Dear Mr. Racicot:
It is my understanding that you are no longer requesting permission
to operate a community care home. Based on a discussion we had on
Monday night, you intend to have a couple of people, who will live
with you. As I explained, the eity'siing regulation defines
a family as five unrelated people living together as a single
housekeeping unit.
Recently the Vermont law changed, which allows for a community care
home for consideration as a single family unit, my concern is at
what point would you consider the maximum number of people to be
occupying your house, is this regulated by the State?
Secondly, the neighbors are very concerned with the fact that you
have converted your original garage into an apartment, when the
permit issued to you by this office was for an additional bedroom.
Their attorney is concerned because you are presently violating the
covenants along with the provisions of the zoning regulations, which
allows for a maximum of a two family dwelling.
If you intend to board a couple of people I would have to be assured
that the apartment would be terminated and that the property would
be use as a two family dwelling and be within all requirements set -
forth by the State law.
