Because of tie construction of the road cqnnection between Laurel rive and Y-2ee",Ve 04 60-f t "i e as part of the required improvements, the lot has becova undersized and without adequate frontage under the Zoning Regulations. Apparently, the Town has never J, formally acquired the right of way for the road connec- tion. I find some indication, in the case law, that in such a situation the Town would be estopped from preventing the use of the lot by the developer for its original purpose. Alternatively, Mr. Yandow, it would seem to me, in connection with the taking of a portion of his land for the road, could seek damages against the Tow,-.L for the value of the lot. if you have any further questions concerning this, please feel free to contact vt,-2. He has 8,450 square feet. Section 6.21, Lot frontage required is 100 feet. He has 55 feet. Lot involved is a corner lot, house will meet all other requirements. House size will be 52' x 26. Some questions regarding lay -out of town road. Deed for lot reads 85 feet frontage. Collin's Appeal Area zoned Business District A. Apartment not allowed under todays ordinance. House not to change on the exterior. Approximately $3,000 to convert interior. Will have a total of four apartments with ten (10) rooms total. Chappel_l's Appeal Area zoned Residence District B. Variance granted June 15, 1966 for construction of flower shop. As to date both old green -houses have been removed. New addition to be an overall of 7210" x 38'6" to the rear of the existing building. Mobil Oil Area zoned Business District A, this area doesn't allow this type of use --service station in existance presently. Old building to be removed. Lot size 160' x 1501.
