Exceptions to Yard Setback and Lot Coverage Requirements, of the South
Burlington Zoning Regulations. Request is for permission to replace front steps
with an 8'x25' deck which will encroach eighteen feet into the 30 foot front yard
setback requirement, 58 Logwood Street:
Ms. Farrell showed pictures of the area and also gave the Board a schedule of pricing for
the work to be done.
Mr. Dinklage said the Board's concern is the visual impact on neighbors. Ms. Farrell
said none of the neighbors have a problem with it. Mr. Belair said he notified neighbors
and there have been no responses.
Ms. Farrell said the deck wouldn't have a roof. Mr. Dinklage stressed that the applicant
should in no way think this could lead to an enclosed structure.
Ms. Quimby moved the Development Review Board approve conditional use
application #MS-00-01 of Nancy Farrell under Section 25.118(c) of the South
Burlington Zoning Regulations to replace front steps with an eight foot by 25 foot
deck which will encroach 18 feet into the 30 foot front yard setback requirement in
the Residential Four District, 58 Logwood Street, as depicted on a plan entitled "58
Logwood St., S. Burlington, VT 864-9323, Nancy Farrell," dated 5100, with the
following stipulations:
1. All previous approvals and stipulations, which are not superseded by this
approval, shall remain in effect.
2. The applicant shall obtain a zoning permit within six months pursuant to
Section 27.302 of the Zoning Regulations or this approval is null and void.
3. Any change to the site plan shall require approval by the South Burlington
Development Review Board.
Mr. Schmitt seconded. Motion passed unanimously.
7. Application #MS-00-02 of Theodore & Deborah Lubicich seeking approval
under Section 25.118(c), Exceptions to Yard Setback and Lot Coverage
Requirements, of the South Burlington Zoning Regulations. Request is for
permission to construct a 9'x18' garage addition to project seven feet into the
required ten foot side yard setback requirement,1501 Williston Road:

FRONT STEP WITH DECK — 58 LOGWOOD STREET
The applicant is seeking approval under Section 25.118 of the South Burlington Zoning
Regulations to construct an eight (8) foot by 25 foot deck that will encroach 18 feet into :the
30 foot front yard setback. Section 25.118 is a new addition to the Zoning Regulations that
provides exceptions to yard setback and coverage requirements for lots in existence prior to
February 28, 1974 that are primarily a single family or two-family residence.
This property is located in the Residential Four District. It is bounded on the east by the
residence of Marion and Karyn Dubie, on the north by the residence of Laura Willette and
Richard Mead, on the west by the residence of James Smith, and on the south by Logwood
Street.
Criteria of Section 25.118 (c): This section provides for encroachment of a structure to
within five feet from the front property line provided that the encroachment will not have an
undue adverse affect on:
(i) views of adjoining and/or nearby properties
(ii) access to sunlight of adjoining and/or nearby properties
(iii) adequate on -site parking-, and
(iv) safety of adjoining and/or nearby property
The applicant has submitted a report addressing these criteria (please see enclosed) and will
bring a photo exhibit to the meeting. Though no survey plat has been submitted, the
applicant has submitted a sketch of the property (see enclosed). It is staffs recommendation
that no adverse affect will result from the proposed addition.
7) LUBICICH — MISCELLANEOUS APPLICATION — CTARAGE ADDITION —
1501 WELLSITON ROAD
The applicant is seeking approval under Section 25.118 of the South Burlington Zoning
Regulations to construct a nine (9) foot by 18 foot addition to project seven (7) feet into the
required ten (10) foot side yard setback requirement. Section 25.118 is a new addition to the
Zoning Regulations that provides exceptions to yard setback and coverage requirements for
lots in existence prior to February 28, 1974 that are primarily a single family or two-family
residence.
This property is located in the Residential Four District. It is bounded on the east by the
residence of Karen Cady, on the north by Williston Road, on the west by Elsom Parkway,
and on the south by the residence of Jim and Susan Fitzpatrick.
Criteria of Section 25.118 (c): This section provides for encroachment of a structure to
within three feet of the side yard property line provided that the encroachment will not have
an undue adverse affect on:
(i) views of adjoining and/or nearby properties

In response to your letter of May 30, 2000, I would like to
submit the following brief report.
The proposed deck will replace the existing front steps and
will not impact on any of my neighbors views, on site parking, or
sunlight. I have talked with my neighbors on either side and they have
no objections to the proposed deck.

Overview:
The applicant is seeking approval under Section 25.118 of the South Burlington Zoning Regulations to replace

and will come within 22 feet of the front property line in a district where the front yard setback is 30 feet.
Section 25.118 of the Zoning .Regulations now permits a five (5) foot setback for older lots and encroachment of
up to three (3) with board approval.
