Ms. Quimby seconded. Motion passed unanimously: 4. Public Hearing: Application #MS-02-05 of Ronald & Sheila Kingsbury seeking approval under Section 25.118, Exceptions to Yard Setback and Lot Coverage Requirements. Request is for permission to allow a 12'x20' accessory structure to encroach ten feet beyond the 15 foot rear yard setback limitation, 6 & 8 Tanglewood Drive: Mr. Kingsbury said he has built the shed and did not know he needed a permit. He also didn't know about the setback requirement. Mr. Dinklage noted receipt of letters of support and also a letter of opposition. He noted the shed could be moved. Ms. Perault said there are actually 2 sheds. Mr. Kingsbury said the plastic one will be taken down and there will be only one. Ms. Perault felt the shed was out of character with the neighborhood. Mr. Dewer felt it was built as well as a home and didn't both him. Mr. Kupferman noted that setbacks are a big concern of the DRB, and he would like to see the shed moved back. Mr. Boucher agreed and noted that the nearest neighbor is objecting. Mr. Boucher read the motion of approval for miscellaneous use application #MS-02- 5 of Ronald and Sheila Kingsbury. Mr. Cameron seconded. The vote on the motion was 1-5. The motion was thus defeated. 5. Public Hearing: Application #CU-02-14 of John & Arlene Duffy seeking conditional use approval under Section 26.05 Conditional Uses, of the South Burlington Zoning Regulations. Request is for permission to allow an accessory residential unit within a single family dwelling, 236 Kirby Rd: Mr. Duffy noted this was originally built as a mother-in-law property. He noted that the Airport will take the property within the next year. In the meantime, he would like to rent it. He understood the stipulation that it must be a blood relative. Mr. Belair said that many years ago Mr. Duffy applied to the Zoning Board for a variance with the stipulation that the property would revert back to a single family dwelling when the person occupying the apartment was no longer there. Ms. Quimby moved to approve conditional use application 4CU-02-14 of John & Arlene Duffy subject to the stipulations in the draft motion of 2 July 2002. Mr. Farley seconded. Motion passed unanimously. Mr. Cameron stepped down during the hearing on item #6 due to a conflict of interest. 6. Public Hearing: Application #CU-02-13 of Great Northern Construction, Inc., seeking approval under Section 26.05, Conditional Uses, of the South Burlington Zoning Regulations. Request is for permission to reconstruct a retaining wall, 58 Bartlett Bay Road: Mr. Schwartz said this is currently a pressure treated wall. It is not a sea wall. A question was raised about using an arsenic treated wood. The wall will be above the high-water mark and there will be no pressure treated wood at the water level or below. No vegetation will be removed. Mr. Bruhn, the abutter to the north, said this is part of a larger project he wished he'd paid more attention to. He is concerned that work on the project begins at 7 a.m., and it is very jarring. He asked for a stipulation that construction work cannot be done before 8 a.m. and not on weekends. Mr. Belair noted the city's "quiet hours" are between Midnight and 8 a.m. Mr. Dinklage asked the applicant to comply with this city ordinance and not begin noisy work before 8 a.m. Mr. Boucher moved the Board approve conditional use application #CU-02-13 of Great Northern Construction, Inc., subject to the stipulations in the draft motion of 2 July 2002. Mr. Farley seconded. Motion passed unanimously. 7. Site Plan application #SP-02-32 of Pizzagalli Properties to construct a 30,000 sq. ft. general office building, 62 Tilley Drive: Mr. Boucher expressed concern that the Board did not have a copy of the traffic study and said he did not want to make a decision before having a chance to review the study. Mr. Bouchard said it was submitted a few weeks ago. Mr. Dinklage asked if turning lanes are required. The Board shall determine that the proposed encroachment will not have an undue adverse affect on: i. Views of adjoining and /or nearby properties; ii. Access to sunlight of adjoining and /or nearby properties; iii. Adequate on -site parking; and iv. Safety of adjoining and/or nearby property. The applicant has provided letters from most abutting property owners that have no issues with the accessory structure (letters enclosed). Ms. Margo Wood Kingsley (at 248 Laurel Hill) has expressed dismay with the accessory structure and it's proximity to her property line. Her letter is also enclosed. 5) CONDITIONAL USE APPLICATION OF JOHN AND ARLENE DUFFY, 236 KIItBY ROAD This project consists of a request for permission to allow an accessory residential unit within a single family dwelling. The accessory residential unit already exists. This property located at 236 Kirby Road lies within the R4 District. It is bound on the north by airport property, on the east and west by a single family residence, and on the south by Kirby Road. CONDITIONAL USE CRITERIA The proposed project complies with the stated purpose of the R4 District "to encourage residential use at moderate densities that are compatible with existing neighborhoods" and does not adversely affect: a) the capacity of existing or planned community facilities - no effect expected b) the character of the area affected - no adverse effect is expected c) traffic on roads or highways in the vicinity the proposed use is not expected to affect traffic. d) bylaws in effect- the proposal is in conformance with the zoning regulations e) utilization of renewable energy resources- there is no utilization of renewable energy resources to be affected. 0 general public health and welfare - no adverse effect expected. Accessory Residential Units: The applicant should be prepared to address Section 26.75 of the South Burlington Zoning Regulations. Consent: The owner of the property signed the design review application. RECOMMENDED CONDTIONS: 1) All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2) All future sign applications shall conform with the Master Signage Plan below: a) All signs on the property shall be construct of exterior grade plywood or Gatorboard and assembled of individual pieces (letters and the approved flag logo), creating a three dimensional effect. b) The colors, red, white, blue, and black, shall be the same as those shown in the photo (and in the required scaled drawing). c) The lighting of all signs shall consist of indirect illumination provided that the source of light shall concentrate the illumination on the sign to prevent glare. 3) The applicant shall obtain a sign permit pursuant to section Five of the Sign Ordinance prior to installation of the approved sign. 4) This approval of the proposed sign design is based solely on the application's compliance with the design review criteria contained in Section 8 of the South Burlington Sign Ordinance. The determination of whether or not this application complies with all other requirements contained in the sign ordinance shall be made by the Code Officer. 4) CONDITIONAL USE APPLICATION OF RONALD AND SHEILA KINGSBURY, SETBACK MODIFICATION, 6 AND 8 TANGLEWOOD DRIVE This project consists a request for permission to allow a 12'x20' accessory structure to encroach ten (l 0) feet beyond the 15 foot rear yard setback limitation. Staff discovered that the structure was built without a permit and placed the owners in violation. This property located at 6 and 8 Tanglewood Drive lies within the R4 District. It is bounded on north and east by single-family residences, on the south by a duplex, and on the west by Tanglewood Drive. Setbacks: The applicant should be prepared to address Section 25.118 (c) (i)-(iv) of the South Burlington Zoning Regulations. 3 DEVELOPMENT REVIEW BOARD MEMO July 2, 2002 MEETING 26.751 Occupancy of the accessory residential unit is restricted to not more than two (2) persons, one of whom is related by blood or marriage to the owner of the primary single-family residence, or is disabled as defined in subdivision 252 (2) of Title 18, or is at least 55 years of age. 26.752 Floor space of the accessory residential unit shall not exceed 30% of the floor space of the existing living area of the primary single family residence or 400 square feet, whichever is greater. The existing primary residence is 1920 square feet. The proposed residential accessory unit is 560 square feet. The proposed accessory unit is 29% of the existing primary residence. 26.753 The primary single-family residence is occupied by the owner. 6) CONDITIONAL USE APPLICATION OF GREAT NORTHERN CONSTRUCTION, INC., 58 BARTL ETT BAY ROAD. This project consists of a request for permission to reconstnict a retaining wall. This property at 58 Bartlett Bay Road lies within the C. O. and Lakeshore Neighborhood Districts. The property is bounded on the north and south by residential development, to the east by Lakeview Lane, and to the west by Lake Champlain. I C.O. DISTRICT CRITERIA The applicant should be prepared to address Section 3.506 (d) of the South Burlington Zoning Regulations. 1) Erosion control measures and water -oriented improvements such as docks, seawalls, steps and walkways leading down to the lake... may be approved provided the following conditions are met; (a) The improvement involves, to the greatest extent possible, the use of natural materials such as wood and stone. (i) Staff would like to see some other then arsenic based pressure treated wood (b) The improvement will not increase the potential for erosion. (i) No the wall will help prevent additional erosion. (c) The improvement does not have an undue adverse impact on the aesthetic integrity of the lakeshore. - (i) The improvement does not have an undue adverse impact. (d) The improvement results in minimal removal of trees, shrubs and groundcover. Additional planting may be required to mitigate removal of vegetation or potential aesthetic impacts. (i) the proposed project does require the removal of any significant trees. This property at 62 Tilley Drive lies within the Mixed Industrial Commercial, Traffic Overlay District, and Conservation Open Space District. It is bounded on the north by a residential lot (Tilley Farm), on the east by agricultural land, on the west by Hinesburg Road, and on the south by I-89. Lot coverage/Setbacks: Building coverage is proposed at 7.6% (maximum allowed is 30%). Overall coverage is 33.4% (maximum allowed is 70%). The front yard coverage is 14.9% (maximum allowed is 30%). It is unclear to staff whether this is for Hinesburg Road or Tilley Drive. Front yard coverage information is needed for the other street not provided. Access/ Circulation: Access to the lot is via a proposed public street (Tilley Drive) off Hinesburg Road. Circulation on site is adequate. Parking: The parking requirement for the 30,000 square foot office building is 120 parking spaces and five (5) accessible spaces. The applicant is proposing 143 spaces with eight (8) accessible spaces. A bike rack is provided. C. O. District/Wetland Buffer: The applicant is proposing parking encroachment within the C.O. District/Wetland buffer. The applicant has supplied comments from WM. D Countryman, Environmental Assessment and Planning concerning the wetlands (letter enclosed).
