HomeMy WebLinkAboutSP-16-67 - Decision - 0325 0331 Lime Kiln Road#SP-16-67 CITY OF SOUTH BURLINGTON DEPARTMENT OF PLANNING AND ZONING FARWATER, LTD. — 325-331 LIME KILN ROAD SITE PLAN APPLICATION #SP-16-67 FINDINGS OF FACT AND DECISION Farwater, Ltd., hereinafter referred to as the applicant, is seeking after -the -fact approval to amend a previously approved plan consisting of: 1) 150 units of congregate care in four (4) buildings, and 2) 85 residential units in four (4) buildings. The amendment consists of relocating the dumpster enclosure for building "D", 325-331 Lime Kiln Road. Based on the plans and materials contained in the document file for this application, the Administrative Officer finds, concludes, and decides the following: FINDINGS OF FACT & CONCLUSIONS 1. The applicant is seeking after -the -fact approval to amend a previously approved plan consisting of: 1) 150 units of congregate care in four (4) buildings, and 2) 85 residential units in four (4) buildings. The amendment consists of relocating the dumpster enclosure for building "D", 325-331 Lime Kiln Road. 2. The owner of record of the subject property is Farwater, Ltd. 3. The subject property is located in the Residential 4 Zoning District. 4. The application was received on October 3, 2016. 5. The plan submitted is entitled, "Northern Meridian Condominiums Congregate Care Lime Kiln Road, South Burlington, Vermont", prepared DeWolfe Engineering Associates, PC, dated 6/01/05, and last revised on 09/30/16. DIMENSIONAL REQUIREMENTS 6. No changes. SITE PLAN REVIEW STANDARDS Only the standards below are affected by this application. All other standards will continue to be met. (c) AH dumpsters and other facilities to handle solid waste, including compliance with any recycling or other requirements, shall be accessible, secure, and properly screened with opaque fencing to ensure that trash and debris do not escape the enclosure(s), - 1 — #SP-16-67 7. The dumpster enclosure has been relocated from the northerly side of the entrance to the underground parking garage to the southerly side. The dumpster will be screened on all sides by a fence. DECISION Based on the above Findings of Fact, the Administrative Officer hereby approves site plan application #SP-16-67 of Farwater, Ltd., subject to the following conditions: 1. All previous approvals and stipulations which are not superseded by this approval will remain in effect. 2. This project must be completed as shown on the plan and shall be on file in the South Burlington Department of Planning and Zoning. 3. The applicant must obtain a zoning permit within six (6) months pursuant to Section 17.04 of the Land Development Regulations or this approval is null and void. 4. The applicant must obtain a Certificate of Occupancy from the Administrative Officer prior to occupancy or use of the site modification. 5. The amendment consists of: 1) relocating shrubs, 2) converting pool/patio area to parking area for building "D", 3) eliminating previously approved bridge between buildings "A" & "B" and replacing it with steps, and 4) adding 47 optional Arborvitae plants for additional screening, 325-331 Lime Kiln Road. Based on the plans and materials contained in the document file for this application, the Administrative Officer finds, concludes, and decides the following: FINDINGS OF FACT & CONCLUSIONS 1. The applicant is seeking approval to amend a previously approved plan consisting of: 1) 150 units of congregate care in four (4) buildings, and 2) 85 residential units in four (4) buildings. The plans submitted consists of a two (2) page set of plans, page one (1) is entitled, "Northern Meridian Condominiums Congregate Care Lime Kiln Road, South Burlington, Vermont", prepared DeWolfe Engineering Associates, PC, dated 6/01/05, and last revised on 07/22/16. DIMENSIONAL REQUIREMENTS 6. No changes. SITE PLAN REVIEW STANDARDS Only the standards below are affected by this application. All other standards will continue to be met. - 1 — #SP-16-53 Parking 7. A total of seven (7) additional spaces will be added in place of the eliminated pool/patio area. 8. Pursuant to Section 13.01(G) (5) of the Land Development Regulations, bicycle parking shall be provided on the subject property. Bicycle racks are shown on the plan. Landscaping 9. A few shrubs will be relocated to accommodate the stairs connecting buildings "A" & "B" and 47 optional Arborvitae plants will be added for additional screening. OTHER 10. The applicant has indicated in an email dated 8/19/16 that two (2) new areas will be created to provided outdoor space for the residents to make up for the loss of the pool and patio area. 11. New area 1 consists of a park area look off and sitting area, accessed by one of the old quarry roads at the easterly edge of the parking area across from the parking garage entry of building C (329 Lime Kiln). Park benches and sitting boulders will enhance the elevated look off plateau. 12. Additional Area 2 is off the east end of building D (331 Lime Kiln). This additional park area consists of grilling area and multiple picnic benches. 13. Both additional spaces are open and accessible to all Northern Meridian residents. Both areas also have views of Mount Mansfield and the river. DECISION Based on the above Findings of Fact, the Administrative Officer hereby approves site plan application #SP-16-53 of Farwater, Ltd., subject to the following conditions: 1.
