HomeMy WebLinkAboutSP-96-0000 - Decision - 0087 Landfill RoadFINDINGS OF FACT & DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact, application of Robert Zimmerman to construct a 96 square foot accessory structure for storage purposes and minor site modifications on a site containing a 170 square foot office builiding and 4692 square foot storage building used as a recycling drop-off facility, 504 Patchen Road. On the 30th day of July, 1996, the South Burlington Planning Commission approved the request of Robert Zimmerman for site plan review under Section 26.10 of the South Burlington Zoning Regulations based on the following findings: 1. This project consists of constructing a 96 square foot accessory structure for storage purposes and minor site modifications on a site containing a 170 square foot office building and a 4,692 square foot storage building used as a recycling drop-off facility. This facility was approved on 5/10/94. The minor modifications include: 1) moving the office building five (5) feet to the west and 2) relocating the oil and land acid battery storage areas so they will be adjacent to the proposed storage shed. 2. This facility is located in the Municipal District on City owned land at 504 Patchen Road adjacent to the former landfill site and the municipal garage. 3. Access/circulation: Access will be via the existing access driveway from Patchen Road. No changes are proposed to the access. Circulation is adequate. 4. Coverage/setbacks: Building coverage is 2.1% (maximum allowed is 30%). Overall coverage is 11% (maximum allowed is 70%). Setback requirements are met. 5. Landscaping: No additional landscaping recommended. The site is currently well landscaped in accordance with the original approval. 6. Parking: No additional parking required. The proposed storage shed, recycled oil storage tank and lead acid battery storage area will be placed in the parking area resulting in the loss of two (2) parking spaces. There are no minimum parking requirements in Table I of the zoning regulations for this type of use. It was staff's position that the remaining ten (10) parking spaces will be adequate. 1 7. Sewer: No additional sewer allocation needed. 8. Lighting: No additional lighting proposed. DECISION & CONDITIONS Based on the above Findings of Fact, the South Burlington Planning Commission approves the site plan application of Robert Zimmerman to construct a 96 square foot accessory structure for storage purposes and minor site modifications on a site containing a 170 square foot office building and 4692 square foot storage building used as a recycling drop-off facility, 504 Patchen Road, as depicted on a plan entitled "South Burlington Landfill Drop Off Facility, Proposed Site Conditions, Chittenden Solid Waste District, South Burlington, Vermont," prepared by Thermo Consulting Engineers, dated 5/26/94, last revised 6/26/96, with the following stipulations: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. The applicant shall obtain a zoning permit within six (6) months pursuant to Section 27.302 of the zoning regulations or this approval is null and void. 3. The applicant shall obtain a Certificate of Occupancy/Compliance from the Administrative Officer prior to occupancy of the new building. 4.
