Belair, Administrative Officer Re: Appeal #AO-10-02, Agenda Item #4 Date: January 14, 2011 Appeal #AO-10-02 of Heritage Flight and City of Burlington, Burlington International Airport appealing the decision of the Administrative Officer to deny Certificate of Occupancy #CO-10-62 for occupancy of a hangar, 228 Aviation Avenue. BACKGROUND 1. On November 22, 2010 Heritage Flight, hereinafter referred to as "Applicant", filed Certificate of Occupancy (C. 0.) application #CO-10-62 on behalf of the property owner, City of Burlington/Burlington International Airport, hereinafter referred to as "Owner". (see exhibit A) 2. The C.O. application was for work completed on 10/1/10 at 228 Aviation Avenue under zoning permit #ZP-08-310 (see exhibit B) for the construction of an aircraft hanger. 3. The Administrative Officer inspected the property for compliance with the approved plans and the Applicant and/or Owner installed barbed wire on the fence surrounding the fuel tank area. The approved site plan depicts only an "Whigh chain link fence" and does not propose barbed wire.(see exhibits C & D) 4. The Administrative Officer denied the C.O. request on 11/30/10 for noncompliance with the South Burlington Land Development Regulations. 5. The Applicant and the Owner filed a Notice of Appeal (#AO-10-02) on 12/10/10 appealing the decision of the Administrative Officer's decision to deny the C.O.(see exhibit E) 6. A public hearing notice that a hearing on the appeal would take place on January 18, 2011 was published in The Other Paper on 12/23/10. JUSTIFICATION FOR DENIAL 1. The DRB approved a site plan that depicts only an "8' high chain li,nk fence" and does not propose barbed wire. The as -built fence, which 575 Dorset Street South Burlington, VT 05403 tel 802.846.4106 fax 802.846.4101 www.sburi.com includes three strands of barbed wire, does not comply with the approved site plan. Section 13.17(C) of the South Burlington Land Development Regulations lists prohibited fences and materials. Section 13.17(C)(1) of the South Burlington Land Development Regulations states "barbed, razor or ribbon wire or broken glass as part of any fence, unless specifically permitted". Since barbed wire is not specifically permitted anywhere in the regulations, it is therefore prohibited (see exhibit F). 2. 24 VSA 4448(a) states in part that the Administrative Officer "shall administer the bylaws literally and shall not have the power to permit any land development that is not in conformance with those bylaws". The Administrative Officer therefore had no authority to permit the barbed wire and had no choice but to deny the C.O. for the aircraft hanger which directly violated the South Burlington Land Development Regulations. 3. Section 17.03(C) of the South Burlington Land Development Regulations states "Within thirty (30) days after notification in the form of a complete application made to the Administrative Officer that a building or structure or premises or part thereof is ready for occupancy or use, it shall be the duty of the Administrative Officer to have made a final inspection thereof and issue a certificate of occupancy if the project is found to conform with the provisions of this ordinance". The Administrative Officer found that the subject project did not conform with either the approved site plan or the provisions of the South Burlington Land Development Regulations. Therefore, the C.O. was denied. The 8 foot high chain link fence with three strands of barbed wire enclosing the Heritage fuel tanks was installed to ensure public safety and provide security of aviation fuel stored in this facili - ty. This fencing conforms with Federal Aviation Regulation (FAR) Part 139 section 139.355 Public Protection states the following: (a) In a manner authorized by the Administrator, each certificate holder must provide— (1) Safeguards to prevent inadvertent entry to the movement area by unauthorized persons or vehicles; and (2) Reasonable protection of persons and property from aircraft blast. (b) Fencing that meets the requirements of applicable FAA and Transportation Security Administration (TSA) security regulations in areas subject to these regulations is acceptable for meeting the requirements of paragraph (a)(1) of this section. The standards for this fencing are provided in FAA Advisory Circular 150/5370-1 OE. Fuel storage facilities are considered subject to these regulations under part (b) by the FAA and TSA and therefore the Airport construction standard for fencing must be used. The FAA standards are federal requirements that must be adhered to and cannot be superseded by local zoning requirements. V A ARTICLE 13 SUPPLEMENTAL REGULATIONS 13-32 (7) No fence shall be erected in such a manner as to inhibit or divert the natural drainage flow or cause the blockage or damming of surface water. (8) No fence shall be erected that may create a fire hazard or other dangerous condition or that may result in obstruction to fire fighting. (9) Fences shall be maintained in a safe and substantial condition. (1o) No fence shall be located or constructed on a terrace or wall that will have an overall height of more than that permitted, unless otherwise approved by the Development Review Board as a conditional use subject to the provisions of Article 14, Conditional Use Review. C. Prohibited Fences and Materials. The following fences and fencing materials are specifically prohibited: %� (1) Barbed, razor or ribbon wire or broken glass as part of any fence, unless specifically permitted. (2) Pointed metal fences. (3) Canvas and/or cloth fences, except when used to protect shrubs and vegetation. (4) Poultry and/or turkey wire fences within minimum front, side and rear yards. (5) Temporary fences, unless for snow control. Snow control fences shall be allowed from November 1 through to the following May 1. (6) Expandable fences and collapsible fences, except during construction of a building. (7) Chain link fences erected with the open loop at the top of the fence. D. Exemption. All existing fences that do not conform to the provisions of these regulations may be continued as they presently exist, except that these fences shall not be altered, extended, replaced or modified except in accordance with these regulations. 13.18 Utility catin'ets and Similar Structures A. Cxgneral Requirements. In any district, the Development Review Board may grant site plan approval for the construction of a utility cabinet, according to the following regulations. B. SDecific Standards for Utility Cabinets and Similar Structures. (1) The facility shall serve the City of South'Burlington and/or immediately adjacent communities. (2) The minimum required lot for a public utility cabinet, substation, or communication relay station may be reduced from the zoning district requirements, at the- discretion of the Development Review Board. In the event that the facility shall be erected on property not owned by the utility, the Development Review Board'shall require that the facility be located unobtrusively. (3) If the parcel containing the facility is landlocked, there shall be a recorded easement or permission granting access to the utility or owner of the facility. W- - There shall be suitable fencing to protect the public and sufficient landscaping with evergreens of sufficient height and density to screen effectively the facility from surrounding property. bouth Burlington Land Development Regulations Effective January 11, 2010 E ARTICLE 13 SUPPLEMENTAL REGULATIONS 13-31 (i) Duration of the permit for any length of time that the Development Review Board deems appropriate. (2) Submission of an acceptable plan for the rehabilitation of the site at the conclusion of the operations, including grading, seeding and planting, fencing, drainage, and other appropriate measures. (3) Hours of operation, routes of transportation, and amount of material to be removed. (4) Provision of a suitable bond or other security adequate to assure compliance with the provisions of this section. D. Removal of Earth Products within Flood Plain District. Within the Flood Plain District, excavation of earth products shall be prohibited in such cases where it is anticipated that such excavation will lower the level of the water table or will interfere the natural flow patterns or reduce the flood storage capacity. E. Exemption. The provisions of this section shall not apply to the removal of earth products from an operating farm, nursery, or cemetery to the extent that such removal is necessary to the operation of same. An official exemption shall be obtained from the Administrative Officer, who will determine if Development Review Board approval is or is not required. 13-17 Fences A. General Requirements. In this section, fence and wall shall be interchangeable terms. B. SDecific Requirements. All fences are subject to the following provisions: A fence shall be erected within the boundaries of the applicant's property and shall be placed wholly within but not on the property boundaries - (2) A fence shall be erected so that its smooth or finished side faces an abutting property or roadway. All fence posts shall be placed on the inside of the fence, except for a fence to contain livestock. (3) 'No part of any fence shall be placed in such manner as to visually obstruct vehicular or pedestrian traffic. If determined necessary by the Administrative Officer, the placement of fences near the corner of a property at the intersection of two roads shall provide for a clear vision area defined as a triangular area formed by the right-of-way lines at points which are thirty (30) feet distant from the intersection of the right-of-way lines and measured along such lines. (4) A fence over four (4) feet in height shall require a zoning permit from the Administrative Officer. (5) A fence over eight (8) feet in height shall require approval by the Development Review Board as a conditional use subject to the provisions of Article 14, Conditional Use Review. (6) A fence over eight (8) feet in height shall be considered a structure subject to normal setback requirements for the zoning district, unless otherwise approved by the Development Review Board as a conditional use subject to the provisions of Article 14, Conditional Use Review. . South Burlington Land Development Regulations Effective January 11, 2010 (111) Shock. (iv) Primary patient survey. (v) Injuries to the skull, spine, chest, and extremities. (vi) Internal injuries. (vii) Moving patients. (viii) Burns. (ix) Triage. (5) A record is maintained of all training given to each individual under this section for 24 consecutive calendar months after completion of training. Such records must include, at a minimum, a description and date of training received. (6) Sufficient rescue and firefighting personnel are available during all air carrier operations to operate the vehicles, meet the response times, and meet the minimum agent discharge rates required by this part. (7) Procedures and equipment are established and maintained for alerting rescue and firefighting personnel by siren, alarm, or other means authorized by the Administrator to any existing or impending emergency requiring their assistance. 0) Hazardous materials guidance. Each aircraft rescue and firefighting vehicle responding to an emergency on the airport must be equipped with, or have available through a direct communications link, the "North American Emergency Response Guidebook" published by the U. S. Department of Transportation or similar response guidance to hazardous materials/dangerous goods incidents. Information on obtaining the "North American Emergency Response Guidebook" is available from the Regional Airports Division Manager. (k) Emergency access roads. Each certificate holder must ensure that roads designated for use as emergency access roads for aircraft rescue and firefighting vehicles are maintained in a condition that will support those vehicles during all-weather conditions. (1) Methods and procedures. FAA Advisory Circulars contain methods and procedures for aircraft rescue and firefighting and emergency medical equipment and training that are acceptable to the Administrator. (m) Implementation. Each holder of a Class U, III, or IV Airport Operating Certificate must implement the requirements of this section no later than 36 consecutive calendar months after June 9, 2004. § 139.321 Handling and storing of hazardous substances and materials. (a) Each certificate holder who acts as a cargo handling agent must establish and maintain procedures for the protection of persons and property on the airport during the handling and storing of any material regulated by the Hazardous Materials Regulations (49 CFR 171 through 180) that is, or is intended to be, transported by air. These procedures must provide for at least the following: (1) Designated personnel to receive and handle hazardous substances and materials. (2) Assurance from the shipper that the cargo can be handled safely, including any special handling procedures required for safety. (3) Special areas for storage of hazardous materials while on the airport. (b) Each certificate holder must establish and maintain standards authorized by the Administrator for protecting against fire and explosions in storing, dispensing, and otherwise handling fuel (other than articles and materials that are, or are intended to be, -20- aircraft cargo) on the airport. These standards must cover facilities, procedures, and personnel training and must address at least the following: (1) Bonding. (2) Public protection. (3) Control of access to storage areas. (4) Fire safety in fuel farm and storage areas. (5) Fire safety in mobile fuelers, fueling pits, and fueling cabinets. (6) Training of fueling personnel in fire safety in accordance with paragraph (e) of this section. Such training at Class III airports must be completed within 12 consecutive calendar months after June 9,2004. (7) The fire code of the public body having jurisdiction over the airport. (c) Each certificate holder must, as a fueling agent, comply with, and require all other fueling agents operating on the airport to comply with, the standards established under paragraph (b) of this section and must perform reasonable surveillance of all fueling activities on the airport with respect to those standards. (d) Each certificate holder must inspect the physical facilities of each airport tenant fueling agent at least once every 3 consecutive months for compliance with paragraph (b) of this section and maintain a record of that inspection for at least 12 consecutive calendar months. (e) The training required in paragraph (b)(6) of this section must include at least the following: (1) At least one supervisor with each fueling agent must have completed an aviation fuel training course in fire safety that is authorized by the Administrator. Such an individual must be trained prior to initial performance of duties, or enrolled in an authorized aviation fuel training course that will be completed within 90 days of initiating duties, and receive recurrent instruction at least every 24 consecutive calendar months. (2) All other employees who fuel aircraft, accept fuel shipments, or otherwise handle fuel must receive at least initial on-the-job training and recurrent instruction every 24 consecutive calendar months in fire safety from the supervisor trained in accordance with paragraph (e)(1) of this section. (f) Each certificate holder must obtain a written confirmation once every 12 consecutive calendar months from each airport tenant fueling agent that the training required by paragraph (e) of this section has been accomplished. This written confirmation must be maintained for 12 consecutive calendar months. (g) Unless otherwise authorized by the Administrator, each certificate holder must require each tenant fueling agent to take immediate corrective action whenever the certificate holder becomes aware of noncompliance with a standard required by paragraph (b) of this section. The certificate holder must notify the appropriate FAA Regional Airports Division Manager immediately when noncompliance is discovered and corrective action cannot be accomplished within a reasonable period of time. (h) FAA Advisory Circulars contain methods and procedures for the handling and storage of hazardous substances and materials that are acceptable ' to the Administrator. § 139.323 Traffic and wind direction indicators. In a manner authorized by the Administrator, each certificate holder -21- protecting —all NAVAIDS on its airport against vandalism and theft; and (c) Prevent, insofar as it is within the airport's authority, interruption of visual and electronic signals of NAVAIDS. § 139.335 Public protection. (a) In a manner authorized by the Administrator, each certificate holder must provide— (1) Safeguards to prevent inadvertent entry to the movement area by unauthorized persons or vehicles; and (2) Reasonable protection of persons and property from aircraft blast. (b) Fencing that meets the requirements of applicable FAA and Transportation Security Administration security regulations in areas subject to these regulations is acceptable for meeting the requirements of paragraph (a)(1) of this section. § 139.337 Wildlife hazard management. (a) In accordance with its Airport Certification Manual and the requirements of this section, each certificate holder must take immediate action to alleviate wildlife hazards whenever they are detected. (b) In a manner authorized by the Administrator, each certificate holder must ensure that a wildlife hazard assessment is conducted when any of the following events occurs on or near the airport: (1) An air carrier aircraft experiences multiple wildlife strikes; (2) An air carrier aircraft experiences substantial damage from striking wildlife. As used in this paragraph, substantial damage means damage or structural failure incurred by an aircraft that adversely affects the structural strength, performance, or flight characteristics of the aircraft and that would normally require major repair or replacement of the affected component; (3) An air carrier aircraft experiences an engine ingestion of wildlife; or (4) Wildlife of a size, or in numbers, capable of causing an event described in paragraphs (b)(1), (b)(2), or (b)(3) of this section is observed to have access to any airport flight pattern or aircraft movement area. (e) The wildlife hazard assessment required in paragraph (b) of this section must be conducted by a wildlife damage management biologist who has professional training and/or experience in wildlife hazard management at airports or an individual working under direct supervision of such an individual. The wildlife hazard assessment must contain at least the following: (1) An analysis of the events or circumstances that prompted the assessment. (2) Identification of the wildlife species observed and their numbers, locations, local movements, and daily and seasonal occurrences. (3) Identification and location of features on and near the airport that attract wildlife. (4) A description of wildlife hazards to air carrier operations. (5) Recommended actions for reducing identified wildlife hazards to air carrier operations. (d) The wildlife hazard assessment required under paragraph (b) of this section must be submitted to the Administrator for approval and determination of the need for a wildlife hazard management plan. In reaching this determination, the Administrator will consider— (1) The wildlife hazard assessment; -26- 9/30/2009 AC 150/5370-IOE ITEM F-161 WIRE FENCE WITH STEEL POSTS (CLASSES C AND D FENCES) DESCRIPT10N 161-1.1 This item covers the requirements for furnishing materials and constructing new wire fences and gates with steel posts in accordance with the details included herein and as shown on the plans. The class of fence to be erected shall be either Class C, woven wire fencing surmounted by two strands of barbed wire, or Class D, four strands of barbed wire, as indicated on the plans and in the bid proposal. MATERIALS 161-2.1 WIRE. a. Woven Wire (Zinc -coated). The woven wire fencing shall be 7-bar, 26-inch (66 cm) field fence with top and bottom wires No. 10 gauge, and filler and stay wires No. 12 1/2 gauge. Stay wires shall be spaced 6 inches (150 mm) apart. All wire shall be smooth galvanized steel wire conforming to ASTM A 121, Type B. All wires shall be two -dip and spaced as shown on the plans. b. Barbed Wire (Zinc -coated). Zinc -coated barbed wire shall be 2-strand twisted No. 12 1/2 gauge galvanized steel wire with 4-point barbs of No. 14 gauge galvanized steel wire. All wire shall conform to ASTM A 121, Type A. The barbs shall be spaced approximately 4 inches (100 mm) apart. c. Barbed Wire (Copper -covered). Copper-covercd steel barbed wire shall conform to ASTM A 121, Type A. d. Barbed Wire (Aluminum -coated). Aluminum -coated steel barbed wire shall be 2-strand twisted No. 12 1/2 gauge. The 4-point barbs of No. 14 gauge aluminum -coated steel wire shall be spaced approximately 5 inches (125 mm) apart. The steel wire shall have a tensile strength of between 60,000 and 80,000 pounds per square inch (413 400 and 551 200 kPa) and the aluminum coating shall have a minimum weight of .30 ounce per square foot (0.07 kilogram per square meters) of wire surface on the No. 12 1/2 gauge line wire and .25 ounce per square foot (0.06 kg/square meter) of wire surface on the No. 14 gauge barbs. e. Bracing Wire (Zinc -coated). Wire used for cable for bracing shall be No. 9 smooth galvanized soft wire. 161-2.2 FENCE POSTS, GATES, RAILS, BRACES, AND ACCESSORIES. These items, when specified, shall conform to the requirements of Fed. Spec. RR-F- 191 and shall be zinc -coated. 161-2.3 CONCRETE. Concrete shall be of a commercial grade with a minimum 28-day compressive strength of 2500 psi. CONSTRUCTION METHODS 161-3.1 GENERAL. The fence shall be constructed in accordance with the details on the plans and as specified herein using new materials, and all work shall be performed in a workmanlike manner satisfactory to the Engineer. Prior to the beginning of the work or upon the request of the Contractor, the Engineer shall locate the position of the work by establishing and marking the property line or fence line. When directed, the Contractor shall span the opening below the fence with barbed wire fastened to stakes of the required length at locations of small natural or drainage ditches where it is not practical to conform the fence to the general contour of the ground surface. The new fence shall be permanently tied to the terminals of existing fences whenever required by the Engineer. The finished fence shall be plumb, taut, true to line and ground contour, and complete in every detail. When directed, the Contractor shall stake down the woven wire fence at several points between posts. When directed, in order to keep stock on adjoining property enclosed at all times, the Contractor shall arrange the work so that construction of the new fence will immediately follow the removal of existing fences. The length of F-161-1 AC 150/5370-IOE 9/30/2009 unfenced section at any time shall not exceed 300 feet (90 in) or such length that the stock can be kept in the proper field. The work shall progress in this manner and at the close of the working day the newly constructed fence shall be tied to the existing fence. Any openings in the fence shall be guarded when stock is using the adjoining property. 161-3.2 CLEARING FENCE LINE. The site of the fence shall be sufficiently cleared of obstructions, and surface irregularities shall be graded so that the fence will conform to the general contour of the ground. The fence line shall be cleared to a minimum width of 2 feet (60 cm) on each side of the centerline of the fence. This clearing shall consist of the removal of all stumps, brush, rocks, trees, or other obstructions that will interfere with proper construction of the fence. Stumps within the cleared area of the fence shall be placed a uniform distance above ground, as specified in the plans. When shown on the plans or as directed by the Engineer, the existing fences which coincide with, or are in a position to interfere with, the new fence location shall be removed by the Contractor as a part of the construction work unless such removal is listed as a separate item in the bid schedule. All holes remaining after post and stump removal shall be refilled with suitable soil, gravel, or other material acceptable to the Engineer and shall be compacted properly with tampers. The work shall include the handling and disposal of all material cleared, excavated or removed, regardless of the type, character, composition, or condition of such material encountered. 161-3.3 INSTALLING POSTS. All posts shall be spaced as shown on the plans. Comer, brace, anchor, end, and gate posts shall be set in concrete bases as shown on the plans. The top of the base shall be slightly above the ground surface, trowel finished, and sloped to drain. Holes of full depth and size for the concrete bases for posts shall be provided even if blasting of rock or other obstructions is necessary. All line posts may be either driven or set in dug holes to a penetration of 3 feet (90 cm). All post setting shall be done carefully and to true alignment. Dirt removed for placing posts, anchor bars, flanges, etc., shall be replaced, tamped, and leveled. When posts are driven, care shall be exercised to prevent marring or buckling of the posts. Damaged posts shall be replaced at the Contractor's expense. No extra compensation will be made for rock excavation. Rock excavation shall not be grounds for extension of time. 161-3.4 BRACING. All comer, anchor, end, and gate posts shall be braced as shown on the plans. Anchor posts shall be set at approximately 500-foot (150 meters) intervals and braced to the adjacent posts. 161-3.5 INSTALLING WIRE. All barbed wire and woven wire shall be placed on the side of the post away from the airport, or as directed, at the height indicated on the plans. The woven wire shall be carefully stretched and hung without sag and with true alignment. Care shall be taken not to stretch the wire so tightly that it will break in cold weather or pull up comer and brace posts. All horizontal wires shall be fastened securely to each post by fasteners or clips designed for use with the posts furnished. The woven wire shall be wrapped around end, comer, and gate posts, and the ends of all horizontal wires shall be tied with snug, tight twists. The wire shall be secured to prevent slipping up and down the post. Barbed wire strands shall be stretched and each strand secured to each post to prevent slipping out of line or becoming loose. At end, comer, and gate posts the barbed wire shall be securely wrapped and anchored once about the post from outside and secured against slipping by tying the ends with snug, tight twists. However, on spans of less than 100 feet (30 in) both ends of the span need not be wrapped around the posts. The bottom wire of the woven wire fencing shall clear the ground by not more than 4 inches (100 mm) or less than I inch (25 mm) at any place. 161-3.6 SPLICING WIRE. Splices in barbed and woven wire will be permitted if made with an approved galvanized bolt -clamp splice or a wire splice made as follows: The ends of each wire shall be carried 3 inches (75 mm) past the splice tool and wrapped around the other wire for at least six turns in opposite directions. After the tool is removed, the space occupied by it shall be closed by pulling the ends together. The unused ends of the wire shall be cut close to make a neat, workmanlike job. 161-3.7 INSTALLING GATES. The gates shall be hung on gate fittings as shown on the plans. They shall be attached in such a manner that the gate cannot be lifted off the hinges. Gates shall be erected to swing in the direction indicated and shall be provided with gate stops, as specified or as shown on the plans. Gates shall be erected at locations shown on the plans. (see exhibit A) 2. The C.O. application was for work completed on 10/1/10 at 228 Aviation Avenue under zoning permit #ZP-08-310 (see exhibit B) for the construction of an aircraft hanger. 3. The Administrative Officer inspected the property for compliance with the approved plans and the Applicant and/or Owner installed barbed wire on the fence surrounding the fuel tank area. The approved site plan depicts only an "8' high chain link fence" and does not propose barbed wire.(see exhibits C & D) 4. The Administrative Officer denied the C.O. request on 11/30/10 for noncompliance with the South Burlington Land Development Regulations. 5. The Applicant and the Owner filed a Notice of Appeal (#AO-10-02) on 12/10/10 appealing the decision of the Administrative Officer's decision to deny the C.O.(see exhibit E) 6. A public hearing notice that a hearing on the appeal would take place on January 18, 2011 was published in The Other Paper on 12/23/10. JUSTIFICATION FOR DENIAL 1. The DRB approved a site plan that depicts only an 8 high chain link fence" and does not propose barbed wire. Section 13.17(C) of the South Burlington Land Development Regulations lists prohibited fences and materials. Since barbed wire is not specifically permitted anywhere in the regulations, it is therefore prohibited (see exhibit F). 2. 24 VSA 4448(a) states in part that the Administrative Officer "shall administer the bylaws literally and shall not have the power to permit any land development that is not in conformance with those bylaws". The Administrative Officer therefore had no authority to permit the barbed wire and had no choice but to deny the C.O. for the aircraft hanger which directly violated the South Burlington Land Development Regulations. 3. Section 17.03(C) of the South Burlington Land Development Regulations states "Within thirty (30) days after notification in the form of a complete application made to the Administrative Officer that a building or structure or premises or part thereof is ready for occupancy or use, it shall be the duty of the Administrative Officer to have made a final inspection thereof and issue a certificate of occupancy if the project is found to conform with the provisions of this ordinance". The Administrative Officer found that the subject project did not conform with either the approved site plan or the provisions of the South Burlington Land Development Regulations. General Requirements. In any district, the Development Review Board may grant site plan approval for the construction of a utility cabinet, according to the following regulations. B. Specific Standards for Utilitv Cabinets and Similar Structures. (1) The facility shall serve the City of South, Burlington and/or immediately adjacent communities. (2) The minimum required lot for a public utility cabinet, substation, or communication relay station may be reduced from the zoning district requirements, at the discretion of the Development Review Board. In the event that the facility shall be erected on property not owned by the utility, the Development Review Board shall require that the facility be located unobtrusively. (3) If the parcel containing the facility is landlocked, there shall be a recorded easement or permission granting access to the utility or owner of the facility. (4) There shall be suitable fencing to protect the public and sufficient landscaping with evergreens of sufficient height and density to screen effectively the facility from surrounding property. The provisions of this section shall not apply to the removal of earth products from an operating farm, nursery, or cemetery to the extent that such removal is necessary to the operation of same. An official exemption shall be obtained from the Administrative Officer, who will determine if Development Review Board approval is or is not required. 13.17 Fences A. General Requirements. In this section, fence and wall shall be interchangeable terms. B. S1ecific Requirements. All fences are subject to the following provisions: (1) A fence shall be erected within the boundaries of the applicant's property and shall be placed wholly within but not on the property boundaries. (2) A fence shall be erected so that its smooth or finished side faces an abutting property or roadway. All fence posts shall be placed on the inside of the fence, except for a fence to contain livestock. (3) No part of any fence shall be placed in such manner as to visually obstruct vehicular or pedestrian traffic. If determined necessary by the Administrative Officer, the placement of fences near the corner of a property at the intersection of two roads shall provide for a clear vision area defined as a triangular area formed by the right-of-way lines at points which are thirty (30) feet distant from the intersection of the right-of-way lines and measured along such lines. The pipe under aviation ave is merely an equalizer pipe put in place for large storm events. All flow to the east of aviation ave goes into the wetland contiguous to Muddy brook and flows into a pipe that goes under the airport runway and into muddy brook by the quarry. ANR considers this to be part of the Muddy Brook watershed. Regarding the inlets, I'm going to bring it up to Erich Finely (project manager) and Heritage Aviation to see if they would be interested. Let me know as soon as you have details and I can send those over to give them an idea of what we're aiming for. Thinking more about the 5 in/hr rule, if we were to assume a greater infiltration rate, the infiltration basin would shrink and the pre-treatment area would grow... it's really a balancing act and without knowing more about why the rule is in place I have a hard time making the change. It comes down to, do you want more area to infiltrate or more area to pre -treat... 6 to one, half dozen to another... We would like to offer the following comments: The proposed project discharges to a class 2 wetland contiguous with Muddy Brook. Ok The application should indicate the % Impervious cover for the entire lot area. Parking Lot impervious area talcs: 55,376 SF of Impervious and 7,697 SF Pervious = 12.2%. 4 1. It appears this property is covered under an existing State stormwater permit (3845-INDS.A). The applicant should confirm that changes on this site are allowed under the terms and conditions of the existing permit, or submit an updated permit. Existing permit and the permit for this project are separate from the direction of Helen Carr at ANR. Permit attached. 3. The applicant should provide a drainage area map for the proposed stormwater treatment practices. Drainage area map in the attached permit application 4. In order to confirm compliance with section 15.13.F(3) the applicant must submit modeling for the 25 year storm event. I modeled the 25 year storm and checked the capacity of the culvert. There were no issues. Reports attached. 5. The applicant should show snow storage locations on the site plan. Snow will be stored in the infiltration basins 6. The DRB should include a condition requiring the applicant to regularly maintain all stormwater treatment and conveyance infrastructure. ok 7. Due to the vicinity of the adjacent to four (4) 25,000 gallon jet fuel tanks and three (3) 4,500 gallon glycol tanks, the applicant should confirm that soils are not contaminated in the areas where infiltration is proposed. As required by their permit, they have been required to document any spills that may have occurred. We've requested that they provide any documentation of an occurrence. One thing that should be known is that these are above ground tanks within a containment system as required for the porous parking lot. Also, the Glycol tanks have been moved off this site. The application should indicate the % Impervious cover for the entire lot area. 1. It appears this property is covered under an existing State stormwater permit (3845-INDS.A). The Class 2 wetland is designated as a warm water fish habitat in the Vermont Water Quality Standards. 4.0 EXISITNG CONDITIONS Land Cover: The site is an existing porous concrete lot surrounded by a grassed area and a large airport support hangar and sidewalks to the north with fueling tanks on a concrete pad to the south. Existing Impervious: A large airport support hangar, sidewalks and a concrete pad for fueling tanks make up the existing impervious area draining to S/N 002. Discharae Locations: Discharge Point S/N 002 is an existing culvert under Eagle Drive located downhill and south of the site. Discharge Point S/N 001 is an existing culvert under Eagle Drive located uphill and North of the site. Runoff from the building drains to a bio- retention/Infiltration/detention basin. The basin discharges stormwater to a stone lined ditch running along Eagle Drive that outlets at an existing culvert under Eagle Drive (S/N 002). The concrete pad with the fuel tanks and the sidewalks sheet flow, and infiltrate through the porous concrete lot and into the groundwater. Soils: Although the site is on fill soils it is still capable of excellent infiltration rates. Infiltration testing was conducted on the native soils in 10 locations to determine if the site was feasible for permeable pavment. The testing yielded an overall site infiltration rate of 21 inches/hour. The infiltration testing can be found in Section b. This rate is higher than the peak intensity for the 100 year, type Il, 24 hour storm in Chittenden County. The native subsoils are capable of infiltrating rain faster than it can fall. Although the porous concrete is structurally deteriorating, it is still capable of infiltrating large rainfall events. Any overflow is directed to a ditch at the south end of the lot where it is directed to a stone lined ditch along Eagle Drive. Existing Permits: The site is currently permitted to discharge stormwater under Permit 3845 GP-9010 (originally permit 3845-INDS.A.). An ACT 250 permit is pending under permit 4C0331-23A. An amendment to existing Individual Construction Permit #VT50000170 3028-INDC.1 is under review. Impervious Areas: The impervious areas treated includes the existing hangar, the existing concrete pad for the fuel tanks, the sidewalks, a proposed hangar that was never built and some associated site balancing areas. The parking lot was considered completely pervious and did not require any treatment. 6.0 PROPOSED STORMWATER SYSTEM Impervious Area: The existing impervious area to pass through the proposed treatment devices includes sidewalks north of the lot and a concrete pad with fuel tanks south of the lot, approximately 0.31 acres. The existing impervious is already covered under an existing permit through site balancing. New impervious will include the new bituminous concrete lot, approximately 1.18 acres. Receiving Water: Class 2 Wetland Contiguous to Muddy Brook Cold/Warm Habitat: Per appendix A of the Vermont Water Quality Standards the receiving water is classified as a warm water fish habitat. Discharge Location: Discharge Point S/N 002 is an existing culvert under Eagle Drive located downhill and south of the site. 5 unified sizing Criteria: Water Quality Treatment Standard - The entire Water Quality Volume (Basin# 1 = 0.033 acre- ft and Basin #2 = 0.050 acre-ft) will be infiltrated into the ground water using infiltration basins. Groundwater Recharge Treatment Standard - The entire Recharge Volume (Total = 0.039 acre-ft) will be infiltrated into the ground water using infiltration basins. Channel Protection Standard - The entire Channel Protection Volume (Basin# 1 = 0.082 acre-ft and Basin#2 = 0.117 acre-ft) will be infiltrated into the ground water using a infiltration basins Overbank Flood Protection Standard - The entire Overbank Flood Protection Volume (Basin# 1 = 0.130 acre-ft and Basin#2 = 0.185 acre-ft) will be infiltrated into the ground water 12 of 113 l Stantec using infiltration basins. The existing discharge flowrate during the 10 year storm is 4.06 cfs and is maintained at 4.06 cfs. Extreme Flood Protection Standard - The site meets the waiver for the extreme flood protection standard because the impervious area is less than 10 acres. Stone lined overflows on the infiltration basins will be provided to safely pass the 100 year storm. Manner of Discharge: Runoff originates from the impervious parking lot. It sheet flows south across the lot and into a pretreatment area. Runoff then flows into two infiltration basins sized to detain the 10 year storm. The runoff is then infiltrated into the ground water over a 24 hour period. Anything over the 10 year storm will pass safely through emergency spillways into existing ditches along the road then into a 36" culvert under Eagle Drive. 7.0 ADDITIONAL INFORMATION See section 6 for Conceptual Infiltration basin sizing, pre-treatment sizing, soil infiltration results and a copy of the EPSC plan. 13 of 113
