FINDINGS OF FACT & DECISION STATE OF VERMONT COUNTY OF CHITTENDEN - qi7_ 000© CITY OF SOUTH BURLINGTON Re: Findings of Fact, application of Frank Naef to amend a site plan approved on 3/9/93 and 7/10/90 on two (2) lots each containing multiple buildings and multiple uses. The amendment consists of adding auto sales use to an exising auto repair use, 1906-1908 Airport Parkway. On the 29th day of April, 1997, the South Burlington Planning Commission approved the request of Frank Naef for site plan review under Section 26.10 of the South Burlington Zoning Regulations based on the following findings: 1. This project consists of amending a site plan approved on 3/9/93 and 7/10/90 on two (2) lots each containing multiple buildings and multiple uses. The amendment consists of adding auto sales use to an existing auto repair use. The ZBA on 4/28/97 approved a request from the applicant for a conditional use permit for the proposed use. 2. These properties located at 1906 & 1908 Airport Parkway lie within the IC District. They are bounded on the north by a r.o.w. providing access to 1908 Airport Parkway and an industrial building to the east, on the east by an industrial building, on the south by undeveloped land, and on the west by Airport Parkway. 3. Access/circulation: Access is provided by a 43 foot curb cut (16 feet of this curb cut is on the applicant's property and the remaining 27 feet provides access to a r.o.w.) which serves 1908 and 1890 Airport Parkway. Access is also provided by an 18 foot curb cut serving 1906 and 1908 Airport Parkway. No changes proposed. Circulation on the site is adequate. 4. Coverage/setbacks: 1906 Airport Parkway: Building coverage is 9.6% (maximum allowed is 30%). Overall coverage is 41.8% (maximum allowed is 70%). Front yard coverage is 16% (maximum allowed is 30%). 5. 1908 Airport Parkway: Building coverage is 17.2% (maximum allowed is 30%). Overall coverage is 62% (maximum allowed is 70%). Front yard coverage is 30.3% (maximum allowed is 30%). This is an existing situation which will not be made worse by this application. 6. Building "B" and "D" do not meet the front yard setback requirements and building "E" does not meet the side yard setback requirement. These buildings are noncomplying structures subject to the limitations of Section 26.002 of the zoning regulations. 7. Parking: A total of 21 parking spaces are required and 24 spaces including one (1) handicapped space and a bike rack are provided. Parallel spaces #1-3 should be revised to be 22 feet in length. 8. Traffic: No additional traffic is expected to be generated. 9. Landscaping: There is no minimum landscaping requirement, based on building costs, for this project. No additional landscaping recommended. 10. Other: --- the plan should be revised to identify each lot by its street address. DECISION & CONDITIONS Based on the above Findings of Fact, the South Burlington Planning Commission approves the site plan application of Frank Naef to amend a site plan approved on 3/9/93 and 7/10/90 on two (2) lots each containing multiple buildings and multiple uses. The amendment consists of adding auto sales use to an existing auto repair use, 1906-1908 Airport Parkway, as depicted on a plan entitled, 111906 & 1908 Airport Parkway Owners: Frank Naef Curtis Montgomery," dated 4/17/97, with the following stipulations: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. Any new exterior lighting shall consist of downcasting shielded fixtures so as not to cast light beyond the property line. Any change in lighting shall be approved by the City Planner prior to installation. 3. For the purpose of calculating road impact fees under the South Burlington Impact Fee Ordinance, the Planning Commission estimates that the proposed changes in use will generate zero (0) additional vehicle trip ends during the P. M. peak hour. 4. The plan shall be revised to show the changes below and shall require approval of the City Planner. Three (3) copies of the approved revised plans shall be submitted to the City Planner prior to permit issuance. a) The site plan shall be revised to show parallel parking spaces #1-3 with a minimum length of 22 feet. b) The site plan shall be revised to identify each lot by its E I street address. c) The plan shall be revised to show building "E" as "office" not retail. 5. The applicant shall obtain a zoning permit within six (6) months pursuant to Section 27.302 of the zoning regulations or this approval is null and void. 6. The applicant shall obtain a Certificate of Occupancy/Compliance from the Administrative Officer prior to occupancy of the newly converted space. 7. Any change to the site plan shall require approval by the South Burlington Planning Commission. 8.
