2. The road from Corporate Way along the southern boundary of
this property shall be widened to at least 24 feet prior to
permit.
3. An additional $3,000 in landscaping shall be required. A
landscaping plan shall be approved by the City Planner and a
$3,000 landscaping bond posted prior to permit.
4. The site plan approval is conditional on revisions to the
floor plan as follows:
Dining Room 150 seats maximum
Banquet room (esiting) 60 seats maximum
Bar/lounge 47 seats maximum
Greenhouse 52 seats maximum
TOTAL ................309 seats maximum
No seating shall be placed within areas shown on the plan as
storage.
5. The applicant shall keep the number of parking places
shown on the plan free of snow by trucking away snow as
necessary so that it does not block any spaces.
6. The building permit shall be obtained within 6 months.
Mr. Burgess seconded the motion.
Mr. Burgess asked what ability the City had to enforce the
seating maximums. Mrs. Lafleur said the Zoning Administrator
could put them on notice and then, if needed, go to Court.
Mr. Poon stressed that storage areas wouldn't be used for
seating until they got more land. He added that there were
times when it would be necessary to add an extra seat to a
table for a larger party of guests and at those times seating
totals might exceed the maximums.
In the vote which followed, the motion was defeated
unanimously.
Mr. Dooley then moved that the application of Sheun Poon for
a 720 sq. ft. greenhouse addition to the China Lite
Restaurant be denied. Mr. Burgess seconded, and the motion
passed unanimously.
4. Consider Final Plat application of Alan Gigure for a sub-
division of land into 2 parcels of 16,977 sq. ft. with the
existing single-family dwelling and 12,038 sq. ft. located on
Airport Parkway and south of 237 Kirby Rd.

Mr. Jacob noted that the City Manager would like the
triangular piece of land across Airport Parkway deeded to the
City. Mr. Gigure said he didn't see why they should so this.
He preferred the piece to go with the larger lot, but the
Commission felt this was not appropriate as it was closer to
the smaller piece. Mr. Belter questioned why construction
had already begun. Mrs. Lafleur noted that it was approved
by the Zoning Board for multiple uses on one lot.
Mr. Dooley moved that the South Burlington Planning Com-
mission approve the Final Plat application of Alan Gigure for
the subdivision of a lot into a 161977 sq. ft. lot with an
existing house and a 12,038 sq. ft. lot on Kirby Road and
Airport Parkway as depicted on a plan entitled "two lot
subdivision for Harry R. Gigure" prepared 12y Palmer Company,
Ltd, dated 10/26/80, last revised 9/9/85 with the following
stipulations:
1. The 1574 sq. ft. parcel is considered part of and shall be
attached to lot #2•
2. The revised Final Plat shall be recorded with the City
Clerk within 90 days.
Mr. Belter seconded the motion which passed unanimously.
5. Election of new Chairman
Mr. Burgess nominated Mr. Jacob. Mrs. Hurd seconded.
Mr. Jacob then nominated Mr. Burgess. Mr. Belter seconded.
In the vote which followed, Mr. Jacob was elected
unanimously.
Mrs. Hurd moved that Mr. Burgess be Vice Chairman. Mr.
Belter seconded, and the motion passed unanimously.
6. Consider sketch plan application of KW Ventures for con-
struction of a 108 room motel on 2.3 acres located west of
the Grand Union, Hinesburg Road, and east of Midas Muffler on
Williston Road
Robert Karol advised that the motel would be located behind
Fassetts and the Home Emporium and would be part of the
Quality Inn chain (Comfort Inns). Rooms would be moderately
priced, full size (12 x 26) with no kitchenettes, restaur-
ants or lounges.
Mrs. Lafleur advised that since there is a 4-acre minimum for
a p.c.d., they are asking the Commission to consider the re-

5) HARRY R. GIGURE, 2 LOT SUBDIVISION, AIRPORT PARKWAY
The 1,574 Square foot parcel located across Airport Parkway is
too small to be of any value to Mr. Gigure plus it is a drainage -
way. The City has possession of land to the west of this parcel
most of which is a drainageway. See attached sketch. The City
ownership of this small parcel would allow access to the drainage -
way for cleaning and dredging, however, if Mr. Gigure feels strongly
for retaining ownership, I would not pursue the issue.
6) K.W. VENTURES MOTEL, WILLISTON ROAD
1. There exists a drainageway along the southerly boundary of
this property. This drainageway has a large watershed area including
a portion of Williston Road. The proposed parking lot may be
within the 50 foot stream setback and should not be.
2. There should be a buffer strip (5 feet minimum) between the
drive connecting the property to the east (Grand Union) and the
property to the north-east (Bolton)
7) SUMMER WOODS, PATCHEN ROAD
1. The access road is too close to the property to the north and
the existing house. This will require snow to be pushed onto
the adjacent property and house. The access road should be south
of the house.
2. Internal walkways should be provided. They should extend to
Patchen Road and J.C. Park.

5) GIGURE, 2 LOT SUBDIVISION
Alan Gigure requests Final Plat approval of this two lot subdivi-
sion that was reviewed by the Commission several weeks ago. The
new undeveloped lot is of adequate size for a duplex. See Bill
Szymanski's memo regarding the triangular piece of land across
Airport Parkway. It abuts City owned land and appears useless to
anyone since it is a drainage way. He suggests it be dedicated
to the City.
6) KW VENTURES, WILLISTON ROAD (MIDAS MUFFLER ROAD)
KW Ventures proposes to construct a 108 room motel on 9.3 acres
owned by Pomerleau. It abuts the Grand Union on Hinesburg Road,
and the Midas Muffler property and is part and parcel of the
property on which the Home Emporium, the Fassetts Bakery Thrift
Shop, the Tackle Shop and a sign shop are located. It will he on
land leased to KW Ventures.
This 2.3 acre leased parcel, the frontage along Williston Road
and the Grand Union property comprise the required 4 acre minimum
for a planned commercial development.
A traffic study is required showing the level -of -service calcula-
tions at Hinesburg Road, White Street and the private Midas
Muffler Street. The plan shows a connection to Hinesburg Road
through the Grand Union lot to ease Williston road congestion.
Obviously, this connection works to the benefit to both uses and
perhaps to circulation in the area. The Grand Union lot
configuration must be shown in order to evaluate this properly.
The effect of this connection on traffic conditions at each
intersection must be evaluated.
The drainage way at the rear of the property is of significant
size. A 50 foot setback of parking and building is required for
this. (See Bill's memo)
Sewer: This project requires 21,600 gpd of sewer capacity.
There are presently 17,995 gpd available.
Height: The proposed height is 3 stories and 34.5 feet.
Other: The sign ordinance must be adhered to for on site signs.
There shall be no off -premise (off leased -limit) signs except for
standard Vermont State roadway signs.

SOUTH BURLINGTON PLANNING COMMISSION
The South Burlington Planning Commission will hold a public hearing at the
South Burlington City Hall, Conference Room, 575 Dorset Street, South Burlington,
Vermont on Tuesday, March 18 1986, at 7:30 P.M. to consider the
following:
1_) Final Plat application of Alan Gigure jor two -lot subdivision
of a 28,000 square foot lot into a 16,977 square foot lot with exist-
ing house and a 12,038 square foot lot. Property is bounded on the
east by land of C. and J. Handy, and V. Franco, and on the west by
the City of South Burlington and to the north and south by Kirby
Road and Airport Parkway.
2) Revised Preliminary Plat of Lakewood Associates for an increase
in the size of the proposed office space to 48,000 square feet in
6 buildings as well as a 1600 sq:.. ft. addition to the existing Inn for a
150 seat restaurant. Property is bounded by properties of T. Farrell
and A. Lewis and is located at 1233 Shelburne Road.

27,600 square foot addition for retail space and mall area and a re-
location of the bank facility at the Factory Outlet Mall. Property

will remain until they find an alternate location. Hackett,
Valine & MacDonald is renovating 3/4 of the building and want
to develop part of the basement for an employee lounge, kitchen,
bathrooms, conference room, mail room, and project room. There
will be no regular office space in the basement. Mrs. Maher asked
whether the Planner thought finishing the basement would generate•addi-
traffie: 'Mrs. Lafleur said probably not, but she was concerned
about parking spaces. Mrs. Maher asked if Mr. Hackett felt they
would have enough parking, and Mr. Hackett replied he was confident
they would. Mr. Burgess asked whether the Commission could prevent
someone in the future from finishing off the basement for office
uses some years down the line. Mrs. Lafleur said the Commission
could stipulate the allowable uses.

4) GIGURE,!231 KIRBY ROAD, SKETCH PLAN
The applicant proposes to subdivide the 29,000 square foot lot
into two lots measuring 16,977 square feet with an existing
house and garage and 12,038 square feet. A duplex will be
permitted on the smaller lot with access from Airport Parkway.
There do not see to be any particular problems with this
proposal. See Bill's and Jim's memos.
5) VERMONT STRUCTURAL STEEL, HINESBURG ROAD
The applicant has provided two additional options for open space/
recreational areas. Both options increase the buffer strip along
Hinesburg Road to continue the Butler Farms precedent.
Option I increases the size of the proposed open space adjacent
to Butler Farms to six acres. It provides a pedestrian buffer
along the stream/drainageway that will allow skiing or walking
to adjacent parcels, such as to the Calkins property. Its
proximity to Butler Farms provides open space for that development
as well. I am concerned that this open site is not well drained
and may not be a suitable recreation area without a good drainage
plan. Bruce and I plan to visit the site Tuesday. However, it is
probably not the best time of year to judge drainage.
Option II, places the open area at the northern end of the
development with 2 acres in the residential area and 8 acres in
the industrial area. By using these industrial acres as part of
the total the applicant proposes to increase the number of lots to
130 which is still less than the maximum of 156. They propose to
offer 13.5 acres of open space, which is above the 15% required.
Both options offer access to the industrial lot and remove this
access acreage from the total for calculating open space.
Of the two options, Bruce and I prefer the second option due to the
potential of connecting with other properties and the size of
the parcel. This option also provides a buffer of sorts to the
industrial land. However, I still feel a better option is on the
residentally zoned land in the northwest corner but these are the
best residential lots and use of residential land for open space
will result in smaller lots.

1) GIGURE - AIRPORT PARKWAY, 2 LOT SUBDIVISION
Overall I do not see a problem. There must be a proper drive to
get one truck in, or a parking area.
2) HACKETT, VALINE & MCDONALD, 140 KENNEDY DRIVE
Plans have been reviewed by the fire department. Overall the
building location is good but a second hydrant is needed because
of water supply required. I do not see a problem if approved/
as long as some one comes in to work out details of hydrant. Also,
when the building was approved by the state, the basement area
could not be used for anything but storage unless it was sprinklered
since it is a windowless area. State approval is required for this.

Re: Airport Parkway development
Dear Mr. Franco:
Be advised that the development of your Airport Parkway land
is subject to subdivision approval by the Planning Commission.
Permission was obtained last fall for construction of a single-
family dwelling by your son. It appears that the entire
parcel is in the development stages.
The stripping of the land requires review and approval by
the City Engineer. To my knowledge no action towards securing
approvals has been taken. It also is my understanding that
stumps and debris is being pushed into the drainageway located
near your land. Both the stripping and the disposal of the
stumps and other debris could be considered as a violation.
We request that you cease any further development of the land
in question until all necessary approvals are secured.

t Our office has completed an initial review of the above
referenced project and have determined that the additional
information listed below will be needed before approval can be
granted. Please note that those comments concerning the interior
waste and water distribution and ventilation plans were prepared
by Mr. Robert Hood, Environmental Technician.
(1) Horizontal waste and water distribution plumbing plans
must be submitted drawn to scale and indicating exactly
where the sewer and water services will enter the
building either up through the building slab or through
the foundation wall.
(2) The waste and vent riser diagram must indicate the size
of all piping to fixtures and all fixtures shall be
identified from a fixture schedule.
(3) The house trap must have a fresh air intake vent.
(4) The water riser diagram must identify all fixtures from a
fixture schedule.
(5) Indicate the type of waste, vent and water distribution
piping to be used above and below grade within the
building.
(6) Indicate the C.F.M. of the bathroom exhaust fans and show
duct work to the outside air.
(7) Please be advised that all revised plans must be
submitted in duplicate.

the survey work, and could no lond,er contain a duplex. Because of the chanEe in
size, the Zoning Board appeal has been rewarned but Kr. Spitz felt the Commission
could give approval, if it so wished, subject to Zoning Board approval. The new
lot is 10,960 sq. ft. and will need a front yard variance.
It was noted that normally the Commission likes to have Zoning Board approval
first, but that this application had been before the Commission already and had
been delayed. It was also noted that if the Zoning Board made any changes, the
application would have to return to the Commission anyway.
Nothing will happen with the tiny piece of land across the street from the
main lot.

and be 2 bedroom units. No basement is planned but there will be carports. 32
parking spaces are planned but more can be added. Yr. Foger said the Commission
has been requesting 2 parking spaces per unit. Mr. Ewing mentioned a gravel
area for parking of boats, campers,etc.
Mr. pions suggested a stipulation that there be no access from Williston Road,
and requiring the present home to use the new private road was also mentioned,
although that .may not be a good idea.
Yx. Liu was told to discuss the plan with the Fire Chief.

at the corner of Airport Parkway and Kirby Road
Mr. Spitz noted that the parcel in question was split when Airport Parkway
was constructed. Two plans for the subdivision were shown, with one of them
including the small parcel separated from the rest of the lot by the road as
part of the square footage of the lot. A variance will be required to build in
either case because of the 75' setback from Airport Parkway.
:sir. Levesque felt the city had created the hardship when it constructed
the road and increased the lot size by 3,000 'sq. f t.
isr. ...ona wanted to count the little piece of land, since it was separated
from the rest of the land by eminent domain. 'Mr. Poger preferred option 2.
He was told that if that option were taken, the lot would' not contain 18,000
sq. ft., but he noted that the city had caused some of the problems so it should
allow a smaller lot.
Option #2, without the little piece of land, was preferred by the Commission.
The meeting was adjourned at 11:00 pm.

5) Liu/Victory
Ying Lui is proposing to purchase the large majority of Emery
Victory's land (5 + acres) and to construct a 21-unit PUD. The
proposed road and building layout is not shown yet, but the sketch
plan is being scheduled to show the proposed change in lot lines.
Emery Victory proposed to sell one parcel without road frontage
to the abutting NCR company. This potential transaction must be
confirmed by the proposed purchaser. He also claims that a 23,000
square foot parcel in the front now belongs to his son through a
will -connected court decree. However, no municipal approval has
been given for this lot. •therefore, this parcel (which was in-
cluded in land shown or. previous Victory subdivisions) is also sub-
ject to review at this time.
6) Gi ure
Applicant owns a parcel on Kirby Road and Airport Parkway that
was split in two when the latter road was built. A small parcel,
1732.5 square feet, is undevelopable; a larger parcel, 31,000
square feet with an existing house fronting on Kirby Road, is being
proposed for a 2-lot subdivision.
The enclosed maps show 2 alternative options for a subdivision,
one including the small parcel across the road as part of the minimum
lot size requirement. Because of the required 75 foot setback from
Airport Parkway, a variance will be needed to allow construction
on either subdivision option. The Planning Commission can provide
input to the Zoning Board on which lot divisions and setback variances,
if any, it prefers.
