On the loth of January, 1995, the South Burlington Planning Commission approved the request of Marian Dumont and Lori Bachand for final plat approval under Section 202 of the South Burlington Subdivision Regulations based on the following findings: 1. This project consists of the subdivision of a 67,095 square foot lot into three (3) lots of 23,274 square feet, 24,403 square feet and 19,418 square feet. This lot is currently developed with three (3) duplex residential buildings. The purpose of the subdivision is to set-off a lot for each duplex. The Zoning Board of Adjustment on September 26, 1994 granted a variance request from the applicant to allow the creation of lots which do not meet the minimum area and frontage requirements. The sketch plan was reviewed on 9/20/94. 2. This property located at 1907-1909, 1915-1917 and 1923-1925 Airport Parkway lies within the IC District. It is bounded on the south by a single family dwelling, on the east by Airport Parkway, on the north by a single family dwelling and on the west by undeveloped property. 3. Access: Access to the three (3) lots is provided by four (4) existing curb cuts. Two (2) of the curb cuts are shared but the driveways are not. No changes proposed. 4. Setbacks: The 15 foot side setback requirement is being met. The duplexes do not meet the 50 foot front setback requirement. This is an existing situation which is not being made worse. 5. Lot size/frontage: The 40,000 square foot minimum lot size requirement is not being met. The applicant received a variance from the Zoning Board of Adjustment on 9/26/94 to allow substandard sized lots. 6. The minimum frontage requirement of 200 feet is not being met. Relief from this requirement was also obtained from the Zoning Board of Adjustment. 7. Sewer: No additional sewer allocation is needed since the three(3) lots have on -site sewage disposal systems. 8. Recreation: No recreation fee required since the lots are already developed. 8. DECISION & CONDITIONS Based on the above Findings of Fact, the South Burlington Planning Commission approves the final plat application of Marion Dumont and Lori Bachand for subdivision of a 67,095 square foot lot into three (3) lots of 23,274 square feet, 24,403 square feet and 19,418 square feet, 1907-1909, 1915-1917 and 1923-1925 Airport Parkway. The lot is currently developed with three (3) duplex residential buildings, as depicted on a plat entitled "3 Lot Subdivision - Airport Pkwy. For Marion C. Dumont + Lori L. Bachand" prepared by James Harvell, dated 8/10/94, subject to the following stipulations: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. The final plat plan shall be recorded in the land records within 90 days or this approval is null and void. The plan shall be signed by the Planning Commission Chair or Clerk prior to recording.
