MOTION OF APPROVAL
NORMAN & JEAN PARROW
I move the South Burlington Planning Commission approve the final
plat application of Norman and Jean Parrow to subdivide a 42,904
square foot parcel into two (2) parcels of 21,452 square feet each,
285 Kirby Road, as depicted on a plan entitled, "Property Plan
Norman & Jean Parrow Kirby Road South Burlington Vermont," prepared
by William A. Robenstein, dated 9/15/97, with the following
stipulations:
1. All previous approvals and stipulations which are not
superseded by this approval shall remain in effect.
2. The Planning Commission approves a sewer allocation of 480 gpd
(includes 20% reduction allowed by State). The applicant shall be
required to pay the per gallon fee prior to permit issuance.
3. The plat plan shall be revised to show the change listed below
and shall require approval of the City Planner. Three (3) copies
of the approved revised plat plan shall be submitted to the City
Planner prior to recording:
a) The final plat plan shall be revised to show a water
easement where the proposed line crosses the northeast corner
of lot #1.
4. The sewer connection to the 18 inch main, which is concrete
pipe, shall be made with a manufactured fitting.
5) Any changes to the final plat plan shall require approval of
the South Burlington Plannina Commission.
6) The final plat plan shall be recorded in the land records
within 90 days or this approval is null and void. The plan shall
be signed by the Planning Commission Chair or Clerk prior to
recording. Prior to recording the final plat plan, the applicant
shall submit a copy of the survey plat in digital format. The
format of the digital information shall require approval of the
City Planner.

This project, consisting of creating a two lot subdivision with Lot #1 0.49 acres containing an
existing three bedroom duplex approved in Water Supply and Wastewater Disr csal Permit 1xTNAT-4--
1149 and Lot #2 being 0.49 acres proposed for a four bedroom single family residence located off
Kirby Road in the city of South Burlington , Vermont is hereby approved under the requirements of
the regulations named above, subject to the following conditions.
GENERAL
The project shall be completed as shown on the plans Project 97646-1, Sheet 1 of 1 "Site
Plan" dated 12-5-97 prepared by Willis Design Associates, Inc. and which have been stamped
"approved" by the Wastewater Management Division. The project shall not deviate from the
approved plans without prior written approval from the Wastewater Management Division.
2. Each prospective purchaser of each lot shall be shown a copy of the approved plot plan and
this Subdivision Permit prior to conveyance of the lot.
The conditions of this permit shall run with the land and will be binding upon and enforceable
against the permittee and all assigns and successors in interest. The permittee shall be
responsible for the recording of this permit and the "Notice of Permit Recording" in the city
of South Burlington Land Records within 30 days of issuance of this permit and prior to the
conveyance of any lot subject to the jurisdiction of this permit.
4. By acceptance of this permit, the permittee agrees to allow representatives of the State of
Vermont access to the property covered by the permit, at reasonable times, for the purpose
of ascertaining compliance with Vermont environmental/health statutes and regulations, with
this permit.
This permit is issued in conjunction with Water Supply & Wastewater Disposal Permit #WW-
4-1149 for the existing three bedroom duplex located on Lot #1. All conditions set forth in
Permit #WW-4-1149 shall remain in effect except as modified or amended herein.

6. This project has been reviewed and is approved for the construction of one four bedroom
single family residence on the approved Lot #2. Construction of other type of building or
dwellings, including public buildings, commercial buildings, duplexes, and condominium
units, is not allowed without prior review and approval by the Wastewater Management
Division and such approval will not be granted unless the proposal conforms to the applicable
laws and regulations.
WATER SUPPLY
7. Each lot is approved for water supply by connection to the municipal water system depicted
on the approved plan. No other means of obtaining potable water shall be allowed without
prior review and approval by the Wastewater Management Division.
SEWAGE DISPOSAL
8. The project is approved for connection to the South Burlington wastewater treatment
facility for a maximum of 930 gallons of sewage per day (480 gallons per day for the single
family residence and 450 gallons per day for the duplex).
9. Each lot is approved for wastewater disposal by connection to the South Burlington
municipal sewer system. No other method of wastewater disposal shall be allowed without
prior review and approval by the Wastewater Management Division, and such approval will
not be granted unless the proposal conforms to the applicable laws and regulations.

The South Burlington Planning Commission a held a meeting on
Tuesday, 21 October 1997, at 7:30 pm, in the Conference Room,
City Hall, 575 Dorset St.

3. Continued Site Plan Application of Wolfstein Architecture to
amend a previously approved plan for a 13,752 sq. ft. standard
restaurant and indoor recreation facility with a total of 250
seats. The amendment consists of 1) adding 40 seats, 2) revising
the parking layout, and 3) constructing 2 additions of 270 sq.
ft. total, 1234 Williston Road:
Mr. O'Rourke stepped down due to a conflict of interest.
Mr. Carroll explained that the plan is in conformance with all
coverage and setback regulations. The increase in square footage
is with infill between the two buildings. They will add land-
scaping as required and will also smooth the traffic flow. The
additional seats were previously approved by the Commission and
were then dropped from the plan.
There have been negotiations with 8-10 White St. regarding an
easement. Mr. Carroll believed there has now been an agreement.
Mr. Weith noted the plan would add 9 more trip ends. This lot is
already above the 46 allowed by the traffic overlay. The total
would now be 66. The Commission can only approve this number if
certain improvements result in better traffic flow in the
vicinity. Mr. Weith said the two improvements being put forth
to meet this requirement are the fence along the back of the
property to limit traffic flow between lots to designated points
and the allowing of future access between two properties.
Mr. Carroll said there is also a net gain in parking from 99 to
109 spaces. Spaces will be more clearly defined.
Mr. Smith noted the proposed easement will be through all travel
lanes of the parking lot. 8-10 White St. is giving them the
ability to travel along the driveway.

2) NORMAN & JEAN PARROW - 2 LOT SUBDIVISION - FINAL PLAT
This project consists subdividing a 42,904 square foot lot into two
(2) lots of 21,452 square feet each. Lot #1 is currently developed
with a single family dwelling. Lot #2 will not have any frontage
on a public street, and therefore is a major subdivision. The
preliminary plat was approved on 9/9/97 (minutes enclosed).
This property located at 285 Kirby Road lies within the R4
District. It is bounded on the east by the airport, on the south
by undeveloped land, on the west by a single family dwelling, and
on the north by Kirby Road.
Access/circulation: Access to lot #1 is provided by an existing
curb cut on Kirby Road. Lot #2 is proposed to be served by a curb
cut on Kirby Road east of the existing curb with a 20 foot r.o.w.
across lot #1.
Lot size/frontage: Both lots meet the minimum lot size requirement
of 9500 square feet.
Lot #1 meets the minimum frontage requirement of 80 feet. Lot #2
has no frontage on a public street and will be served by a 20 foot
r.o.w.
Sewer: The sewer allocation requested is 480 gpd (includes 20%
reduction allowed by State). The applicant will be required to pay
the per gallon fee prior to permit issuance.
Impact fees: The applicant was made aware that the new dwelling
will be subject to road, school and recreation impact fees.

Mr. Parrow noted that his in-laws are gifting a portion of their
land.
Mr. Burgess noted that the Fire Department is concerned with
access to the back lot if the drive is blocked with cars or snow.
Mr. Parrow said there is a turnaround provided. Mr. Weith said
he will have to check to be sure it is adequate. He added that
he felt it was asking a lot for a situation such as this. Mr.
Teeson said if there is a standard that's worked historically, it
should be used or a new standard developed.
Mr. Crow moved the Planning Commission_ a prove the prelimi"nary

isting 89 room hotel & 225 seat restaurant facility, 1 Dorset
Street. The expansion consists of adding 71 hotel rooms for a
total of 160 rooms. This application will be treated as a
planned unit development:
Mr. Rabideau reviewed changes addressed since sketch plan review:
They had originally proposed a 6-story building with the existing
building to remain. There had been traffic and setback issues,
so they now propose two 4-story buildings further back on the
site. There would be a total of 160 hotel rooms. He showed the
Commission pictures of what the buildings could possibly look
like.
They will be asking for 45 ft. in height as the buildings will
have pitched roofs.
The existing buildings will have facades completely reworked to
make this an upscale property.
Talks with Friendly's have failed to reach any agreement for
major changes to the parking lot, so they cannot affect a re-
duction in front yard coverage as hoped. Mr. Burgess noted that
there is 3 times the allowable coverage on Williston Rd.
Mr. Weith asked if Friendly's has an easement for parking in the
right-of-way. Mr. Rabideau didn't think so.
Mr. Rabideau said they will provide a wider sidewalk in back of
the project as requested by the Fire Department. They also pro-
pose to add plantings along the I-89 right-of-way.

District. It is bounded on the east by the airport, on the south
by undeveloped land, on the west by a single family dwelling, and
on the north by Kirby Road.
Access/circulation: Access to lot #1 is provided by an existing
curb cut on Kirby Road. Lot #2 is proposed to be served by a curb
cut on Kirby Road east of the existing curb with a 20 foot
r.o.w.across lot #1.
Lot size/frontage: Both lots meet the minimum lot size requirement
of 9500 square feet.
Lot #1 meets the minimum frontage requirement of 80 feet. Lot #2

lobby/drop-off area. The sketch plan was reviewed on 5/13/97
(minutes enclosed).
This property located at 1 Dorset Street lies within the Cl and
C.O. Districts. It is bounded on the north by Williston Road, on
the west by the I-89 ramp, on the east by Dorset Street, and on the
south by U-Mall.
Access/circulation: Access is provided by two (2) curb cuts on
Dorset Street. No changes proposed. Pedestrian connections to U-
Mall should be provided. Applicant is proposing a vehicular access
to the U-Mall property. The U-Mall plans would have to be amended
to show this access and a mutual access agreement recorded between
U-Mall and the applicant.
Coverage/setbacks: Building coverage is 18.3% (maximum allowed is
30%). Overall coverage is 69.6% (maximum allowed is 70%). Front
yard coverage along Dorset Street is being reduced from 60% to 58.2
% and along Williston Road is being reduced from 73.1% to 21.2%
(maximum allowed is 30%).

I move the South Burlington Planning Commission approve the
preliminary plat application of Norman and Jean Parrow to subdivide
a 42,904 square foot parcel into two (2) parcels of 21,452 square
feet each, 285 Kirby Road, as depicted on a plan entitled "Property
Plan Norman & Jean Parrow Kirby Road South Burlington Vermont,"
prepared by William A. Robenstein, dated 9/2/97, with the following
stipulations:
1. All previous approvals and stipulations which are not
superseded by this approval shall remain in effect.
2. The plat shall be revised prior to final plat submittal as
follows:
a) The plat shall be revised to clearly indicate that the
easterly property line is the boundary between the Airport
District to the east and R4 District to the west.
b) The plat shall be revised to indicate the size of existing
and proposed water and sewer lines.
c) The plat shall be revised to use different line symbols
for the property lines and setback lines.
3. The Planning Commission approves a sewer allocation of 480 gpd

Mr. Parrow said the Planning Commission staff was unhappy with the measurements shown on
his sketch and they would like to see where the sewer lines came in to the property.
Mr. Weith instructed them to have that information on their preliminary plat.
There were no other issues.
Mr. Burgess stated that if they have all information on their preliminary plat, approval should be
granted. '
8) Site plan application of Twin Oaks Sports and Fitness to amend a previously approved site
plan for an 11,000 square foot building for day care/indoor recreation use. The amendment
consists of: 1) relocating the outside playground from the rear of the building to the front of the
building, and 2) relocating a parking area from the front of the building to the rear of the building,
80 Farrell Street.
Darrell Campbell said that Twin Oaks proposed to move the play center to the front of the
building and the parking lot to the rear. There would be no changes to coverage or setback
landscaping except for 2 trees that would need to be removed and would be replaced. One
parking space would be added, changing from 29 to 30 spaces. There would be no changes to
sewer, traffic, or lighting. A dumpster currently located in the rear would move to the other side
of its current location.
Mr. O'Rourke asked what the hours of operation were for the play area.
Mr. Campbell replied that the hours vary seasonally, but the majority from September to June is
7:00 a.m. to 5:30 p.m. They are not always in use during that time. Organized activity runs from
9:00 a.m. to 4:30 p.m. 5 days a week.
Mr. O'Rourke asked where the adjoining residential properties were located.
Mr. Campbell replied that they were located along the back of the property, with one house
across the street, and on the path to Rice High School.
Mr. Beaudin thought that Mr. Holcomb had concerns about noise.

The South Burlington Planning Commission will hold a public hearing
at the South Burlington City Hall, Conference Room, 575 Dorset
Street, South Burlington, Vermont on September 9, 1997 at 7:30 P.M.
to consider the following:
1) Preliminary plat application to subdivide a 1.32 acre parcel
into four (4) parcels of 17,766 square feet, 15,680 square feet,
12,000 square feet and 12,000 square feet, 380 White Street.
2) Preliminary plat application of Norman and Jean Parrow to

Access/circulation: Access is provided by two (2) curb cuts on Bay
Crest Road. No changes proposed. A previous approval required
that a chain/gate be installed across the access driveway along the
northerly boundary. This chain/gate has yet to be installed.
Circulation on the site is adequate.
Coverage/setbacks: Building coverage is 19.5% (maximum allowed is
20%). Overall coverage is 39.9% (maximum allowed is 40%). The
plan notes should be revised to reflect these coverages.
The PUD perimeter setback requirement is 50 feet. The Commission
previously approved a 30 foot PUD perimeter setback. The applicant
is seeking a modification under Section 8.404 of the zoning
regulations to further reduce the setback behind duplex #3 to 25
feet. The applicant has constructed a deck at the rear of this
unit which projects five (5) feet into the 30 foot setback.
Staff recommends that the modification not be granted. It sets a
bad precedent. The applicant was fully aware of the P.U.D. setback
requirement when originally approved. Also, this is a relatively
dense development abutting a park and therefore the 30 foot setback
should be respected.
Landscaping: No additional landscaping required based on building
costs.
7) NORMAN & JEAN PARROW - 2 LOT SUBDIVISION - SKETCH PLAN
This project consists subdividing a 43,560 square foot lot into two
(2) lots of 21,780 square feet each. Lot #1 is currently developed
with a single family dwelling. Lot #2 will not have any frontage
on a public street so this subdivision is a major subdivision.
This property located at 285 Kirby Road lies within the R4
District. It is bounded on the east by the airport, on the south
by undeveloped land, on the west by a single family dwelling, and
on the north by Kirby Road.
Access/circulation: Access to lot #1 is provided by an existing
curb cut on Kirby Road. Lot #2 is proposed to be served by a curb
cut on Kirby Road east of the existing curb with a 20 foot
r.o.w.across lot #1.

of 9500 square feet.
