HomeMy WebLinkAboutMS-01-05 - Decision - 0038 Knoll Circle#MS-01-05 FINDINGS OF FACT & DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact, application #MS-oi-o5 of David and Heather Main seeking approval from Section 25.117, Alteration of Existing Grade, of the South Burlington Zoning Regulations. Request is for permission to place 84 cubic yards of fill on property at 38 Knoll Circle. On the 18th day of September zoos, the South Burlington Development Review Board approved alteration of existing grade for David & Heather Main under Section 25.117 of the South Burlington Zoning Regulations based on the following findings: i. The owners of record of this property are David & Heather Main. z. This project consists of adding 84 cubic yards of fill and construction of retaining walls at the rear of the property. 3. This property located at 38 Knoll Circle at 38 Knoll Circle lies within the Southeast Quadrant District. It is bounded by residences on the north and south, by Knoll Circle on the west, and by undeveloped land on the east. 4. No issues. DECISION & CONDIONS Based on the above Findings of Fact, the South Burlington Development Review Board approves application #MS-oi-o5 of David and Heather Main seeking approval from Section :*117, Alteration of Existing Grade, of the South Burlington Zoning Regulations. Request is for permission to place 84 cubic yards of fill on property at 38 Knoll Circle, as depicted on a plan entitled. "Heather & David Main 38 Knoll Circle South Burlington, VT 05403", dated 9/4/oi, with the following stipulations: i. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. z. The applicant shall obtain a zoning permit within six (6) months pursuant to Section 27.302 of the zoning regulations or this approval is null and void. 3. The applicant shall obtain a Certificate of Occupancy/Compliance from the Administrative Officer prior to the use of the fill. 4. Any change to the site plan shall require approval by the South Burlington Development Review Board.
