HomeMy WebLinkAboutSD-00-55 - Decision - 0303 0305 Lime Kiln Road#SD-00-55 FINDINGS OF FACT AND DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact, final plat application #SD-00-55 of Far Water, Ltd. to amend a previously approved planned residential development consisting of 85 units in four (4) buildings on two (2) lots. The amendment consists of 1) reducing the number of units on the east side from 40 units to 37 units, 2) increasing the number of units on the west side from 45 units to 48 units, 3) parking layout modifications, and 4) building footprint and elevation alterations, 303 & 304 Lime Kiln Road. On the 7th of November, 2000, the South Burlington Development Review Board approved the final plat application of Far Water, Ltd. under Section 204 of the South Burlington Subdivision Regulations based on the following findings: 1. This project consists of amending a previously approved planned residential development consisting of 85 units in four (4) buildings on two (2) lots. The amendment consists of 1) reducing the number of units on the west side from 40 units to 37 units, 2) increasing the number of units on the east side from 45 units to 48 units, 3) parking layout modifications, and 4) building footprint and elevation alterations, 303 & 304 Lime Kiln Road. 2. The owners of record are Stephen and Shona Unsworth. 3. This property lies within the Residential Four District. It is bounded on the north and west by the Winooski River and on the east by the farm lands of John Belter. On the south, a residence and a commercial structure bound the property. Lime Kiln Road runs through the middle of the property dividing Lot # 1 from Lot 42. 4. Coverage/setbacks: The proposed building coverage for lot # 1, or the 12.5 acre lot, will remain unchanged at 4.4% (20% allowed). The total coverage is unchanged at 9.7% (40% allowed). The building coverage for lot #2, or the 12.67 lot (the eastern parcel), is unchanged at 2.9% (20% allowed). The total coverage is unchanged at 5.4% (40% allowed). Setback requirements are met. 5. Densi : The maximum number of units allowed on the westerly parcel, or lot two (2), is 50 units and 48 units are proposed (12.5 acres x 4 units/acre = 50). This density requirement has changed as Lime Kiln Road will not be realigned and therefore lot two (2) will remain 12.5 acres and not be reduced to 11.44 acres as previously thought. The applicant should provide written confirmation from the State of Vermont that the realignment will not happen. 6. Parking: A total of 192 spaces are required and 199 spaces are proposed. The applicant has proposed six handicap parking spaces (six are required). The Development Review Board previously granted a parking space waiver of one space or a 1 % parking waiver. The applicant is requesting a parking waiver of an additional twelve spaces for a thirteen space or 7% parking waiver to meet parking requirements for the western side of Lime Kiln Road. A total of 108 parking spaces are required for the western lot (#1) and 95 are provided for a thirteen space shortfall. On the eastern lot (#2), 84 spaces are required and 104 spaces are provided. Bike racks have been proposed for both lots one and two. 7. Landscaping_ No changes are proposed. 8. Sewer: The applicant has not requested an additional sewer allocation. 9. Legal Documents: This project is currently subject to a condition that the applicant agree to dedicate to the City the necessary r.o.w. to accommodate the proposed realignment. Staff recommended that this condition should remain in the event the realignment does occur. DECISION AND CONDITIONS Based on the above Findings of Fact, the South Burlington Development Review Board approves final plat application #SD-00-55 ofFar Water, Ltd. to amend a previously approved planned residential development consisting of 85 units in four (4) buildings on two (2) lots. The amendment consists of: 1) reducing the number of units on the east side from 40 units to 37 units, 2) increasing the number of units on the west side from 45 units to 48 units, 3) parking layout modifications, and 4) building footprint and elevation alterations, 303 & 304 Lime Kiln Road, as depicted on six (6) page set of plans, page one (1) entitled, "Farwater Ltd. Burlington Vermont," prepared by Provan and Lorber, Inc., dated May 1997, last revised on 10/15100, with the following stipulations: 1) All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2) Pursuant to Section 26.256(b) of the zoning regulations, the Development Review Board approves a total of 95 parking spaces on the western lot (lot #2), which is a 13 space or 12% waiver. 3) The plat plan shall be revised to show the changes below and shall require approval of the Director (hereinafter Director). Four (4) copies of the approved revised plat plan shall be submitted to the Director prior to recording. a) The survey plat shall be revised to include the conservation easement area on lot #2. b) The building elevation plans shall be revised to include skylights and dormers discussed at the meeting. 4) Any change to the final plat plans shall require approval of the South Burlington Development Review Board. 5) The final plat plans (sheets 1 of 12, 2 of 12, 3 of 12 and survey plat) shall be recorded within 90 days or this approval is null and void. The plan shall be signed by the Board Chair or Clerk prior to recording. Prior to recording the final plat plans, the applicant shall submit a copy of the survey plat in digital format.
