The landowner shall be responsible for the recording of this permit in the South Burlington Land Records within thirty, (3o) days of issuance of this permit and prior to the conveyance of any lot subject to the jurisdiction of this permit. 1.5 Each prospective purchaser of the lot shall be shown copies of the Wastewater System And Potable Water Supply Permit and the stamped plans prior to conveyance of the lot. This permit may be revoked if it is determined that the project does not comply with these Rules. 1.8 Any person aggrieved by this permit may appeal to the Environmental Court within 3o days of the date of issuance of this permit in accordance with 10 V.S.A. Chapter 22o and the Vermont Rules of Environmental Court Proceedings. 2.WATER SUPPLY 2.1 No permit issued by the Secretary shall remain valid after substantial completion of a potable water supply until the Secretary receives a signed and dated certification from a designer or an installer, as specified in the permit, that states: 1 hereby certify that in the exercise of my reasonable professional judgment the installation - related information submitted is true and correct and the potable water supply was installed in accordance with: the permitted design and all permit conditions; or record drawings and such record drawings are in compliance with the applicable rules, were filed with the Secretary, and are in accordance with all other permit conditions; was inspected; was properly tested; and has successfully met those performance tests." This certification shall include the water service. Compliance with this condition is required prior to activating the water spigot. 2.2 This project is approved for connection to the South Burlington municipal water system as depicted on the stamped plans. No changes to the water supply shall be allowed without prior review and approval by the Wastewater Management Division. 2.3 The connection of a water spigot to the municipal supply system shall require the installation and maintenance of back -flow prevention devices which conform to the standards acceptable to the Department of Labor & Industry. Site Plan Application #SP-10-41 of City of South Burlington for a 2.15 acre municipal dog park to include a gravel parking lot, 265, 285, 287 Kirby Road: Mr. Nedde showed an ortho photo plan from from 2004. He indicated the houses which no longer exist. He also noted that all the homes on Picard Circle are vacant. There is a ravine to the back (south) of the property and tree lines forming other borders. The Airport has given permission to remove some brush. Mr. Nedde then indicated where there will be graveled parking spaces (a total of 22) and room for snow storage and a graveled walkway. There will also be a "yard hydrant" for water for the dogs. The dog park will consist of an area for large dogs (1.9 acres) and one for smaller dogs (4200 sq. ft.) The entrance area will be an isolated 10'x10' pad, so the dogs can't get out on their own. There will be no lighting in the park, but there are some picnic tables proposed. All fencing will be vinyl coated (probably green) with galvanized posts. Fencing will be 5 feet tall. v4r. Stuono asked if the park will be open to non -South Burlington residents. Mr. Hubbard said t will. o other issues were raised. Conditional Use Application #CU-10-07 of Kathleen & Thomas Easton to: 1) reconstruct a single family dwelling and increase its footprint by 50%, and 2) allow the height of the reconstructed structure to exceed the 25-foot height limit by 9.4 feet for a total height of 34.4 feet,101 Holmes Road: Mr. Marshall located the property off the private part of Holmes Road. He indicated the existing house. He noted that the property fronts on the Lake, and there are some Class 3 wetlands on the property. Some site improvements are proposed. Landscaping has been created to take advantage of the new potential for sunlight. There will also be an improved wildlife habitat potential. Mr. Marshall gave members photos of buildings in the vicinity and a rendering of the proposed building. He also provided a "shadow study" which he said shows no impact on nearby homes. A portion of this property is in the 100-year flood plain. FEMA maps show it out of the flood plain, but city maps do not. There is a pending "Letter of Map Amendment" (LOMA), and the Board cannot make a decision until that is received. Zoning District & Dimensional Requirements: There are no changes to the dimensional requirements as part of this application. No new structures are proposed. SITE PLAN REVIEW STANDARDS Section 14.06 of the South Burlington Land Development Regulations establishes the following general review standards for all site plan applications: (a) The site shall be planned to accomplish a desirable transition from structure to site, from structure to structure, and to provide for adequate planting, safe pedestrian movement, and adequate parking areas. No buildings are being proposed as part of this application. However staff finds that this criterion is being met on the site. There are no minimum requirements for parking for public parks; however, based on experiences and other similar parks, Staff finds the proposed number of spaces (22, including two marked handicapped accessible spaces) to be adequate. (b) Without restricting the permissible limits of the applicable zoning district, the height and scale of each building shall be compatible with its site and existing or adjoining buildings. No buildings are being proposed as part of this application. (c) Newly installed utility services and service modifications necessitated by exterior alterations or building expansions shall, to the extent feasible, be underground. No new utility services are expected. (d) The DRB shall encourage the use of a combination of common materials and architectural characteristics, landscaping, buffers, screens and visual interruptions to create attractive transitions between buildings of different architectural styles. No buildings are being proposed as part of this application. The applicant is proposing a 5""*train link fence to surround the property. (e) Proposed structures shall be related harmoniously to themselves, the terrain, and to existing buildings and roads in the vicinity that have a visual relationship to the proposed structures. CITY OF SOUTH BURLINGTON 3 DEVELOPMENT REVIEW BOARD No buildings are being proposed as part of this application. DEPARTMENT OF PLANNING & ZONING Site plan applications shall meet the following specific standards as set forth in Section 14.07 of the South Burlington Land Development Regulations: (a) The reservation of land may be required on any lot for provision of access to abutting properties whenever such access is deemed necessary to reduce curb cuts onto an arterial of collector street, to provide additional access for emergency or other purposes, or to improve general access and circulation in the area. At this time, staff does not suggest providing additional accesses. (b) Electric, telephone and other wire -served utility lines and service connections shall be underground. Any utility installations remaining above ground shall be located so as to have a harmonious relation to neighboring properties and to the site. Pursuant to Section 15.13(E) of the Land Development Regulations, any new utility lines, services, and service modifications shall be underground. (c) All dumpsters and other facilities to handle solid waste, including compliance with any recycling or other requirements, shall be accessible, secure and properly screened with opaque fencing to ensure that trash and debris do not escape the enclosure(s). There are no changes proposed with respect to trash facilities. (d) Landscaping and Screening Requirements As there is no building construction proposed for this site, there are no minimum landscaping requirements. Lighting No lighting is proposed for the park. The Burlington Airport is leasing property to the City of South Burlington at the east end of Kirby Road for the Dog Park. The property is relatively flat with the north and easterly portions being an open field while the south west corner is mature woods. The airport has granted permission to clear out brush as well as head -high limbs to accommodate the Dog Park. The perimeter fence is 5' high vinyl coated with wire supports on top and bottom with galvanized posts. We have worked with Justin Rabidoux, Public Works Director, in design of the turnaround at the end of Kirby Road. South Burlington Water Department will be installing a yard hydrant to provide a water source for the project. We anticipate the project being constructed this summer.
