SUBJECT: SD‐20‐04 1430 Hinesburg Road Preliminary and Final Plat Application

Scott McAllister, hereinafter referred to as the applicant, is seeking preliminary and final plat approval to to
subdivide an existing 1.23 acre parcel developed with a single family home into three lots of 0.63 acres (Lot 1),
0.28 acres (Lot 2) and 0.28 acres (Lot 3) for the purpose of constructing a new single family home on each of
Lots 2 and 3, 1430 Hinesburg Road. At the February 19, 2020 hearing, the Board heard the applicant and
continued the hearing for three purposes.
1. The applicant previously provided a template TDR option agreement, but did not indicate from where
the TDRs would be purchased. The Board asked the applicant to provide a draft option agreement
indicating from where the TDRs will be purchased prior to closing the hearing, and that they would
require the option agreement to be signed prior to recording the mylar as a condition of approval. The
applicant has provided an updated option agreement that both indicates from where the TDRs will be
purchased and has been executed.
Staff recommends the Board include a condition of approval requiring that all legal documents needed
to effectuate the TDRs needed for the each dwelling be reviewed and approved by the City Attorney,
recorded in the land records, and delivered to the Administrative Officer before the zoning permit may
be issued for either proposed dwelling.
2. The Board requested the applicant provide a map showing the yields of water supply wells in the
vicinity. An 8‐page report of well yields was provided and is included in the packet for the Board.
Staff recommends the Board discuss whether their concerns about adequate water supply are
addressed.
RECOMMENDATION
Staff recommends that the Board discuss the project with the applicant and close the hearing.
