HomeMy WebLinkAboutSD-02-59 - Decision - 0325 0327 Lime Kiln Road# SD-02-59 FINDINGS OF FACT AND DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Final plat application of Farwater, Ltd. to amend a previously approved planned unit development consisting of 85 residential units in four (4) buildings and 88 units of congregate housing in two (2) buildings. The amendment consists of: 1) relocating and reducing in size the pool structure at 325 Lime Kiln Road, and 2) removing the breezeway pool connection at 327 Lime Kiln Road. On the V Of October 2002, the South Burlington Development Review Board approved the request of Farwater, LTD seeking final plat approval under Section 204 of the South Burlington Subdivision Regulations based on the following findings: 1) This project consists of amending a previously approved planned unit development consisting of 85 residential units in four (4) buildings and 88 units of congregate housing in two (2) buildings. The amendment consist of 1) relocating and reducing in size the pool structure at 325 Lime Kiln Road, and 2) removing the breezeway pool connection at 327 Lime Kiln Road. The application was last reviewed by the DRB at their May 7, 2002 meeting. 2) The owner of record is Farwater, LTD. 3) This property lies within the Residential 4 District. The property is bounded on the east by the Belter Farm, on the north and west by the Winooski River, and on the south by a residence and a commercial structure. 4) The only issue affecting this application is coverage. 5) Coverage: The applicant is proposing a front yard coverage along Lime Kiln Road at 12% (maximum allowed is 30%). Building coverage is 11.7% which remains unchanged from previous approval (maximum allowed is 20%). Overall coverage is 17.6% (maximum allowed is 401/o). DECISION AND CONDITIONS Based on the above Findings of Fact, the South Burlington Development Review Board approves final plat application #SD-02-59 of Farwater, Ltd. to amend a previously approved planned unit development consisting of 85 residential units in four (4) buildings and 88 units of congregate housing in two (2) buildings. The amendment consists of: 1) a relocating and reducing in size the pool structure at 325 Lime Kiln Road, and 2) removing the breezeway pool connection at 327 Lime Kiln Road, as depicted on a six (6) page set of plans, page one (1) entitled "Northern Meridian 88 Unit Congregate Care Facility" prepared by DEA dated 8/27/02, with a last revised date of 9/02/02, with the following stipulations: 1) All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2) The plat plan shall be revised to show the changes listed below and shall require approval of the Director of Planning and Zoning (hereinafter Director). Four copies of the approved revised plat plan shall be submitted to the Director prior to recording. a) The plan (sheet 3) shall be revised to show the correct coverage information. 3) Any change to the final plat plans shall require approval by the South Burlington Development Review Board. 4) The final plat plan (sheet 2) shall be recorded in the land records within 90 days or this approval is null and void. You will be bound by the decision, pursuant to 24 V.S.A. § 4472(d) (exclusivity of remedy; finality).
