Only 5,000 square feet was constructed. The amendment consists of: 1) storage of one 40' x 10' construction office trailer within the rear parking area, and 2) constructing a gravel access drive to the rear of the building, 6 Lime Rock Road, as depicted on a one (1) page set of plans, entitled, "S. Barrett, Lime Roack Road South Burlington, Vermont", prepared byPaul Carlson, dated 6/26/00, with the following stipulations: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. The site plans shall be revised to show the changes listed below and shall require approval of the Director of Planning & Zoning (hereinafter Director). DEVELOPMENT REVIEW BOARD 5 SEPTEMBER 2000 There would be no new curb cut and no adjustment of the original curb cut Mr. Belair said there was no overhead door in the plan that was originally approved. It was apparently put in before these people bought the property. Mr. Dinklage said it seems there is a lot of space in the back for access to that door. Mr. Carlson said it doesn't work for a large trailer with a pick up. It would go over the bank. Mr. Dinklage said he would like staff to look at that. Mr. Belair noted the Board couldn't approve any incursion into the flood plain. Mr. Dinklage said the boundary needs to be where it was originally approved. He advised the applicant to work this through with staff. Mr. Farley moved to continue the application until 19 September. Ms. Quimby seconded. Motion passed unanimously. 8. and 9. Public Hearing: Preliminary plat application #SD-00-41 and final plat application #SD-00-42 of Wright and Morissey Realty Company to amend a P.U.D, consisting of: 1) an 11,400 sq. ft. general office building, and 2) a 41,000 sq. ft. building which includes 40,500 sq. ft. of general office use and 500 sq. ft. of bakery and delicatessen use. ALL - uendment consists of: 1) replacing the 11,400 sq. ft. general office building with a 35 unit multi -family dwelling, 60 Farrell St: Mr. Farrell said this is a revision of a PUD approved 4 or 5 years ago. He showed the proposed location of the office building. He noted that at sketch review they had showed the residences with access from Joy Drive. The number of units has been reduced from 35 to 34. Parking is mostly the same. The building will be 4 stories, and the driveway access will still be from Joy Dr. They have taken all improvements out of the CO District. The property will be divided into 2 lots. Mr. Farrell then showed the planting plan. There will be some plantings in the CO Zone. The building is 7 ft. above the height limit. They are asking a waiver from the additional setbacks required. Mr. Rabideau said the building is more in keeping with the commercial buildings around it. It will have a flat roof and an all brick exterior. Each unit has a large bay window. He showed a building concept. Units will be 1, 2 or 3 bedrooms. It will be aimed at an upper end market. 31 DEVELOPMENT REVIEW BOARD 5 SEPTEMBER 2000 Mr. Farley moved the Development Review Board approve application #MS-00-05 of Faucet Builders, Inc, under Section 25.117 of the South Burlington Zoning Regulations to add 96 cubic yards of fill material on an existing residential lot for the construction of a single family dwelling, 1397 Spear Street, as depicted on a plan entitled "Faucet Property Site Plan South Burlington, Vermont," by Llewellyn - Howley, Inc., dated 7/25/00, with the following stipulations: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. Based on evidence submitted at the meetings and as part of this application, the South Burlington Development Review Board hereby renders the following decision on this application: FINDINGS OF FACT 1. The owner of record of this particular property is Stephanie D. Barrett. 2. This project consists of a site plan application of Stephanie Barrett for an amendment to a previously approved site plan for a 5,700 square foot or less office/warehouse building. Only 5,000 square feet was constructed. The amendment consists of. 1) storage of one 40' x 10' construction office trailer within the rear parking area, and 2) constructing a gravel access drive to the rear of the building, 6 Lime Rock Road. The Planning Commission previously approved a site plan for this property on May 1, 1990. The requested improvements have already been constructed. Staff discovered that these changes were made without approval and requested the applicant obtain approval for the changes made. 3. Access/circulation: A thirty (30) foot curb cut on Lime Rock Road leading to an eighteen (18) foot access drive was previously approved. The applicant has proposed a twenty three (23) foot curb cut leading to a fourteen (14) foot access drive. Section 26.254 of the zoning regulations requires that access drives be a minimum of twenty (20) feet in width for a commercial or industrial access drive connecting parking area to a public street. This decrease in the width of the access drive is proposed as part of the parking reconfiguration to accommodate the proposed trailer. In addition, aisles between double loaded parking have a twenty four (24) foot minimum aisle width and single loaded aisles have a twenty two (22) foot minimum aisle width. These aisle widths are not being met. 4. The Fire Chief has commented that the proposed access and circulation does not allow proper access for fire trucks. 5. Coverage/setbacks: The proposed changes will increase the total overall coverage from 26.6% to 29.4% (30% maximum). Building coverage is 12% (30% maximum). Front yard coverage is 8% (30# maximum). All setbacks are met. 6. Parking: The proposed project will alter the existing parking arrangement. A total of seven (7) parking spaces were previously approved (seven (7) required) and a total of seven (7) parking spaces are proposed. The proposed parking will create three (3) parallel parking spaces eighteen (18) feet in length. The required minimum length of a par, 11el parking space is twenty two (22) feet. 7. Floodplain: The applicant has filled in the 100 year Floodplain Overlay District to create the proposed gravel access drive to the rear of the building. The applicant has proposed to eventually pave this access drive. Section 20 of the Zoning Regulations prohibits this proposed work. Filling and access drives not associated with agricultural, forestry, and horticultural practices are neither a permitted nor conditional use. CONCLUSIONS OF LAW 1. Section 26.102(b) of the zoning regulations requires "appropriate aisle widths to accommodate emergency vehicles and vehicular and pedestrian movement patterns, location of parking areas to prevent conflicts with entering and exiting traffic onto a public street, prevention of conflicts between vehicles and pedestrians, and location of loading docks." Aisle widths on the proposed plan do not meet the minimum width requirement under Section 26.251 of the zoning regulations. The Board concludes that on -site circulation is inadequate and that Section 26.102(b) of the zoning regulations is not being met. 2. Section 26.251 of the zoning regulations requires paralL'. parking spaces to be twenty two (22) feet in length. The parallel spaces proposed are eight feet (18) feet in length. The Board concludes that Section 26.251 of the zoning regulations is not being met. 3. Section 26.102(e) of the zoning regulations requires the Board to consider among other things fire protection. The Fire Chief has commented that the proposed access and circulation does not allow proper access for fire trucks. The Board concludes that Section 26.102(e) of the zoning regulations is not being met. 4. Sections 20.10 and 20.20 of the zoning regulations list those uses allowed within the Floodplain Overlay District. The applicant has added fill and proposes to use a portion of the property located within the Floodplain Overlay District for an access drive. The placement of fill and use of this area for a driveway is not permitted. The Board concludes that the proposed driveway use, and fill are not in compliance with Article XX Floodplain Overlay District of the zoning regulations. E DECISION Based on the above Findings of Fact and Conclusions of Law, the South Burlington Development Review Board hereby denies the Applicant's request for site plan approval for an amendment to a previously approved site plan for a 5,700 square foot or less office/warehouse building. Since this encroachment is more than average, the project must be reviewed under Section 25.118(c) of the Zoning Regulations. Section 25.118 is a new addition to the Zoning Regulations that provides exceptions to yard setback and coverage requirements for lots in existence prior to February 28, 1974 that are primarily a single family or two-family residence. This property at 2 Sherry Road is a corner lot located in the Residential Four District. Staff has not heard from the applicant. 8) & 9) WRIGHT & MORISSEY REALTY COMPANY, PRELIMINARY & FINAL PLAT APPLICATIONS TO AMEND A PREVIOUSLY APPROVED P.U.D., 60 FARRELL STREET This project is an amendment to a P.U.D. consisting of. 1) an 11,400 square foot general office building, and 2) a 41,000 square foot building which includes 40,500 square feet of general office use and 500 square feet of bakery and delicatessen use. The amendment consists of. 1) replacing the 11,400 square foot general office building with a 35 unit multi -family dwelling. The Development Review Board considered the sketch plan application for this project on April 4, 2000 (minutes enclosed). The property located at 60 Farrell Street lies within the C2 and C.O. Districts. It is bounded on the north by the Olympiad Fitness Center, on the west by Farrell Street, on the south by I-89, and on the east by WCAX studios. Access/circulation: Access is provided by a 30 foot curb cut on Farrell Street and a 24 foot curb cut on Joy Drive. Access to Joy Drive is via a deeded right of way over the Olympiad property. Circulation on the site appears to be adequate. The applicant has depicted a pedestrian walkway linking the proposed parking area with the existing parking area on the landscaping plans. The walkway should be moved to the north side of the building as the proposed walkway encroaches into the C.O. District which is not allowed. The site plan should be revised to include the proposed walkway. Coverag,e/setbacks: The existing building coverage is 5% and will increase to 10% (20% max). The total coverage for the property is 27.6% and will increase to 44% (40% max). Coverage requirements are therefore not being met. It has been the Development Review Board's unwritten policy of using the residential coverage's for mixed use developments. The applicant is requesting that the policy be amended to allow the greater overall coverage. Access/Circulation: Access is to be provided via a 20 foot curb cut on Catkin Drive. Circulation is adequate. Coverage/Setbacks: Proposed building coverage is 1.2% (max 20%). Other Business Mr. Weith noted that with regard to the Larkin-Milot project on Shelburne Rd., the TMA director from New Jersey will come up and provide preliminary advice on setting up a S. Burlington TMA. She will meet with the City Council next Monday and Planning Commission members may wish to attend. Burger King on Williston Rd, has a playground in front of the building that they want to enclose in glass. It will remain a playground and will be available for such use in winter. The Commission asked that they come in for a hearing so it can be stipulated the area remain a playground. Mrs. Maher noted at the 14 May Zoning meeting, Jiffy Lube's location is up for multiple use approval to include a bakery/ thrift store and a dry cleaner. She felt the Commission should express concern about traffic numbers. Mr. Weith said the owner knows he has to come to the Planning Commission. Mrs. Maher stressed if the Zoning Board approves the multiple use, the Com- mission may have no power. Mr. Burgess noted receipt of a letter from the City Council ex- pressing concern on the Ramada Inn property which has been in dispute as to ownership. Mr. Weith noted that the Zoning Board has asked that traffic impact questions on the UVM project be referred to the Planning Commission. There has been a meeting with Regional Planning on this issue. Mr. Goldberg questioned why fire access to the rear of the building has become an issue when it wasn't mentioned when the same plan was submitted 3 years ago. He said the building will be for warehouse, offices and a showroom and is actually 6,000 sq. ft. The curb cut will be on Lime Rock Rd. There will be a loading dock in the rear of the building. Mr. Weith noted there is a question of the flood plain going through the proposed parking lot. Mr. Goldberg said they can back off and make the building a bit shorter and could also move the building forward. Mr. Weith said that is OK as long as front yard coverage is met. Mrs. Maher suggested continuing the hearing until everything is in order. Mr. Goldberg said a 30 ft. drive is not a problem. Mr. Wieth noted the Fire Chief recommends a hydrant in the cul de sac to serve all of these buildings. Ms. Peacock wanted to know how far away existing hydrants are. Mr. Weith said one is about 150-175 ft. from the proposed building and the other is over 1,000 ft. Ms. Peacock noted only 5 parking spaces are shown and 7 are required. Lot 1 is by itself at the inter- section of Shamrock Road and Ethan Allen Drive. Additional topographic work has been done. The limits of the 100 year flood plain have been extended. The fence line has been shown. Lot 1 has been narrowed a bit to put 20 feet between the flood plain limit and the back of the lot. Mr. Spitz noted that although buildings cannot be on the flood plain, they can use the area back to the existing fence for parking, etc. Mr. Page noted that they would prefer to have access to lots 2 and 8 directly from Ethan Allen Drive. Regarding a right of way, Mr. Spitz noted that although 60 feet would be required for a public street, that is not the case here, and 40 feet would be sufficient with 20 feet in the lot and 20 feet in the flood plain. Mr. Mona expressed concern f'ari a clear designation of the right of way involved. Mr. Belter said it was his thought that ifithe road ever needed to be built someday there was no reason 20, 30 or 50 feet of it couldn't be out in the flood plain. Mr. Mona said they didn't want to put the road out there; rather add 10 feet either side of the already designated 20 feet. Mr. Page agreed to add a 10 foot right of way for future development on the easterly line of lot 1 to serve the rear land. Regarding entrances to the lots, Mr. Spits suggested two options. If there is concern with those entrances there would have to be a stipulation that entrances come only into the main road, in which case 2 lots would have to be dropped off. If there is notconcern, no stipulation is needed. Mr. Pager said there is still concern with Ethan Allen Drive coming into the already dangerous intersection. Mr. Page said that in his -Last conversatinn with Mr. Szymanski, Mr. Szymanski indicated that the City plans to install a flashing caution signal at the intersection.. Mr. Mona asked whether anyone has estim- ated what the cost would be to improve the intersection. Mr. Spitz replied that for this scale of development, the cost would be too great. Mr. Mona then asked whether the Commission has any money to spend on its own survey of what can be done and how much it would cost. She also noted they can request a 15-foot buffer strip between the development and the residential area adjacent to it. Mr. Desmond said they are hoping for some office buildings and small plants, perhaps some warehousing. Mr. Belter asked the status of Gregory Drive. Access: The access is shown from a 30 foot driveway on the west side of Lime Rock Drive. It should be constructed with a depressed concrete curb across the driveway. Circulation and Parking: A 12 foot wide driveway is shown around the north of the building to a gravel parking area in the rear. A seven car parking lot is shown in front of the building. Dear Mr. Belter: The Division of Protection has received a written request to allow the commencement of construction for the foundation of the above referenced project. In accordance with the Environ- mental Protection Rules, Chapter 4 - Public Building, Section 4-03(2), authorization is hereby granted by the Protection Division for commencement of construction with the following conditions: (1) Construction of the actual structure is limited, at this time, to foundation work only and does not include nor is permission granted for the installation of interior plumbing either above or below grade. (Please note, interior plumbing is defined to include waste and water piping beginning 3 feet outside of the foundation wall and extending into the building. (2) Permission for foundation construction does not include authorization for the installation of the exterior sewer and water line services to the building. No exterior sewer or water lines are authorized for installation until the Land Use Permit has been issued by the Protection Division. (3) This letter authorizing foundation construction does not relieve you, as applicant, from obtaining all approvals and permits as may be required from the City of South Burlington and the Department of Labor and Industry prior to construction. Please note, this office has not received the plans for the interior plumbing and ventilation.
