rock Road. No changes proposed. Circulation on the site is adequate. 5. Coverage/setbacks: Building coverage is 10.96% (maximum allowed is 4o%). Overall coverage is 41.21% (maximum allowed is 70%). Front yard coverage is 26.9% (maximum allowed is 30%). Setback requirements are being met. 6. Pam: A total of three (3) parking spaces are required and 14 spaces are being provided including one (1) handicapped space and a bike rack. Prior to issuance of a Certificate of Occupancy, the handicapped space will have to be indicated on the pavement and the other spaces stripped. 7. Landscaping: The minimum -landscaping requirement, based on building cost, is $540, which is being met. Only 10 of the 17 White Pines that were originally required are existing. The missing trees will have to be planted to issuance of a Certificate of Occupancy. 8. Lighting No additional exterior lighting is proposed. 9. Traffic: ITE estimates the current use to generate 4.9-vehicle trip ends (vtes) during the PM peak hour. ITE estimates that the current use plus the proposed building will generate 8.9 vtes for a 4.0 vte increase. The applicant will be required to pay the road impact for the additional traffic. IO.Dumpster: A screened dumpster storage area is indicated on the plan. 11.0ther: a) There is a truck parked on the open space at the northeast end of the building, which must be moved. b) There are two (2) unregistered motor vehicles on the site constituting a "Junk yard". These vehicles should be removed. c) There is currently unapproved outside storage, which must be removed prior to issuance of a Certificate of Occupancy. DECISION Based on the above Findings of Fact, the South Burlington Development Review Board approves site plan application #SP-03-13 of Michael and Cynthia Tetrault to amend a previously approved plan for a 2756 sq. ft. warehouse building. The amendment consists of constructing a 2100 sq. ft. accessory building, 15 Lime Rock Road, as depicted on a plan entitled "Normand Er Laurie Frenette Lot #7-Lime Rock Road South Burlington", prepared by O'Leary -Burke Civil Associates, PLC, dated 11%13%98, last revised on 6%10/03, with the following stipulations: 1. All previous approvals and stipulations, which are not superseded by this approval, shall remain in effect. 2. For the purpose of calculating road impact fees under the South Burlington Impact Fee Ordinance, the Development Review Board estimates that the accessory structure will generate 4.0 additional vehicle trip ends during the PM peak hour. 3. Any new exterior lighting shall consist of down casting -shielded fixtures. Any changes to approved lights shall require approval of the Director prior to installation. 4. Prior to issuance of a zoning permit, the applicant shall post a $540 landscape bond. The bond shall remain in effect for three (3) years to assure that the landscaping take root and has a good chance of surviving. 5. Prior to issuance of a Certificate of Occupancy, the applicant shall stripe the paved portion of the parking lot as shown on the approved plan. 6. Prior to issuance of a Certificate of Occupancy, the applicant shall plant the seven (7) missing White Pine trees that were required as part of the original approval. 7. Prior to permit issuance, the applicant shall provide a landscaping budget for the new landscaping prepared by a landscape architect or professional designer, which shall meet or exceed the $540 minimum landscaping requirement. 8. Prior to issuance of a Certificate of Occupancy, the applicant shall: a) move the truck parked on the open space at the northeast end of the building onto an approved parking space, b) remove the two (2) unregistered motor vehicles from the property, and c) remove all unauthorized outside storage. 9. The applicant shall obtain a zoning permit within six (6) months pursuant to Section 17.04 of the land development regulations or this approval is null and void. 10.The applicant shall obtain a Certificate of Occupancy from the Administrative Officer prior to the use of the new accessory structure. 11. Any change to the site plan shall require approval by the South Burlington Development Review Board. ----------------------- --------------------- hairman Date South Burlington Development Review Board Please note: You have the right to appeal this decision to the Vermont Environmental Court, pursuant to 24 VSA 4471 and VRCP 76 in writing, within 30 days of the date this decision is issued. The fee is $150.00. If you fail to appeal this decision, your right to challenge this decision at some future date may be lost because you waited too long. You will be bound by the decision, pursuant to 24 VSA 4472 (d) (exclusivity of remedy; finality).
