HomeMy WebLinkAboutSP-94-0000 - Decision - 0087 Landfill RoadFINDINGS OF FACT & DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact, application of Chittenden Solid Waste District for construction of a recycling drop-off facility consisting of a 170 square foot office building and a 4,692 square foot storage building, 504 Patchen Road. On the loth of May, 1994 the South Burlington Planning Commission approved the request of Chittenden Solid Waste District for site plan review under Section 19.10 of the South Burlington Zoning Reglations based on the following findings: 1. This project consists of constructing a recycling drop-off facility which includes a 170 square foot office building and a 4,692 square foot recycled material storage building. This project was approved on 8/24/93 but the approval expired for failure to obtain a zoning/building permit within six (6) months. The purpose of this application is for reapproval of the same plan approved on 8/24/93 with a 492 square foot increase in the size of the storage building. 2. This faciity will be located in the Municipal District on City owned land at 504 Patchen Road adjacent to the former landfill site and the municipal garage. 3. Access/circulation: Access will be via the existing access driveway from Patchen Road. No changes are proposed to the access. Circulation is adequate. 4. Coverage/setbacks: Building coverage is 2.1% (maximum allowed is 30%). Overall coverage is 11% (maximum allowed is 70%). Setback requirements are met. 5. Landscaping: The minimum landscaping requirement, based on building costs, is $3750. This minimum amount will be met. Plantings will include Summit Ash, Sargent Juniper and Norway Spruce. 6. Parking: There are no minimum parking requirements listed in Table I of the zoning regulations for this type of use. The applicant is proposing 12 parking spaces including (1) handicapped space in addition to some unloading areas. It was staff s position that the parking proposed will be adequate. 7. Sewer: The sewer allocation required for this project is 30 gpd. The applicant will have to pay the per gallon fee prior to 1 permit. 8. Lighting: Exterior lighting will consist of two (2) pole lights 20 feet high each with a 250 watt high pressure sodium lamp with cut-off luminaires and some lights attached to the building. Applicant should provide details of the building lights including number, type of lamp, wattage and locations. DECISION & CONDITIONS Based on the above Findings of Fact, the South Burlington Planning Commission approves the site plan application of Chittenden Solid Waste District for construction of a recycling drop-off facility consisting of a 170 square foot office building and a 4,692 square foot storage building as depicted on a five (5) page set of plans, page one entitled "South Burlington Recycling Facility", prepared by Thermo Consulting Engineers, dated September, 1993 with a stamped "received" date of 5/3/94, with the following stipulations: 1. The applicant shall post a $3,750 landscaping bond prior to issuance of a zoning/building permit. The bond shall remain in effect for three (3) years to assure that the planted landscaping takes root and has a good chance of surviving. 2. Prior to issuance of a zoning/building permit, the applicant shall submit a revised plan showing a 4,692 square foot storage building. 3. All exterior lighting shall be downcasting and shielded and shall not cast light beyond the property line. Prior to issuance of a zoning/building permit, the applicant shall submit to the City Planner all details of the building mounted lights including number, type of lamp, wattage, location of mounting, etc. Any change is existing lighting or new lighting shall be approved by the City Planner prior to installation. 4. The applicant shall obtain a zoning/building permit within six (6) months or this approval is null and void. 5. The applicant shall obtain a Certificate of Occupancy from the Administrative Officer prior to occupancy of the facility. 6.
