HomeMy WebLinkAboutBATCH - Supplemental - 0008 Laurel Hill Drive (2)EXHIBIT N CITY of SOUTH BURLINGTON DEPARTMENT of PLANNING AND ZONING VIGNESH SOLAI — 8 LAUREL HILL DRIVE CONDITIONAL USE APPLICATION #CU-04-16 FINDINGS of FACT AND DECISION Vignesh Solai, hereinafter referred to as the applicant, is seeking conditional use approval under Section 14.10, Conditional Use Review, of the South Burlington Land Development Regulations. Request is for permission to allow an accessory residential unit, 8 Laurel Hill Drive. The Development Review Board held a public hearing on January 18, 2005. The applicant was present at the meeting. Based on testimony provided at the above mentioned public hearing and the plans and supporting materials contained in the document file for this application, the Development Review Board finds, concludes, and decides the following: FINDINGS of FACT 1. The applicant is seeking conditional use approval under Section 14.10, Conditional Use Review, of the South Burlington Land Development Regulations. Request is for permission to allow an accessory residential unit, 8 Laurel Hill Drive. 2. The record owner of the subject property is Vignesh Solai. 3. The subject property is located in the Residential 4 (R4) Zoning District. 4. The plans consist of one (1) sheet entitled, "Wastewater Plan Vignesh Solai 8 Laurel Hill Drive South Burlington, VT", prepared by Earthbound Services, dated 11 /19/04. ACCESSORY RESIDENTIAL UNITS Pursuant to Section 3.10(E)(1) of the proposed Land Development Regulations, in any district where a single-family residence is a principal permitted use, one (1) accessory residential unit within or attached to a primary single-family residence may be permitted by the DRB in accordance with Article 14, the Conditional Use criteria and the following additional criteria: (a) With the exception of lots in R1, R2, and SEQ Districts that are one-half (112)acre orgreater in area, occupancy of the accessory residential unit is restricted to not more than two persons, one of whom is either (i) related by blood, marriage, or adoption to the owner of the primary single-family residence, or (ii) is disabled as defined in subdivision 252(2) of Title 18, or (iii) is at least 55 years of age. The applicant shall target a person who meets one of the above -mentioned requirements. - 1 - (b) On lots that are one-half (112) acre or greater in size in the R1, R2 and SEQ districts, occupancy of the accessory residential unit is restricted to not more than two persons and no additional restrictions shall apply. This criterion does not apply to the subject property. (c) Floor space of the accessory residential unit shall not exceed 600 square feet or 30% of the gross floor area of the original dwelling unit, whichever is less. The applicant did not indicate the proposed size of the accessory structure or the existing size of the gross floor area of the original dwelling unit. (d) Maximum occupancy of the accessory residential unit shall be two persons. The maximum occupancy of the accessory residential unit shall be two persons. (e) The principal dwelling shall be owner -occupied. The principal dwelling shall be owner -occupied. (f) No exterior alteration, other than the entranceways and other alterations required by the Vermont building code are made to the principal dwelling. The applicant did not indicate that any alterations were being made to the existing dwelling unit. (g) No exterior entrance or other alterations shall be made to the front of the original dwelling. The front of the existing dwelling will remain unchanged. (h) Public water and sewer shall be provided to all residences on the lot. The applicant has wastewater allocation approval from the Director of Planning and Zoning. The existing dwelling unit is currently served by municipal water. (i) No home occupation shall be conducted in an occupied accessory apartment. No home occupation shall be conducted in an occupied accessory apartment. (j) One additional off-street parking space shall be provided on the same lot. The existing dwelling unit has a two -car garage and a paved driveway, which is sufficient to satisfy this requirement. (k) A zoning permit shall be required for each accessory apartment. Prior to constructing the accessory apartment, the applicant shall obtain a zoning permit from the Administrative Officer. WM CONDITIONAL USE CRITERIA 1. The proposed use, in its location and operation, shall be consistent with the planned character of the area as defined by the City of South Burlington Comprehensive Plan. According to the South Burlington Comprehensive Plan, residential neighborhoods should be protected from incompatible commercial encroachment and traffic adherence. In addition, the Plan states that the City should consider increasing the residential densities in areas that are planned for residential use. The proposed accessory residential unit will be consistent with the plan character of the area, as defined by the Comprehensive Plan. 2. The proposed use shall conform to the stated purpose of the district in which the proposed use is to be located. According to Section 4.03(A) of the South Burlington Land Development Regulations, the Residential 4 District is hereby formed in order to encourage residential use at moderate densitieS that are cnmpatib/e —;4vvoLlo CX1Sting neighborhoods and undeveloped land adjacent to those neighborhoods. Any use not expressly permitted is prohibited, except those that are allowed as conditional uses. The proposed accessory residential unit conforms to the stated purpose of the R4 District. 3. The DRB must find that the proposed uses will not adversely affect the following: (a) The capacity of existing or planned municipal or educational facilities. Educational facilities will not be affected, as the accessory apartment will be occupied by no more than two individuals. In addition, the accessory apartment will not adversely affect other municipal services. (b) The essential character of the neighborhood or district in which the property is located, nor ability to develop adjacent property for appropriate uses. The proposal is in keeping with residential uses on surrounding properties and will not adversely affect the character of the area or the ability to develop adjacent properties. (c) Traffic on roads and highways in the vicinity. The addition of one or two residents will have negligible affects on traffic in the vicinity. (d) Bylaws in effect. -3- The proposal is in keeping with regulations, provided the applicant obtains water and sewer allocation. (e) Utilization of renewable energy resources. The proposal will not affect renewable energy resources. (0 General public health and welfare The proposed accessory apartment will not have an adverse affect on general public welfare. All previous approvals and stipulations shall remain in full effect, except as amended herein. 2. This project shall be completed as shown on the plans submitted by the applican+ as amended by thig clec!s,nn, and on file in the South Burlington Department of Planning and Zoning. 3. The applicant shall submit documentation indicating the proposed size of the accessory structure and the existing size of the gross floor area of the original dwelling unit, prior to permit issuance. 4. The maximum occupancy of the accessory residential unit shall be two persons 5. The principal dwelling shall be owner -occupied. 6. No home occupation shall be conducted in an occupied accessory apartment. 7. Pursuant to Section 17.04(B) of the South Burlington Land Development Regulations, the applicant shall obtain a zoning permit within six (6) months of this decision. Were you living in the smaller unit or in the main house? Is the owner living there and if so in which apartment? Lead paint issues are regulated by the Vermont Heath Dept. Martin Jr. I have lived at 8 Laurel Hill Dr. South Burlington Vt 05403 for the last 4 years. I have rented this apartment from Vignesh Solai ( phone 1-734-717-1700 ) under ( Preston property management ). About 2 years ago I learned that the apartment I lived in had lead paint hazards. The building was built in 1904. The last two years there has been many construction projects started and not finished. The trim boards on most of the windows on the inside of the house was removed and left for months never finished. The paint dust was all over the floor and construction on the outside was so bad with dust my air conditioners shut down; one needed to be replaced. About a year ago I knew I needed to leave this house because of risk to my health, my son Ryan and my girl friend Pam and our granddaughter Kaylee that visits on the weekend. We were getting sick often and did not know why; we thought it may have been the mold in the basement. It is always wet down there and all the furniture we stored in the basement got molded bad like there was moss on them. There was suppose to be a painter come in to fix these issues but never happened. I have since moved to Colchester 12/5/10. I would like to see someone enforce the law to see that this house is fixed properly so the next tenants stay healthy. Besides this issue I found out I have been paying for the hot water for the other tenants apartment for the last 4 years. Now Vignesh is trying to settle this issue by offering me $10.00 a month and then claiming I was there for only 33 months. I was told that this house is only zoned for 1 apartment not 2, Vignesh Solai has been renting it out for the last 4 years maybe someone in zoning could stop by and take a look to see if he is compliant. I was told by an appraiser and a Realtor that this dwelling is not a two apartment building. I was also wondering if there was a place we could get tested for lead poisoning. Please Help, John K. On 1/18/05, the Development Review Board granted approval for a conditional use to allow an accessory residential unit at 8 Laurel Hill Drive (see exhibit A). This decision included condition #5 which states "The principal dwelling shall be owner -occupied". 2. On December 27, 2010 the Administrative Officer received an email from John Martin who indicated that he had been living in the main house at 8 Laurel Hill Drive for the past four (4) years (see exhibit B) but recently moved out the house. 3. The Administrative Officer on December 28, 2010, issued Notices of Violation #NV-10-12 and #NV-10-12A to the Appellants (see exhibits C & D) informing them that they had commenced land development on the subject property without a zoning permit and were in violation of the Development Review Board's decision dated 1/18/05 which required them to occupy the principal dwelling at 8 Laurel Hill Drive. 4. The Appellants filed Notices of Appeal #AO-11-01 and #AO-11-02 (see exhibits E & F) appealing the Notices of Violation. 5. A public hearing notice that a hearing on the appeals would take place on February 15, 2011 was published in The Other Paper on 1/27/11 (see exhibit G). 6. The City's Grand List shows the Appellants mailing address as P.O. Box 549, Malden MA 02148 (see exhibit H). 7. A letter addressed to the Appellants and mailed on August 25, 2010, to the 8 Laurel Hill Dr. address was returned (see exhibit 1). 8. A letter addressed to the Appellants and mailed on September 27, 2010, to the 8 Laurel Hill Dr. address was returned (see exhibit J). 9. The Appellants paid for the Notices of Appeal fees with two (2) checks with the address listed as "99 Florence St. Apt. 714, Malden, MA 02148" (see exhibit K). 10. Based on facts referenced in paragraphs 6-9, above, Appellants reside in Massachusetts. At the hearing, the Appellants admitted that they reside not at 8 Laurel Hill Drive, but instead reside in Massachusetts. 11. The Appellants submitted an application for and were issued Zoning Permit #ZP- 11-10 on 1/10/11 to eliminate the accessory residential unit (see exhibit L). CONCLUSIONS OF 1. The facts listed above clearly indicate that the Appellants do not reside in the principal dwelling at 8 Laurel Hill Drive, thereby violating condition,#5 of their 1/18/05 Development Review Board decision requiring them to do'so. 2. As a result, Appellants commenced land development without a zoning permit, in violation of Section 17.02 of the Land Development Regulations and 24 V.S.A. section 4449(a)(1). 3. When Appellants demonstratethat they have complied with the zoning permit issued on 1/10/11 and eliminated the: accessory residential unit, the violations listed in the notice of violation will end. Associate Planner Brian Robertson, referred to herein as staff, has reviewed the Site Plan submitted on December 3, 2004, and has the following comments. ACCESSORY RESIDENTIAL UNITS Pursuant to Section 3.10(E)(1) of the proposed Land Development Regulations, in any district where a single-family residence is a principal permitted use, one (1) accessory residential unit within or attached to a primary single-family residence may be permitted by the DRB in accordance with Article 14, the Conditional Use criteria and the following additional criteria: (a) With the exception of lots in R1, R2, and SEQ Districts that are one-half (112) acre or greater in area, occupancy of the accessory residential unit is restricted to not more than two persons, one of whom is either (i) related by blood, marriage, or adoption to the owner of the primary single-family residence, or (H) is disabled as defined in subdivision 252(2) of Title 18, or (iii) is at least 55 years of age. 1. The applicant shall target a person who meets one of the above -mentioned requirements. (b) On lots that are one-half (112) acre or greater in size in the R1, R2 and SEQ districts, occupancy of the accessory residential unit is restricted to not more than two persons and no additional restrictions shall apply. This criterion does not apply to the subject property. (c) Floor space of the accessory residential unit shall not exceed 600 square feet or 30% of the gross floor area of the original dwelling unit, whichever is less. The applicant did not indicate the proposed size of the accessory structure or the existing size of the gross floor area of the original dwelling unit. 2. The applicant shall submit documentation indicating the proposed size of the accessory structure and the existing size of the gross floor area of the original dwelling unit, prior to conditional use approval. (d) Maximum occupancy of the accessory residential unit shall be two persons. 3. The maximum occupancy of the accessory residential unit shall be two persons. (e) The principal dwelling shall be owner -occupied. 4. The principal dwelling shall be owner -occupied. The applicant did not indicate that any alterations were being made to the existing dwelling unit. (g) No exterior entrance or other alterations shall be made to the front of the original dwelling. The front of the existing dwelling will remain unchanged. (h) Public water and sewer shall be provided to all residences on the lot. The applicant has wastewater allocation approval from the Director of Planning and Zoning (attached). The existing dwelling unit is currently served by municipal water. (i) No home occupation shall be conducted in an occupied accessory apartment. 5. No ,home occupation shall be conductedin an occupied accessorl apartment. Q) One additional off-street parking space shall be provided on the same lot. The existing dwelling unit has a two -car garage and a paved driveway, which is sufficient to satisfy this requirement. (k) A zoning permit shall be required for each accessory apartment. Prior to constructing the accessory apartment, the applicant shall obtain a zoning permit from the Administrative Officer. CONDITIONAL USE CRITERIA 1. The proposed use, in its location and operation, shall be consistent with the planned character of the area as defined by the City of South Burlington Comprehensive Plan. According to the South Burlington Comprehensive Plan, residential neighborhoods should be protected from incompatible commercial encroachment and traffic adherence. In addition, the Plan states that the City should consider increasing the residential densities in areas that are planned for residential use. The proposed accessory residential unit will be consistent with the plan character of the area, as defined by the Comprehensive Plan. 2. The proposed use shall conform to the stated purpose of the district in which the proposed use is to be located. According to Section 4.03(A) of the South Burlington Land Development Regulations, the Residential 4 District is hereby formed in order to encourage residential use at moderate densities that are compatible with existing neighborhoods and undeveloped land adjacent to those neighborhoods. Any use not expressly permitted is prohibited, except those that are allowed as conditional uses. No Text Design Qualification This plan depicts the wastewater and water supply system as built, as best as could be determined. This plan is not a design of the sewer or water lines or service connections. This plan and related materials are intended for the VT ANR and City of South Burlington permitting process. Location of the water service line and water main were determined by the locating services of the Champlain Water District. Location of the sewer service line was determined by the locating services of P&P Septic. Location of the sewer main was determined from information made available from the City of South Burlington Department of Public Works (DPW). GENERAL 1. This permit does not relieve the permittee from obtaining all other approvals and permits as may be required from the Act 250 District Environmental Commission, the Department of Environmental Conservation, Water Supply Division — telephone (802) 241-3400, Water Quality Division — telephone (802) 241-3770, the Department of Labor & Industry — telephone (802) 828-2106 or (802) 879-2300, the Department of Health — telephone (802) 863-7221, and local officials prior to proceeding with this project. 2. The project shall be completed as shown on the following plans prepared by Dean Grover which have been stamped "approved" by the Wastewater Management Division: Project 40425: Sheet 1 of 1 "Wastewater Plan" dated 11/17/04. 3. The project shall not deviate from the approved plans in a manner that would change or affect the exterior water supply or wastewater disposal systems, building location or the approved use of the building, without prior review and written approval from the Wastewater Management Division. 4. The conditions of this permit shall run with the land and will be binding upon and enforceable against the permittee and all assigns and successors in interest. The permittee shall be responsible for the recording of this permit in the South Burlington Land Records within thirty, (30) days of issuance of this permit and prior to the conveyance of any lot subject to the jurisdiction of this permit. 5. The Wastewater Management Division now reviews the water and wastewater disposal systems under 10 V.S.A., Chapter 64 — Potable Water Supply and Wastewater System Permit. 6. By acceptance of this permit, the permittee agrees to allow representatives of the State of Vermont access to the property covered by the permit, at reasonable times, for the Wastewater System and Potable Water Supply Permit WW-4-2296 Vignesh Solai Page 2 purpose of ascertaining compliance with the Vermont environmental and health statutes and regulations. 7. A copy of the approved plans and this permit shall remain on the project during all phases of construction, and upon request, shall be made available for inspection by State or local personnel. The Division has relied solely upon the licensed designers certification that the design - related information submitted was true and correct, and complies with the Vermont Wastewater System and Potable Water Supply Rules and the Vermont Water Supply Rules. WATER SUPPLY & WASTEWATER DISPOSAL 9. This permit issued by the Secretary is valid for a substantially completed potable water supply and wastewater system based upon a certification from a designer that states: "I hereby certify that, in the exercise of my reasonable professional judgment, the installation -related information submitted is true and correct and the potable water supply and wastewater system were installed in accordance with the design." 10. The project is approved for water supply by connection to the municipal water system as depicted on the approved plans. The Wastewater Management Division shall allow no other method, or location of obtaining potable water without prior review and approval. 11. The project is approved for wastewater disposal by connection to the municipal wastewater treatment facility as depicted on the approved plans.
