HomeMy WebLinkAboutSD-03-33 - Decision - 0303 0305 0325 0327 0329 0331 Lime Kiln Roadr #SD-03-33 FINDINGS OF FACT Er DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact, final plat application #SD-03-33 of Lime Kiln Bond Housing Limited Partnership Er Lime Kiln Allocated Housing Limited Partnership to amend a previously approved planned unit development consisting of 85 residential units in four (4) building and 88 units of congregate housing in two (2) buildings. The amendment consists of minor site modifications, 378 Er 380 Lime Kiln Road. On ,June 16, 2003 the South Burlington Development Review Board approved the request of Lime Kiln Bond Housing Limited Partnership Er Lime Kiln Allocated Housing Limited Partnership for final plat approval under Section 15.08 (E) (2) of the Land Development Regulations based on the following findings: 1. This application is for re -approval of an amended plan approved on 7WO2. Re -approval is necessary because the applicant failed to submit the mylar for recording. This project consists of amending a previously approved planned unit development consisting of 85 residential units in four (4) buildings and 88 units of congregate housing in two (2) buildings. The amendment consists of minor site modifications. 2. The owners of record are Lime Kiln Bond Housing Limited Partnership Er Lime Kiln Allocated Housing Limited Partnership. 3. This property located at 378 Er 380 Lime Kiln Road lies within the Residential 4 District. The property is bounded on the east by the Belter Farm, on the north and west by the Winooski River, and on the south by a residential and a commercial structure. 4. The only issues affecting this application are parking, lighting, and coverage. 5. Pam: The parking requirement for lot #4 is 108 spaces. There are 93 parking spaces provided, 8 are handicap accessible spaces. This represents a 15 space of 14% shortfall. The applicant justified this shortfall at the hearing. 6. Coverage: The applicant is proposing 2.9% building coverage (maximum allowed is 20%). Overall coverage is 6% (maximum allowed is 40%). 7. Lim Cut sheets for all lighting should be submitted for approval by the Director of Planning Er Zoning. nFCTST0k1 Based on the above Findings of Fact, the South Burlington Development Review Board approves final plat application #SD-03-33 of Lime Kiln Bond Housing Limited Partnership Er Lime Kiln Allocated Housing Limited Partnership, to amend a previously approved planned unit development consisting of 85 residential units in four (4) buildings and 88 units of congregate housing in two (2) buildings. The amendment consists of minor site modifications, as depicted on a two (2) page set of plans, page one entitled "Housing Vermont Lake Champlain Housing Lime Kiln Apartments", prepared by Provan and Lorber, Inc., dated 1/4/Ol, with a revised date of 3/28%02, with the following stipulations: 1. All previous approvals and stipulations, which are not superseded by this approval, shall remain in effect. 2. The applicant shall submit cut sheets for unit exterior lighting prior to issuance of a Certificate of Occupancy. 3. Any change to the plat plan shall require approval by the South Burlington Development Review Board. 4. The final plat plan (site plan) shall be recorded in the land records within 90 days or this approval is null and void. The plan shall be signed by the Board Chair or Clerk prior to recording. 5. This approval is for non-profit affordable housing usage and if use is changed to fair market value housing, then a new final plat review would be necessary to deal specifically with parking requirements. The fee is $150.00. If you fail to appeal this decision, your right to challenge this decision at some future date may be lost because you waited too long. You will be bound by the decision, pursuant to 24 VSA 4472 (d) (exclusivity of remedy; finality).
