FINDINGS OF FACT & DECISION
STATE OF VERMONT
COUNTY OF CHITTENDEN
CITY OF SOUTH BURLINGTON
Re: Findings of Fact, application of Frank Naef to amend a previously approved site plan
dated April 29, 1997 to: 1) Change the use of a 1,800 SF building "C" from office and
storage to lumber yard not including retail, a permitted use in the IC district; 2) change the
use of the exterior area previously approved for materials storage to a graveled lumber
storage area, accessory to the lumber yard not including retail use; 3) add a dumpster
location near the northwest corner of the lumber yard building; 4) relocate a previously
approved dumpster and enclosure; 5) remove four parking spaces; and 6) add a handicapped
ramp at the rear of the existing 1,050 SF retail building labeled "D" on the plans, at 463-469
Lime Kiln Road, South Burlington, VT 05403.
On the 25a' day of February, 2002, the Director of Planning and Zoning approved the
request of the for site plan review under Section 26.10 of the South Burlington Zoning
Regulations based on the following findings:
This project consists of six changes to a previously approved site plan approval for a
five (5) building complex with multiple uses at 463 and 469 Lime Kiln Road. The
current application consists of seven changes to the prior approval: 1) Change the
use of a 1,800 SF building (labeled "C" on the plans) from office and storage to a
lumber yard not including retail, a permitted use in the IC district; 2) change the use
of 912 SF of exterior area previously approved for materials storage to a graveled
lumber storage area, accessory to the lumber yard not including retail use; 3) add a
dumpster location near the northwest corner of the lumber yard building; 4) relocate
a previously approved dumpster and enclosure; 5) remove four parking spaces; and
6) add a handicapped ramp at the rear of the existing 1,050 SF retail building. The
uses in buildings "A," "B," "D" and "E" are not proposed to change.
2. The record owner of the property is Frank R. Naef. This property consists of two
lots located at 463 and 469 Lime Kiln Road, both of which are within the IC -Mixed
Industrial Commercial District.
3. Access/circulation: No changes affecting overall access and circulation are
proposed.
4. Coverage: There are two lots covered by this site plan approval. There are no
changes affecting coverage on the lot at 463 Lime Kiln Road, which meets building

(9.6%, maximum of 30%), overall (42%, maximum of 70%) and front yard (16%,
maximum of 30%) coverage requirements. Coverages on the lot at 469 Lime Kiln
Road will be affected by this proposal. Building coverage will remain at 17.2% and
overall coverage will increase from 62% to 64.7% with the addition of a graveled
lumber storage area. This is within the 70% requirement. The previously approved
front yard coverage of 30.3% will be unchanged. All setback requirements for the
property appear to be met.
5. Setbacks: Buildings "B" and "D" do not meet front yard setback requirements, and
building "E" does not meet the side yard requirement. All of these buildings are
non -complying structures and subject to Section 26.002 of the South Burlington
Zoning Regulations. All other setbacks appear to be met.
6. Landscaping_ No changes in landscaping are proposed as part of this application,
and none are recommended.
7. Traffic: The proposed configuration of uses will generate an estimated 25.3589 PM
peak hour trips, which is 1.9504 more than the 23.4085 currently permitted for the
site. The applicant will need to pay the applicable traffic impact fee for the increase.
8. Parking. The parking requirement for this property and the approved uses is 20
spaces, including one that is designated handicapped -accessible. The plans indicate
21 spaces and a bike rack, but do not specify which space is handicapped -accessible.
9. Sewer: The proposed changes do not affect the wastewater flows for the property.
10. Lighting: No changes to lighting are proposed.
11. Dumpsters and storage: The plans show the relocation of the approved dumpster
from a point in the graveled lumber storage area to a location at the corner of the
parking area serving buildings "D" and "E." The plans indicate that the dumpster
will be screened by a fence and rolling gate. The plans also indicate a new dumpster
at the northwest corner of building "C," which would be screened from view from
the public right-of-way by a wood fence and landscaping.
DECISION AND CONDITIONS
Based on the above Findings of Fact, the South Burlington Director of Planning and Zoning
approves the site plan application of Frank Naef to 1) change the use of a 1,800 SF building
from office and storage to lumber yard not including retail, a permitted use in the IC district;
2) change the use of 912 SF of exterior area previously approved for materials storage to a
graveled lumber storage area, accessory to the lumber yard not including retail use; 3) add a
dumpster location near the northwest corner of the lumber yard building; 4) relocate a
previously approved dumpster and enclosure; 5) remove four parking spaces; and 6) add a
handicapped ramp at the rear of the existing 1,050 SF retail building labeled "D" on the
plans, at 463-469 Lime Kiln Road, South Burlington, VT 05403, as depicted on a plan

entitled "463 & 469 Lime Kiln Road," dated February 12, 2002, with the following
stipulations:
1) All previous approvals and stipulations, which are not superseded by this approval, shall
remain in effect.
2) Any changes to the site plan shall require approval by the South Burlington
Development Review Board.
3) Any changes to the exterior lighting shall require approval of the South Burlington
Director of Planning and Zoning.
4) One (1) of the proposed parking spaces on the site shall be designated and labeled as a
designated handicapped parking space for the site. The plans shall be corrected to
specify the space to be labeled for handicapped use prior to issuance of a Zoning Permit.
5) The applicant shall pay any applicable traffic impact fees prior to issuance of a Zoning
Permit.
6) A zoning permit shall be obtained within six (6) months or this approval shall be null
and void.
