The South Burlington Planning Commission held a meeting on
Tuesday, 10 January 1995, at 7:30 pm, in the Conference Room,
City Hall, 575 Dorset St.
Members Present:
William Burgess, Chairman; Mac Teeson, Mark Crow, Gayle Barone,

1. Other Business:
Mr. Weith advised that at last night meeting, the City Council
adopted impact fees for schools, roads, and recreation.
Mr. Burgess said he got a letter from the State Development and
Community Affairs office regarding artifacts found on the South-
land site.
2. Minutes of 15 November and 29 November:
Mr. Austin moved the Minutes of 15 November be approved as
written. Mr. Crow seconded. Motion passed 4-0 with Mr. Sheahan
and Ms. Barone abstaining.
Mr. Sheahan moved the minutes of 29 November be approved as
written. Mr. Austin seconded. Motion passed unanimously.
3. Public Hearing: Final Plat application of Marian Dumont for
subdivision of a 67,095 sq. ft. lot into 3 lots of 23,274 sq.
ft., 24,403 sq. ft. and 19,418 sq. ft., 1907-0 , 1915-17, and
1923-25 Airport Parkway. The lot is currently developed with
three duplex residential buildings:
Mr. Burgess noted the applicant had gotten a variance from the
Zoning Board because the lots don't meet minimum lot size.
Mr. Hary ell said the duplexes were built in the early 60's and
have been occupied since then. They have been taxed as sep-
arate lots. Each lot has public water and a septic system.
Mr. Crow asked if the distance of the septic systems from the
side boundaries had to be calculated. Mr. Weith said they de-
termined they were grandfathered. Mr. Harwell said there has
never been a problem with the systems.

Mr. Burgess raised the question of curb cuts for three buildings.
Mr. Har)nell said there are 6 living units in 3 buildings with 4
driveways.
Mr. Bresee noted the property is on Airport Parkway where the
bike path committee had submitted a recreation path proposal. He
raised the question of an easement. Mr. Weith said this hasn't
been discussed. Mr. Harvell said there is adequate room, about
20 ft. between the edge of the pavement and the property line.

4. Site plan application of Shawn B. Cliche for conversion of a
former fast food restaurant (Arby's) to a 54 seat night club
including 116 standing patrons for a total of 170 patrons, 1087
Williston Road:
Mr. Abair, representing the applicant, said the similar use in
Barre has a good reputation. He thanked.. the Commission for
giving them a chance to address traffic concerns. He said that
the peak hour traffic on Williston Rd. is from 4-5 pm. The ap-
plicant would agree to open the bar at 5:30 pm. He said the peak
hour for the club in Barre is 9-10 pm. It is proposed that one
curb cut would be removed and the other one relocated as far from
Dorset St. as possible. There is also an access to Dorset St.
via a deeded right of way over the Greer property.
Ms. Knox reviewed the plan, stressing that they will do every-
thing possible- to keep people from making left turns out to Wil-
liston Rd. They will sign the access for right turn only and
will also have a sign in back indicating the way to Dorset St.
and I-89.

Dear Mr. Knapp:
This letter will confirm information given to you in a meeting at
my office in November.
Documentation provided by you indicates that the lot on Airport
Parkway contained three duplexes built on the lot in 1965. The
duplexes meet the exemption cited in State Environmental
Regulations Chapter 3-02(B)4. This exemption is for a parcel
"which on March 5, 1973, contained two or more structures which
were used on or before that date as primary single or two family
residences" and allows a boundary line to be drawn between the
structures.
If in the future any boundary lines are changed a permit from
this office may be needed.

3) DUMONT & BACHMAN - 3 LOT SUBDIVISION - FINAL PLAT
This project consists of the subdivision of a 67,095 square foot
lot into three (3) lots of 23,274 square feet, 24,403 square feet
and 19,418 square feet. This lot is currently developed with three
(3) duplex residential buildings. The purpose of the subdivision
is to set-off a lot for each duplex. The Zoning Board of
Adjustment on September 26, 1994 granted a variance request from
the applicant to allow the creation of lots which do not meet the
minimum area and frontage requirements. The sketch plan was
reviewed on 9/20/94 (minutes enclosed).
This property located at 1907-1909, 1915-1917 and 1923-1925 Airport
Parkway lies within the IC District. It is bounded on the south by
a single family dwelling, on the east by Airport Parkway, on the
north by a single family dwelling and on the west by undeveloped
property.

Setbacks: The 15 foot side setback requirement is being met. The
duplexes do not meet the 50 foot front setback requirement. This
is an existing situation which is not being made worse.
Lot size/frontage: The 40,000 square foot minimum lot size
requirement is not being met. The applicant received a variance
from the Zoning Board of Adjustment on 9/26/94 to allow substandard
sized lots.
The minimum frontage requirement of 200 feet is not being met.
Relief from this requirement was also obtained from the Zoning
Board of Adjustment.
Sewer: No additional sewer allocation is needed since the three(3)
lots have on -site sewage disposal systems.
Recreation:

4. Sketch Plan application of S.D. Mansfield, Inc., to: 1)desig-
nate lots 1-16 of an approved 18-lot subdivision as a planned
unit development and 2) add 400 sq. ft. of neighborhood community
meeting space to an approved duplex on lot #9 as an accessory use
to the residential planned unit development, Kirby Rd. and
Patchen Rd:
Mr. Crow stepped down due to conflicting interests.
Mr. Farrell said there are 9 duplex lots and 7 single family
lots. The duplex lots are organized as a co-op. The 400 sq.
ft. of additional space will serve as community space. It will
be on the first floor with a separate access. No parking will
be required as the space will be for use of those living in the
development. Meetings and small social events (kids birthday
parties) will be held in the community space. Mr. Weith said he
is comfortable with the plan.
Mr. Sheahan asked if the space would be rented to outsiders. Mr.
Farrell said it would not.
Members had no problems with the project.
Mr. Crow rejoined the Commission.
5. Sketch plan application of James Harvell to subdivide a 67,095
sq. ft. lot into three lots of 22,584 sq. ft., 25,093 sq. ft.,
and 19,418 sq. ft., 1907-9, 1915-17 and 1923-25 Airport Parkway:
Mr. Harvell said the land is owned by Marion Dumont and Lori
gachmen. It is shown as 3 lots on the tax map. When the owners
wanted to sell lot #2, they found the land had not been
subdivided. There will be individual driveways for the
properties.

Mr. Burgess noted the building on lot #1 won't meet the 15' side
setback and they will either have to meet it or get a variance.
It was noted the applicant is already going to the Zoning Board
to waive minimum lot size and minimum frontage.
The Commission saw no reason not to approve the plan if the
variances are obtained.
6. Sketch Plan application of Cynosure, Inc, to subdivide a 175
acre lot into 6 lots ranging in size from 4.0 acres to 146.66
acres, 115 Kimball Avenue:
Mr. Crow stepped down due to a conflict of interest.
Mr. Sehney reviewed the history of the site noting that this is
the former Digital property originally subdivided in 1975 and
amended in 1977. GBIC has the chance to buy the land and sell
lot #6 (the former Digital lot) to Rainbow Rugs. They would also
develop industrial sites on lots 1-4. Lot 5 houses Green
Mountain Power's substation which they would own.
Mr Burgess asked about access. Mr. Behny showed accesses which
will require easements in some cases.
Mr. Weith reviewed the issues. Sewer allocation will have to be
determined and it will have to be decided how long the sewer ap-
proval will last.
Traffic impacts will also have to be assessed. Mr. Burgess said
he would like to review the traffic situtations from the original
Digital approval.
Mr. Weith will review the original approvals.
7. Site plan approval of South Burlington Realty to contruct a
19,378 sq. ft. mixed commercial use building, 2069 Williston Rd:
Mr. Crow stepped down due to conflicting interests.
Mr. Jaeger said the property is a vacant field now on the south
side of Williston Rd. There was some approval a few years ago
for a warehouse. The present planis for a highly visible
building, upscale, for retail tenants. It will be highly dec-
orated with lots of glass. They plan for up to 4 uses including
professional health/fitness, educational child/parent physical
activity center, deli -restaurant (a low number of tables, mostly
a delivery business). Breakers Billiards would be in the back.
Mrs. Maher noted the difficulty with making left turns out of
this area.

18 lot subdivision as a planned unit development and 2) adding 400
square feet of neighborhood community meeting space to an approved
duplex building on lot #9 as an accessory use to the residential
planned unit development. The purpose of the meeting space is to
provide space for members of the cooperative which controls lots 1-
16 to meet. This subdivision was originally approved on 8/29/89
and revised on 2/5/91 and 6/9/92 (minutes enclosed).
This subdivision located at the corner of Patchen Road and Kirby
Road behind the existing residences on both streets lies within the
R4 District.
The proposed meeting space will be used as follows:
--- business meetings of the cooperative. These meetings are
typically 6-9 persons involved in various co-op committees
(legal/finance committee, maintenance/on-call committee,
membership committee) and will be held primarily in the late
afternoon or evening hours.
--- meetings with potential new members of the cooperative and
orientation to the co-op when units become vacant. These
meetings would be held in the late afternoon or evening hours.
--- social events such as children's birthday parties, potluck
suppers, scheduled through the co-op. These activities would
be limited to a maximum of 20 persons, and held primarily on
weekend days or evenings. All activities would end by 11:00
P.M.
--- storage of community equipment and records. The use of this
equipment would be on an as needed basis by the co-op Board of
Directors or authorized members of the co-op.
Parking: Applicant has indicated that no additional parking is
needed because the room will be used solely by the residents who
will walk from their homes.
Other: The applicant will be required to record a "Notice of
Condition" which clearly identifies and legally ties together
lots 1-16 as a PUD for planning, zoning and subdivision purposes.

northerly boundary line. Applicant should either obtain a variance
or certify that this setback requirement will be met.
Lot size/frontage: The minimum lot size in this district is 40,000
square feet. This minimum lot size is not being met. The
applicant is scheduled to appear before the Zoning Board of
Adjustment on September 26, 1994 seeking a variance to allow lots
smaller than the minimum requirement.
The minimum frontage requirement of 200 feet is not being met.
Relief from this requirement is also being requested from the
Zoning Board of Adjustment.
Final plat: The final plat should include the following additional
information:
--- locations of all existing driveways
--- five (5) foot contour lines
--- locations of on -site sewage disposal systems

The South Burlington Planning Commission will hold a public hearing
at the South Burlington City Hall, Conference Room, 575 Dorset
Street, South Burlington, Vermont on Tuesday, January 10, 1995 at
7:30 P.M. to consider the following:
1) Final Plat application of Marian Dummont for subdivision of a
67,095 square foot lot into three (3) lots of 23,274 square feet,

18 lot subdivision as a planned unit development and 2) adding 400
square feet of neighborhood community meeting space to an approved
duplex building on lot #9 as an accessory use to the residential
planned unit development. The purpose of the meeting space is to
provide space for members of the cooperative which controls lots 1-
16 to meet. This subdivision was originally approved on 8/29/89
and revised on 2/5/91 and 6/9/92 (minutes enclosed).
This subdivision located at the corner of Patchen Road and Kirby
Road behind the existing residences on both streets lies within the
R4 District.
The proposed meeting space will be used as follows:
--- business meetings of the cooperative. These meetings are
typically 6-9 persons involved in various co-op committees
(legal/finance committee, maintenance/on-call committee,
membership committee) and will be held primarily in the late
afternoon or evening hours.
--- meetings with potential new members of the cooperative and
orientation to the co-op when units become vacant. These
meetings would be held in the late afternoon or evening hours.
--- social events such as children's birthday parties, potluck
suppers, scheduled through the co-op. These activities would
be limited to a maximum of 20 persons, and held primarily on
weekend days or evenings. All activities would end by 11:00
P.M.
--- storage of community equipment and records. The use of this
equipment would be on an as needed basis by the co-op Board of
Directors or authorized members of the co-op.
Parking: Applicant has indicated that no additional parking is
needed because the room will be used solely by the residents who
will walk from their homes.
Other: The applicant will be required to record a "Notice of
Condition" which clearly identifies and legally ties together
lots 1-16 as a PUD for planning, zoning and subdivision purposes.
5) DUMONT & BACHMAN - 3 LOT SUBDIVISION - SKETCH PLAN
This project consists of the subdivision of a 67,095 square foot
lot into three (3) lots of 22,584 square feet, 25,093 square feet

and 19,418 square feet. This lot is currently developed with three
(3) duplex residential buildings. The purpose of the subdivision
is to set-off a lot for each duplex. The Zoning Board of
Adjustment on September 26, 1994 will consider a variance request
from the applicant to allow the creation of lots which do not meet
the minimum area and frontage requirements.
This property located at 1907-1909, 1915-1917 and 1923-1925 Airport
Parkway lies within the IC District. It is bounded on the south by
a single family dwelling, on the east by Airport Parkway, on the
north by a single family dwelling and on the west by undeveloped
property.
Access: Each duplex has its own driveway on Airport Parkway.
These driveways should be shown on the final plat.
Setbacks:; It does not appear that the building on lot #1 will
meet the 15 foot side setback requirement from the proposed
northerly boundary line. Applicant should either obtain a variance
or certify that this setback requirement will be met.
Lot size/frontage: The minimum lot size in this district is 40,000
square feet. This minimum lot size is not being met. The
applicant is scheduled to appear before the Zoning Board of
Adjustment on September 26, 1994 seeking a variance to allow lots
smaller than the minimum requirement.
The minimum frontage requirement of 200 feet is not being met.
Relief from this requirement is also being requested from the
Zoning Board of Adjustment.
Final plat: The final plat should include the following additional
information:
--- locations of all existing driveways
--- five (5) foot contour lines
--- locations of on -site sewage disposal systems
--- locations of all accessory buildings and entire footprint of

Being all and the same lands and premises conveyed to Leo H.
Dumont and Robert H. Dumont dba Dumont Construction Co. by
Warranty Deed of Melton M. Miller and Gertrude F. Miller
dated October 26, 1959, recorded at Volume 50, Page 419 of
the City of South Burlington Land Records.
This is the second of two deeds for the purpose of Robert H.
Dumont conveying all of his right, title and interest in and
to the above described premises to Leo H. Dumont subject to
any and all mortgage thereon which Leo H. Dumont shall
assume and agree to pay and shall indemnify and hold Robert
H. Dumont harmless from any and all liability thereon.
